    Kyl criticizes Fox

    WASHINGTON, D.C. - U.S. Senator Jon Kyl (R-Ariz.) today urged Mexican President Vicente Fox to respect the United States' right to defend its borders and "demonstrate perhaps a little less disdain for the rule of law north of the border."

    "I agree with President Fox that it is unacceptable for civilian groups to take the law into their own hands, and that individuals who volunteer to help the Border Patrol in a lawful way must guard against extremism in their ranks," Kyl said. "But at the same time, President Fox does not appear to grasp the high level of frustration over illegal immigration in states like Arizona, and his pre-emptive threats to file lawsuits on behalf of those crossing the border unlawfully is hardly helpful, since it presumes that illegal aliens have more of a right to break American law than American citizens have to peacefully assist authorities in enforcing it."

    Moreover, Kyl called Fox's recent ridicule of border walls, such as a new "triple fence" planned for San Diego, "downright insulting."

    "For one thing, the United States is a sovereign nation that has every right to protect our borders, as other countries do, without baseless accusations of 'discrimination'. The process for entering the United States legally is straightforward and not terribly difficult - deterrence measures like walls only discriminate against those who intend to break the law."

    Fox recently claimed in an interview that security along the border was "as high a priority for (Mexico) as it is for the United States," and that Mexico has been "very cooperative" with U.S. officials on security measures to create an "orderly flow" of legal immigrants and commerce across the border.

    "If President Fox is serious about helping to reduce illegal immigration, a good start would be to prohibit his government's production of materials like the free comic book guide to crossing the border illegally and living unobtrusively so as not to attract the attention of law enforcement," Kyl said. "I doubt Mr. Fox would appreciate it if the U.S. government started giving out free advice on how to get away with tax fraud in Mexico City."

    It's about dang time a Senator grew a set and called this jerk on his outrageous insulting remarks. Everyone needs to write to Sen Kyl and thank him for standing up for America.

    Well I doubt you'll be hearing from the likes of Hillary Clinton, Ted Kennedy and John McCain because they love the invasion of our country and hate America in general, but maybe if Senator Kyl can get a handful of Senators to join him in taking Vicente Fox to task (maybe some of the more conservative Republicans and Democrats if there is such a thing in the Senate anymore) then I would say that would be a major victory.

    Heck, just getting one Senator to lash out is huge.

    Kyl's off-road patrol plan meets general resistance

    An Arizona senator wants the U.S. Border Patrol to have more off-road access when combatting illegal smuggling operations that rip through pristine deserts along the border.
    Jon Kyl, R-Ariz., says his proposed pilot program could slow smugglers and the environmental degradation they cause in the Sonoran Desert, as well as boosting homeland security. But a Tucson-based conservation agency hates the idea and park rangers are afraid it will defeat the purpose of declaring fragile habitat a "refuge."

    At Buenos Aires National Wildlife Refuge, manager Wayne Shifflet said he is nervous about what the proposal may mean for what he calls "one of the most sensitive areas along the Mexican border." He acknowledges the problem coming from the south - about 1,000 illegal immigrants cross the border every day - has created 1,300 miles of unauthorized trails, but has questions about Kyl's proposal.

    "It could no longer fit the status of a national wildlife refuge if the manager didn't have control over the land that they're responsible for managing," Shifflet said of Kyl's proposal. "The Border Patrol is interested in apprehensions, we're interested in protecting the environment. But if we can work with the Border Patrol we can both meet our objectives."

    Organ Pipe Cactus National Monument Chief Ranger Fred Patton said he too is concerned about giving Border Patrol more access in the park.

    "In essence, we would be jeopardizing the very character that led to the wilderness designation in the first place," Patton said.

    The senator says it's an effort to stop criminals from destroying lands when they smuggle immigrants and drugs through places such as Organ Pipe and Cabeza Prieta National Wildlife Refuge. Kyl says he wants to eliminate barriers agents face, which smugglers exploit.

    "Nobody is talking about free rein, nobody is talking about eliminating the purpose of the refuge," Kyl said. "Somebody has to do something. It makes little sense to say that we're going to turn a blind eye to this environmental degradation."

    The Border Patrol's policy for going off road isn't clear.

    A spokeswoman for the agency in Washington, D.C., Gloria Chavez, said, "We don't have an off-road pursuit policy, per se."

    In Cabeza Prieta there is an interagency agreement between the Border Patrol and the U.S. Fish & Wildlife Service concerning what agents can and can't do.

    Basically, Border Patrol is restricted from going off road except if engaged in pursuit or for human health or safety reasons, said Refuge Manager Roger DiRosa.

    He noted that the Border Patrol recently requested an exemption from environmental laws within two miles of the border.

    "It'd be fair to say we are concerned about what this (new proposal) may mean," DiRosa said. "There needs to be some checks and balances."

    He says a proposed vehicle barrier for Cabeza Prieta, similar to one his neighbors at Organ Pipe are planning to erect, would be more effective in combatting the illegal traffic than giving agents more access for off-roading in the refuge.

    Border Patrol agents do regularly see a 20-minute video about environmental sensitivity and how to handle it, said Border Patrol Tucson Sector spokesman Rob Daniels.

    "We always try to stay on maintained, existing roadways," Daniels said.

    Another spokesman for the Border Patrol, Mario Villarreal, wouldn't comment on Kyl's proposal, which was sent to at least three agencies, including the Environmental Protection Agency and the Department of Homeland Security.

    But the Border Patrol already has a bad reputation with many environmental groups in the area and at least one of them is raging about Kyl's proposal.

    "Giving the Border Patrol a free license to drive in wilderness areas is like giving a group of convicted child molesters a license to run a day-care center," said Daniel Patterson, a desert ecologist with the Tucson-based Center for Biological Diversity.

    "This shows just how out of control both the Border Patrol and Sen. Kyl are and they'll stop at nothing to advance their antienvironmental, police state agenda."

    Jen Allen, director of the Tucson-based border watchdog group Border Action Network, also dislikes Kyl's plan.

    "(Border Patrol agents) are already degrading the environment in areas that aren't protected," Allen said.

    Off-road chases can be extremely harmful to the desert ecosystem, where it takes up to 60 years for one tire track to disappear.

    Endangered animals such as the Sonoran pronghorn, of which only about 20 are known to exist in the United States - generally in Organ Pipe and Cabeza Prieta - can be severely effected.

    The pronghorn has adapted so well to the desert it can go for days - nobody knows exactly how many - without water. It survives off moisture trapped in plants but the equation is fragile and in the driest times of year an off-road chase through pronghorn habitat could cause the animal to flee, using more energy than it has water for, thus in the worst case leaving one less pronghorn.

    Patterson says Kyl's proposal is a green light for the Border Patrol to destroy areas that need to be protected.

    Kyl disagrees.

    "You'd have to do a lot of damage going off-road to cause more damage than what's going on today," he said.

    Kyl insists it's just a pilot program to see if giving Border Patrol more access would be better or worse for the environment.
