Framingham child rape suspect convicted of illegally returning to U.S.

Authorities say Octaviano Boche, 48, had been deported seven times between 2004 and 2016, illegally returning each time. His sentencing is set for May 15.

BOSTON – A Guatemalan man who last year tried to flee the country to avoid rape charges in Framingham has been convicted in federal court for illegally re-entering the country.

Octaviano Boche, 48, pleaded guilty in U.S. District Court in Boston to one count of illegally re-entry of a previously deported alien.

In August, Framingham police obtained a Framingham District Court warrant to arrest Boche and charge him with rape of a child.

On Aug. 23, Boche was about to board a plane at Dallas/Fort Worth Airport in Texas for a flight to his native Guatemala. U.S. Customs and Border Protection officers stopped him and arrested him. Boche was later returned to Massachusetts where he was officially charged with rape of a child. Authorities said Boche had booked the flight after he found out Framingham police were investigating him.

At his Sept. 7 Framingham District Court arraignment, prosecutors said Boche raped a boy known to him several times between March 2017 and August 2017. The boy was 14 or younger during the alleged incidents.

After one of the alleged assaults, Boche allegedly offered the boy $200 to $300 not to tell anyone because Boche told the boy he (Boche) would get into trouble.

At Boche’s arraignment in Framingham, Judge Jennifer Stark ordered Boche held on $100,000 bail. The judge also revoked Boche’s bail on two open cases, holding him without bail for 90 days, and ordered him to stay away from the boy and not to contact him or any witnesses to the case. If Boche ever made bail, Stark ordered him to wear a GPS monitoring bracelet with exclusion zones from the boy’s home and other locations.

The case has since been indicted and moved to Middlesex Superior Court. Boche remains held. He is due back in court on Wednesday for a compliance hearing.

As for the federal case, authorities say Boche had been deported seven times between 2004 and 2016, illegally returning each time.

Judge Leo T. Sorokin set Boche’s sentencing for May 15. Boche faces two years in federal prison followed by one year of supervised release and a fine up to $250,000.
