Molester admits offense, tries to blame 11-year-old

EASTON | A 27-year-old Mexican immigrant admitted Wednesday to molesting an 11-year-old girl, but he rankled a Northampton County judge when he told her the girl was the one who initiated the relationship.
"She was after me, your honor," Cleuris Jose Martinez told Judge F.P. Kimberly McFadden through a court interpreter.
McFadden quickly asked Martinez, "You sure you want to stick with that story?"
Martinez, of the 600 block of Ferry Street in Easton, then said he disputed the facts of the case, telling McFadden, "How could I have done these things with five people present?" When McFadden asked him if he was unwilling to admit to the charges and would face trial, Martinez backed off his statement and acknowledged he molested the girl.
Martinez further annoyed McFadden by smiling repeatedly as the court interpreter explained the facts of the case to him. McFadden later asked him what he was smiling about.
"I didn't mean to smile," Martinez told her.
"Yes, you did. I'm not stupid," McFadden replied.
Martinez then apologized for molesting the girl.
"All I can say is, I'm sorry," he said.
McFadden ordered Martinez to undergo both a sex offender and psychological evaluation before he is sentenced at 10:30 a.m. July 11.
"I want you to know I don't take this lightly at all," McFadden said, telling him that his actions were "abhorrent" and "disgusting."
"You have a problem. I don't want it to be our problem, you understand," she said.
Police said on several occasions between April 1 and Sept. 30, 2005, Martinez sexually assaulted an 11-year-old girl at a city residence. Assistant District Attorney Patricia Broscius said Martinez fondled the girl's breasts on multiple occasions and once tried to get into the shower with her.
While the girl was taking a shower, Martinez told her he wanted to have sex and she refused. Broscius said when the girl refused his advances, Martinez threatened to hurt her.
The charges also say between March 14 and Oct. 7, 2005, Martinez used another person's Social Security number and birth date to get a job at National Plastics on McFadden Road in Palmer Township.
Martinez pleaded guilty Wednesday to indecent assault, indecent exposure, terroristic threats, identity theft and tampering with records. In turn, prosecutors withdrew four counts of indecent assault and a count of tampering with records.
