    Former Nashua man convicted in beating death

    NASHUA – A former city man received the maximum sentence last week for his conviction in the beating death of another man outside a West Hollis Street restaurant in 2002.

    Diego Duran, 26, formerly of Nashua and Cartago Valle, Colombia, was convicted of manslaughter, but cleared of a more serious, second-degree murder charge in the death of Luis Otero, 62, of Nashua.

    Duran has asked the state Sentence Review Board to reconsider his 15-30 year prison sentence, the maximum state law allows for manslaughter.

    Otero never regained consciousness after he was beaten in an alleyway outside the former Tu Casa restaurant at 60 W. Hollis St., on the night of Oct. 26-27, 2002, and he died more than a month later at Massachusetts General Hospital in Boston.

    Duran returned to Colombia after the incident but was arrested and imprisoned there for an unrelated crime. He has remained jailed since his extradition back to the United States in 2005.He was convicted after a trial this spring in Hillsborough County Superior Court.     Duran’s sentencing originally was scheduled for July 19, and later postponed to Wednesday and then Thursday of this week. It was subsequently moved ahead to Aug. 14, however, court records show.

    Judge Bernard Hampsey sentenced Duran to the maximum sentenced allowed by state law for manslaughter.

    Duran and Otero were Colombian nationals and relatively recent immigrants to the United States. Prosecutors charge that Duran attacked Otero after an argument and scuffle over their respective home towns in Colombia, which are rivals. A mutual acquaintance had introduced the two men to each other earlier that night, witnesses testified.

    Several witnesses testified Duran admitted to beating and stomping Otero in the alley outside the restaurant, but Duran’s lawyers argued at trial that another man was responsible for the attack.

    We need to build the fence and start tracking visa violators ASAP. No more excuses. Just do the job. the money can come from the benefits being given to illegals and their children. Send them home and keep the families together.
