    Goodlatte: Executive Amnesty Contains ‘Sneaky’ Path to Citizenship

    President Obama’s recent executive orders on immigration include provisions that “place potentially hundreds of thousands of unlawful immigrants on a path to citizenship,” a top Republican revealed after a staff-level briefing from U.S. Customs and Immigration Services.

    “Your Department’s recent changes to this deferred action program seem to be a sneaky attempt to place potentially hundreds of thousands of unlawful immigrants on a path to citizenship,” House Judiciary Chairman Bob Goodlatte (R., Va.) wrote in a Friday letter to Homeland Security Secretary Jeh Johnson.

    The key is that DHS allows the illegal immigrants who enroll in the deferred action program established by Obama’s orders to apply for advanced parole status.

    “As you know, when an individual receives advance parole, upon return to the United States the individual can then be eligible to adjust to lawful permanent resident (LPR) status,” Goodlatte writes to Johnson. “And as you know, lawful permanent resident status is the precursor to U.S. citizenship. A simple search of the Internet reveals that immigration reform advocacy groups and immigration benefits law practices are fully aware of the path to citizenship that is afforded to DACA recipients through advance parole.”

    USCIS staff told Goodlatte’s office that 88 percent of illegal immigrants who applied for advance parole through the deferred action program in the last two years had their request approved.

    The mighty United States of America, a nation so busy going to the defense of other nations for the past 75 years, it lost itself without firing a shot defensively. Has that really made any sense? It is quite likely too late to ask now!

    So true, but it's never too late. Some of the damage is irreparable, that's true, trillions of our money wasted, millions of American lives ruined or severely diminished, tens of thousands of Americans killed or harmed, but our land is still here, most of US are still on it, and if you can still believe in right over wrong, it's never too late for good to prevail.

    It is hard to foresee any possible way that good will prevail concerning this cause in my lifetime. So, I wasted a very large portion of my life trying to help others see what American government was doing to them. After the death of my son there was little government could do to me that would have stopped me, and I believe that is why so long they ignored me, because they did not need to cause more negatives about government to talk about, their silence spoke more about their sincerity for Americans (none at all) than anything they could have said. I'm close to just turning it over to another generation, but will they carry the mantel?

    No, they'll be outnumbered. It's our generation and our parents who have to do it. And the drug cartels and those on their payrolls are betting on their lawlessness out-living US.

    House Judiciary Committee Chairman Bob Goodlatte is shining the light on a change made to the expanded Deferred Action for Childhood Arrivals (DACA) program that could put hundreds of thousands of illegal immigrants on a path to citizenship.

    According to the House Judiciary Committee, the Obama administration announced Thursday that it will allow illegal immigrants seeking deferred status to apply for DACA and advance parole (which allows them to travel abroad and reenter the country) simultaneously.

    The committee explains that once an immigrant receives advance parole, they could be able to adjust their status and get on a track to citizenship.

    Goodlatte raised the issue in a letter to Department of Homeland Security Sec. Jeh Johnson Friday; the Virginia lawmaker highlighted President Obama’s assertion that DACA would not lead to citizenship.

    “When announcing the creation of the DACA program on June 15, 2012, President Obama stated from the White House Rose Garden that, ‘Now, let’s be clear — this is not amnesty, this is not immunity. This is not a path to citizenship.’” Goodlatte wrote. “Unfortunately your Department seems to be acting contrary to the President’s intent in its implementation of DACA and the expanded DACA program set to begin next Wednesday, February 18, 2015.”

    The Judiciary chairman called the new changes to the program a “sneaky attempt to place potentially hundreds of thousands of unlawful immigrants on a path to citizenship.”

    In his missive to Johnson Goodlatte requested data related to the changes.

    “When the President of the United States tells the American people that DACA is ‘not a path to citizenship,’ no agency should take action in direct conflict with that statement. To do so is misleading the American people,” he wrote.

    Read the letter:

    Dear Secretary Johnson,

    I write regarding the Deferred Action for Childhood Arrivals (DACA) program and the grant of advance parole to DACA recipients.

    When announcing the creation of the DACA program on June 15, 2012, President Obama stated from the White House Rose Garden that, “Now, let’s be clear — this is not amnesty, this is not immunity. This is not a path to citizenship.” Unfortunately your Department seems to be acting contrary to the President’s intent in its implementation of DACA and the expanded DACA program set to begin next Wednesday, February 18, 2015. Your Department’s recent changes to this deferred action program seem to be a sneaky attempt to place potentially hundreds of thousands of unlawful immigrants on a path to citizenship.

    According to U.S. Citizenship and Immigration Services (USCIS), in the first two years of DACA implementation, over 6,400 DACA recipients requested advance parole. And out of the 4,566 cases decided by that time, only 566 had been denied. That is an advance parole grant rate of 88%. As you know, when an individual receives advance parole, upon return to the United States the individual can then be eligible to adjust to lawful permanent resident (LPR) status. And as you know, lawful permanent resident status is the precursor to U.S. citizenship. A simple search of the Internet reveals that immigration reform advocacy groups and immigration benefits law practices are fully aware of the path to citizenship that is afforded to DACA recipients through advance parole.

    As outlined on yesterday’s USCIS “Congressional Update and Teleconference” regarding the expanded DACA program, under the expanded program, DACA requestors will now be able to file applications for advance parole at the same time they file their DACA application. Such a process encourages advance parole applications and thus encourages DACA to be used as a path to U.S. citizenship.

    I am also troubled by the fact that, as USCIS staff noted during the teleconference in response to my Judiciary Committee staff asking how many DACA recipients given advance parole have come back into the U.S. and applied for adjustment of status, USCIS does “not have a way to track electronically” the number of DACA recipients who have received advance parole and who have subsequently applied for adjustment of immigration status. I can only hope that not having a way to track such requests is not intentional to avoid answering the very question my staff asked.

    I request that you immediately direct USCIS to stop accepting applications for advance parole from DACA recipients and to prohibit individuals applying for the expanded DACA program from applying for, or receiving, advance parole.

    In addition, I request that you immediately direct USCIS to track the following:

    1. The number of DACA recipients granted advance parole who after leaving the United States and returning pursuant to that parole authority, apply for adjustment of status.

    2. The number of those described above who are subsequently allowed to adjust their immigration status.

    3. The basis for each approved adjustment of status of the category of aliens described above.

    When the President of the United States tells the American people that DACA is “not a path to citizenship,” no agency should take action in direct conflict with that statement. To do so is misleading the American people.

    Thank you for your attention to this matter and I appreciate in advance your prompt and substantive response to this letter.

    Go Goodlatte! I like this approach very much. Jeh is now on notice, personally, that's he's violating US law.
