    Feds: Painesville man bought weapons at gun shows, sold to undocumented immigrants

    CLEVELAND, Ohio -- A Painesville resident who authorities believe is in the United States illegally was arrested Tuesday after admitting to buying guns and selling them to undocumented immigrants, court filings show.

    Eli Padilla Moreno, 33, sold an assault rifle to an informant working for the Department of Homeland Security, according to a criminal affidavit filed Tuesday. During the sale, which was caught on video, Padilla Moreno also offered to sell the informant a machine gun.

    After his arrest, Padilla Moreno admitted to agents that he had bought and sold firearms at gun shows, the affidavit says. He is charged with possession of a firearm by an illegal immigrant. He is being held at a federal facility in Youngstown while he awaits trial.

    The case is expected to go to a federal grand jury.

    The affidavit says Padilla Moreno, a citizen of Mexico, obtained a nonimmigrant visa in May 2009. The visa is part of a program that allows U.S. employers to bring in foreign workers for a short time. Padilla Moreno came to the U.S. the same month he obtained the visa. By June 3, 2009, he had left his employer in Savannah, Georgia, the affidavit says.

    He obtained an Ohio driver's license on June 30, 2009. The temporary visa expired in November of that year, and Padilla Moreno did not file to renew it, the affidavit states.

    State records show that Padilla Moreno owns a landscaping company in Painesville called Eli Irrigation. Roger Synenberg, Padilla Moreno's attorney, declined to comment.

    The affidavit says Painesville police first found out about Padilla Moreno's activities in July, when a confidential informant told officers that he was buying weapons at gun shows and selling them to undocumented immigrants.

    Painesville police handed the case over to Homeland Security in September. An agent then talked to another informant, who told him that Padilla Moreno had sold him several weapons in the past few months, authorities say. That informant was the one who bought the assault rifle from Padilla Moreno.

    Agents also said that Padilla Moreno posted pictures of weapons on his Facebook page. In one photo, he posted two gold handgun grips with the names "Eli" and "Padilla" on them, the affidavit says.

    All federally licensed firearms dealers are required to ask for identification and perform a background check before selling a firearm to an individual. However, there is no law in Ohio that requires non-licensed firearm sellers who sell weapons at gun shows to check a buyer's background, according to John Fulkerson, deputy chief counsel at the Ohio Attorney General's Office.

    Still, Fulkerson said, it is illegal to sell a firearm to a non-Ohio resident or to an undocumented immigrant.

    An assault rifle IS a type of machine gun.

    Painesville man to be deported for selling guns to undocumented immigrants

    CLEVELAND, Ohio — A federal judge on Friday ordered a Painesville man to be deported for buying firearms at gun shows and selling them to undocumented immigrants.

    Eli Padilla Moreno, who has been in jail since September, will first serve a 10-month prison sentence.

    Speaking through a translator and with his loved ones watching, Padilla Moreno apologized to U.S. District Judge James Gwin "for wasting his time." He said the case has made him think about his family and how this affected them.

    The 33-year-old sold a Bushmaster assault rifle to an informant working for the U.S. Department of Homeland Security, according to a criminal affidavit filed in September. During the sale, which was caught on video, Padilla Moreno also offered to sell the informant a machine gun.

    After his arrest, Padilla Moreno confessed his scheme to agents. He pleaded guilty in September to two counts of possession of a firearm by an illegal alien, one for the assault rifle and one for a pistol.

    The U.S. Attorney's Office said that Padilla Moreno handled up to seven guns as part of the case. Gwin, in sentencing Moreno, said that it was clear that this was "somewhat of an ongoing scheme" and that there were likely more guns at play. He said there was also evidence that Padilla Moreno was also taking guns to Mexico.
