A federal judge has suggested that when two men used false Social Security cards to gain employment at the local Pilgrim’s Pride plant, they might not have technically broken the law.

Juan Luis Dardon-Canelo and Andres Loarca-Reynoso, along with three others, are being criminally prosecuted in the wake of a large immigration raid in April. Today, they were set to plead guilty to using an illegal identification document — a Social Security card — to gain work at Pilgrim’s Pride.

U.S. District Judge Harry S. Mattice’s revelation that Social Security cards are not necessarily valid forms of identification, however, sent the defense back to the drawing board with no complaints from the federal government.

Judge Mattice recalled a 2003 case in which the government prosecuted Tyson Foods for hiring illegal immigrants. In that case, U.S. District Judge R. Allan Edgar dismissed certain charges with regard to the use of a Social Security card, ruling that a certain section of U.S. immigration law does not list the document as a valid form of I.D.

“This is an issue that will have to be decided by a higher court,â€

Really? Then why are US citizens required by LAW to present their SS numbers when applying for jobs?

Seriously.....fill me in.....I'm spending money to protect this number which identifies who I am. This single number saves me or destroys me......if it's nothing....hey let the rest of know!

It's as if the judicial system bends over backwards to find every conceivable loophole and excuse to give illegal aliens a break.

I am hopeful that what the judge is saying, is that Pilgrim’s Pride is liable, for the employment of these men, without validating their SS numbers, using DHS's E-Verify system.

It would be good to really hang the employer out to dry with an immense fine!!

Make an example of them!! Put the fear of God into all other employers!!

The judge doesn't need to decide the issue as whether or not a social security is a valid form of identification. Rather, he only needs to decide if in fact the defendants presented a social security number (other than one issued to them by the Fed gov) in an effort to gain employment. They either did or they didn't! Stop thinking Judge and just apply the law as it pertains to the facts of this case!

Why are these judges so willing to distort the law and it's interpretation in order to protect these illegal invaders. I don't get it!

And just why then do we have to show a SS # to get a drivers license...

I'm not clear on what the judge was saying here or what it means but it doesn't seem like it was in the favor of the defense.

Notice they said it sent them back to the drawing board? That means that one must start over again. And, since it was applied to the defense and not the prosecution that doesn't indicate that it was good news for the IAs.
