GOP Rep. Andy Biggs: Stop Dumping Illegals in Our Communities

The Biden administration must stop bringing illegal "aliens" into Arizona communities, particularly without a legal notice to appear (NTAs) and especially because the communities do not have the resources to handle their crisis, Rep. Andy Biggs, R-Ariz., warned in a letter to top U.S. officials Monday.

"This administration can't acknowledge the border crisis they created, but expect surrounding border communities to take care of the overflow of illegal aliens that are coming in the name of President [Joe] Biden," Biggs wrote in a statement.

"DHS should not be shifting the consequences of their horrible policy choices to our communities who don't have the resources to care for illegal aliens, and I'm working to stop it."

Biggs wrote a letter to Department of Homeland Security Secretary Alejandro Mayorkas, Acting Customs and Border Patrol Commissioner Troy Miller, and head of the Border Patrol's Tucson, Arizona, sector John Modlin.

"I request that DHS refrain from releasing aliens into communities without first coordinating with local elected officials and stop releasing aliens without NTAs," Biggs' letter warned.

"I am especially concerned about the potential of future releases of aliens into Arizona communities because DHS has yet to explain its legal authority for releasing aliens without issuing NTAs," the letter continued.

Biggs also wrote he is "dismayed" at President Biden's "inability to understand that the current crisis is the direct result of policy decisions made by his administration."

Among the directives in the letter were calls to restore Trump administration border policies that have been unwound by President Biden's early days in office, including:

  • Restart Migrant Protection Protocols (MPP), as known as the remain in Mexico policy.
  • Reinstate Asylum Cooperative Agreements (ACA) with Northern Triangle countries Honduras, Guatemala, and El Salvador.
  • Apply Center for Disease Control's Title 42 authority to all eligible aliens.

"If the Biden administration is unwilling to restart MPP, reinstate the ACAs, and apply Title 42 to all eligible aliens, DHS should, at a minimum, begin placing aliens in expedited removal so that only aliens who establish a credible fear of persecution are allowed to remain in the United States to receive a hearing in front of an immigration judge," Biggs' letter concluded.

Biggs' letter references the mayor of Gila Bend, Arizona, declaring a state of emergency after 16 aliens were released in their town of 2,000 residents, which "lacks the necessary resources to care for an influx of aliens," Biggs wrote.

Officials in Gila Bend were told more drop-offs would come, the Washington Examiner reported.

"To drop people in basically the middle of nowhere, it's 30 miles to the next type of town, and that's 30 miles of open desert," Gila Bend Mayor Chris Riggs told the Examiner. "So, especially come July and August, we're going to be finding bodies."
