Sheriff Joe Fights Back: Appealing Court Ruling Barring Arrest of Hispanic Illegal Aliens

Maricopa County Sheriff Joe Arpaio is appealing a federal judge’s ruling that prohibited his deputies from detaining people under Arizona’s immigrant smuggling law based solely on the suspicion that they’re in the country illegally.

Arpaio’s lawyers told U.S. District Judge Murray Snow in a filing that they will appeal the judge’s preposterous Dec. 23 ruling in a lawsuit brought by the ACLU alleging that the sheriff’s deputies racially profiled Latinos in immigration patrols.

The ruling – like the Department of Justice’s recent accusations of racial profiling – was based almost entirely upon “testimony” of foreign nationals in the U.S. illegally, who insist they were doing nothing else wrong when they were stopped by one of Arpaio’s deputies and asked their immigration status.

Based on this flimsy racial premise, Snow has effectively handcuffed a Sheriff’s office that apprehends a remarkable 25% of all criminal illegal aliens in the U.S. every year.

Incredibly, in the same ruling, Snow also expanded the scope of a lawsuit against the Maricopa County Sheriff’s Office (MCSO) to include every Hispanic driver and passenger who has been stopped, detained, questioned or searched by MCSO deputies since January 2007 – potentially tens of thousands of individuals!

As if it was not bad enough for a sitting Federal judge to brazenly undermine the rule of law and put the public – in Arizona and beyond – at increased risk, Snow also awarded ACLU attorneys a staggering $90,000 in legal fees.

This judge’s despicable actions underline how critical it is that S.B. 1070 prevail in the U.S. Supreme Court, and that this entire open-borders Administration – Obama, Napolitano, Holder, Morton, Muñoz, et al – be removed from office in November.

For his part, Arpaio refuses to quit. He and his deputies have been working around the ruling to continue to apprehend illegals and keep the community safe – with one liberal AZ paper even accusing Arpaio of “defying” the Judge.

“I report to the people of Maricopa County,” Arpaio said, “and I intend to continue enforcing the immigration laws of the state of Arizona as long as I hold this office.”
