Groups in Mexico Push to Reclaim California, End Hidalgo Treaty

Groups in Mexico Push to Reclaim California, End Hidalgo Treaty

By Joe Gomez January 8, 2018 43 Comments

As open borders lobbyists push for an amnesty by way of a “DACA fix” or the DREAM Act, others are challenging the legitimacy of the current U.S. – Mexico border. Some prominent Mexicans are making the case that Mexico should return to its 1848 boundaries, by eliminating the Treaty of Guadalupe Hidalgo, a treaty that gave the U.S. large swaths of territory in the southwest. These were territories that were in dispute after the end of Spanish colonial rule in the area. At the end of the Mexican-American War, some 90 percent of residents in these territories chose to become U.S. citizens rather than Mexican citizens.

“The Mexican community on both sides of the border must be in solidarity and demand that the government go before the International Court of Justice of the United Nations and demand the revocation of the Hidalgo Treaty and compensation in the form of citizenship.” Reads a statement from the group Mexico Defends Yours. “Enough is enough! Stop the deportations!”

(Treaty of Hidalgo from Library of Congress)
The group attempts to make the case that territory in certain states was illegally gained by the United States Army during the Mexican – American War. And so there is no such thing as an illegal alien. “We are one, with or without papers,” they allege.

Separately, Cuauhtemoc Cardenas, a left-wing politician and former presidential candidate in Mexico, has also called for the Mexican Government to bring a lawsuit against the U.S. in the International Court of Justice. Cardenas’ attorney has promised to make a “strong and tough case… They [The U.S. Army] were in Mexican territory in a military invasion.” Acknowledging the practical impossibility of recovering lost territory, Cardenas instead wants monetary compensation for the United States use of the land over the past 168 years. In order for Cardenas case to be taken up, Mexico’s President Enrique Pena Nieto would have to adopt the suit. Nieto has declined to do so, but it could become an issue during Mexico’s next presidential election in July 2018.

Cardenas currently leads the organization “Por Mexico Hoy” or “For Mexico Today,” which according to its mission statement seeks to build “towards a sovereign country, of equals with justice and freedom.”

The thought that Cardenas’ and other groups would be making a push for Mexico to recover losses because of an “illegal” occupation by the U.S. in states like California is ironic, to say the least. California has become a sanctuary state, harboring millions of illegal immigrants, the majority of whom are from Latin America. California Governor Jerry Brown has even begun pardoning illegal aliens facing deportation.

This type of deference to illegal aliens by states like California has clearly emboldened some of the open border lobby in Mexico. But make no mistake, even if such a lawsuit to end the Treaty of Guadalupe Hidalgo is taken up by the Pena Nieto administration it likely has a slim chance of ever succeeding in the courts.

Mexico is still a hostile country. They will always be. They're thieves, gypsies and warlords who want to be "conquerors" but met their match here and were defeated. Why we cater to them at all over anything has always been beyond me.

I don't think we are surprised. " Reconquista."

Notice they don't mention paying back the millions given to them with that treaty that they agreed too and imagine today's monetary equivalent too.

I believe WE gave them money...they were broke and had to pay off loans and debts.

We bought it...YOUR President blew your money like they do now.

Get over it...they have beautiful land they turned into a wasteland of trash, poverty, gangs, rape, crime, murder, overbreeding, no education and drugs.

Now they are here to turn USA into the cesspool they left...just look all around where they live.

NO DACA, NO ANCHOR BABY AND NO PATH TO STAY

IF YOU LIKE YOUR CESSPOOL YOU CAN KEEP YOUR CESSPOOL...WE DO NOT LIKE IT HERE!

    Mexico-US treaty invalid, politician claims

Legal claim is one of two regarding Mexico's territory

Mexico News Daily | Friday, March 10, 2017
The deterioration in relations between Mexico and the United States has triggered a couple of claims over the countries’ common border, one of which would put into question the ownership of five U.S. states and parts of four others.

A prominent Mexican politician and a lawyer yesterday proposed a legal claim that would invalidate the treaty with which Mexico surrendered half its territory to the United States.

Former Mexico City mayor and three-time presidential candidate Cuauhtémoc Cárdenas and lawyer Guillermo Hamdan Castro argue that the 1848 Treaty of Guadalupe Hidalgo fails several tests as to its validity.

The treaty gave the U.S. what is now California, New Mexico, Arizona, Nevada and Utah and parts of Colorado, Wyoming, Kansas and Oklahoma.

Hamdan said during a presentation in Cuernavaca, Morelos, yesterday that the most important element is in the accord’s first sentence, which contains an admission that the U.S. army invaded Mexico. Signing an agreement in that context renders it null, he said.

Another legal factor is that the agreement ceding Mexico’s territory was signed under pressure.

Hamdan conceded it would be impossible for Mexico to recover the lost territory should the legal claim be upheld, but suggested instead the U.S. should pay compensation for the use of the land over the last 168 years.

But given that the dollar “has meant nothing since the 1970s,” he observed, payment should be in gold or pesos. No amount was stated.

Cárdenas, a founder of the leftist Democratic Revolution Party, and Hamdan are calling on Mexicans to join them in a march to Los Pinos, official residence of President Enrique Peña Nieto, to present the proposal.

Hamdan said the president is the only person who can take the claim before the International Court of Justice.

The second claim is that 430 kilometers of the border was incorrectly marked, meaning that about 85,000 hectares now in Arizona and New Mexico actually belong to Mexico.

The claim has been made by Senator Patricio Martínez, a former governor of Chihuahua, who discovered the mistake in the 1990s. In the mid-19th century, he said, piles of stones were used to mark the border.

But towards the end of the century Mexico found the cairns had been destroyed and parts of the border marked too far south, according to a report today by the Financial Times.

Martínez’ discovery was based on an engineer’s report. A second study conducted since has confirmed the finding, he said. Now he plans to file a motion in the Senate to have the mistake corrected.

He said the matter was raised by Mexico in a letter to the Secretary of State in 1897, but was subsequently forgotten.

American beat their ass in a big war, Americans paid them a huge amount of money, and let Mexicans stay in the US who had lived here before the war. Most victors just take the land, they don't pay for it. Most victors kick out the enemies to avoid future wars and disputes over the same issues. Americans were extremely kind and generous to the Mexicans on all fronts. In return, the Mexicans have whined and grumbled just like all losers do throughout the ages, no different than all the other cess-pool nations in the world. They're stupid snowflakes, no different than DemoQuacks.

Meixcan Americans are wonderful people and they are Americans. I know they wish our government would do something to stop illegal immigration, to deport illegal aliens and enforce our laws. It is only the group that came in illegally who complain, that's why you should never grant an amnesty, besides being illegal and unconstitutional to do, there is no just or valid reason to do so. It's stupidity and weakness, silly baby talkers, who whine for a free ride because they think they're special and above the law, a complete contradiction to the beliefs and standards of our nation.

"The treaty called for the U.S. to pay US$15 million to Mexico and to pay off the claims of American citizens against Mexico up to US$3.25 million. It gave the United States the Rio Grande as a boundary for Texas, and gave the U.S. ownership of California and a large area comprising roughly half of New Mexico, most of Arizona, Nevada, and Utah, and parts of Wyoming and Colorado. Mexicans in those annexed areas had the choice of relocating to within Mexico's new boundaries or receiving American citizenship with full civil rights."
