    Members of the U.S. Senate and House of Representatives on Thursday introduced matching bills that would throw out per-country limits on employment-based green cards.

    Current law caps the annual percentage of green card recipients from any one country at 7 percent.


    That restriction hits Indian citizens hardest, because of the high numbers of Indians in the U.S. who are eligible for green cards. Indian citizens on the H-1B visa and other visas can wait years or even decades for a green card. Chinese citizens also face long delays.

    The “Fairness for High-Skilled Immigrants Act” bills from the House and Senate would also adjust per-country limits for family-based green cards.

    The House bill was introduced by Democrat Bay Area Congresswoman Zoe Lofgren and 113 other representatives, both Democrat and Republican. The Senate bill was introduced by Democrat California Sen. Kamala Harris and 14 other senators from both parties.
    Sen. Mike Lee of Utah said in a press release that the Senate bill’s supporters include Google, Walmart and the Information Technology Industry Council, which represents major Silicon Valley tech companies and also outsourcing firms that receive vast numbers of H-1B visas.

    Lofgren said the U.S. immigration system has been broken for decades. “At the heart of this broken system are the outdated employment- and family-based immigration systems, which suffer under decades-long backlogs,” Lofgren said in a statement. “In combination with the per-country limits, these backlogs keep nuclear families apart for decades, while preventing U.S. employers from accessing and retaining the employees they need to stay competitive.”


    John Miano, a lawyer for the Center for Immigration Studies, which pushes for reduced immigration to the U.S., said the proposed legislation, if passed, would bring about “the most massive change in the history in immigration policy” and create a “train wreck” in America’s immigration system.


    “The effect of the bill is to replace America’s system of diversity immigration with an India-first system,” Miano said in an email Friday. “Because India has monopolized the H-1B system, it would take over the employment-based green card system as well. The long-term effect is that about 75 percent to 80 percent of employment-based green cards would go to India.”

    Lawmakers Introduce Bipartisan Legislation to Eliminate Arbitrary Per-Country Limits to Employment-Based Visas

    WASHINGTON D.C. – U.S. Representatives Zoe Lofgren (D-Calif.), Ken Buck (R-Colo.), and 112 bipartisan members today introduced the Fairness for High-Skilled Immigrants Act (H.R. 1044) – a bill to reform the legal immigration system by eliminating per-country percentage limits that cause backlogs in the employment-based green card system. The bill would also ease backlogs for certain family-sponsored immigrants by modifying the per-country limits in the family-sponsored green card system. Lofgren and Buck are the Chair and Ranking Member of the House Judiciary Subcommittee on Immigration and Citizenship.


    The United States makes 140,000 green cards available every year to employment-based immigrants, including many who first come here on temporary H-1B or L visas. Current law, however, provides that no more than 7% of these green cards can go to nationals of any one country—even though some countries are more populous than others. Because of this 7% limit, for example, a Chinese or Indian post-graduate at the top of her class at MIT may have to wait half a decade or more for a green card, much longer than a student from a less-populated country.


    The bipartisan Fairness for High-Skilled Immigrants Act alters the per-country limits for employment-based immigrants so that all are treated equally regardless of their country of birth.


    “We all know that our immigration system is severely broken, and it has been broken for decades,” said Lofgren. “At the heart of this broken system are the outdated employment- and family-based immigration systems, which suffer under decades-long backlogs. In combination with the per country limits, these backlogs keep nuclear families apart for decades, while preventing U.S. employers from accessing and retaining the employees they need to stay competitive. The Fairness for High-Skilled Immigrants Act begins to address these problems and makes the immigration system somewhat more rational. It is a small, but good step forward.”


    “Our current immigration is broken and is in dire need of reform and repair.” said Buck. “Year after year, I have met with constituents who come here legally on work visas from India or China and face decades-long wait times for obtaining permanent residence. If we want to ensure America remains globally competitive, we need to ease the backlogs and leverage the talent and expertise of our high-skilled immigrants who help strengthen the U.S. economy and fill knowledge gaps in certain fields. These are people who have helped America grow and thrive as a nation of immigrants and we need to make sure our system continues to value those who are following our laws and doing the right thing.”

    WASHINGTON – Sens. Mike Lee (R-UT) and Kamala Harris (D-CA) introduced the Fairness for High-Skilled Immigrants Act Wednesday, a bill that would remove per-country caps for employment-based green cards.

    “Immigrants should not be penalized due to their country of origin,” Sen. Lee said. “Treating people fairly and equally is part of our founding creed and the Fairness for High-Skilled Immigrants Act reflects that belief. Immigration is often a contentious issue, but we should not delay progress in areas where there is bipartisan consensus just because we have differences in a other areas."

    “Ours is a nation of immigrants, and our strength has always come from our diversity and our unity,” Sen. Harris said. “We must do more to eliminate discriminatory backlogs and facilitate family unity so that high-skilled immigrants are not vulnerable to exploitation and can stay in the U.S. and continue to contribute to the economy. I’m proud to join with Senator Lee on this bipartisan legislation to ensure that our country remains vibrant and dynamic.”

    The Fairness for High-Skilled Immigrants Act also increases the per-country caps for family-sponsored green cards from 7 percent to 15 percent. Without adding any new green cards, S. 386 creates a “first-come, first-served” system that alleviates the backlogs and allows green cards to be awarded more efficiently.

    The bill has broad bipartisan support and is additionally cosponsored by Sens. Roy Blunt (R-MO), Susan Collins (R-ME), Jim Moran (R-KS), Tom Carper (D-DE), Ron Wyden (D-OR), Maria Cantwell D-WA), Cory Gardner (R-CO), Tom Cotton (R-AR), Tammy Baldwin (D-WI), Jeff Merkley (D-OR), Michael Bennet (D-CO), Kevin Cramer (R-ND), and Krysten Sinema (D-AZ).

    The bill has also been endorsed by Immigration Voice, Compete America Coalition, the Information Technology Industry Council, Google, Microsoft, the U.S. Chamber of Commerce, The Heritage Foundation, La Raza, and many others.

    Now that I have corrected the record, there is another immigration group who should correct what they are saying about #greencardequality This study clearly shows that #greencardequality means an average wage increase per green card recipient of $11,592!

    Bill Summary: Fairness for High-Skilled Immigrants Act, H.R. 392

    July 10, 2018



    The Fairness for High-Skilled Immigrants Act, H.R. 392, would amend the Immigration and Nationality Act to eliminate the per-country numerical limitation for employment-based immigrant visas, and to increase the per-country numerical limitation for family-sponsored immigrant visas. The bill is aimed at clearing backlogs for skilled workers from large countries, allowing them to come to the United States to work and obtain permanent residence, along with their spouses and children. It was introduced in January 2017, and the main co-sponsor is Rep. Kevin Yoder (R-Kansas). The bill has extensive bipartisan support, with 325 cosponsors in the House of Representatives.


    What Would the Fairness for High-Skilled Immigrants Act Do?



    • Remove per-country caps for employment-based visas, instead issuing them on a first-come, first-serve basis. Moving to a first-come, first-served process would give every immigrant an equal chance at obtaining permanent residency by issuing green cards by application date rather than country of origin.


    • Increase the per-country numerical limitation from 7 percent to 15 percent of the total number of employment-based visas and visas for those in the family-based preference categories.

      • Raising this limit would allow families some of whom have been waiting decades to reunite more quickly. For some countries, waits have exceeded two decades. For example, an application filed 22 years ago by a U.S. citizen to sponsor an unmarried adult child from Mexico is potentially just now being processed in 2018. Similarly, an application filed 24 years ago by a U.S. citizen sponsoring a sibling from the Philippines is only now being processed.


    Impact



    • Significantly reduce visa backlogsestimated to be about 4.1 million — enabling many immigrants to gain permanent residence faster and more easily.

      • Reducing the backlogs would allow spouses and children of H-1B visa holders to become permanent residents, reducing the number of children on H-4 dependent visas “aging out” and getting sent back to their home countries because they are unable to obtain their own H-1B visas in a timely manner.

    • Increase wait times for people from lower-demand countries.
      • Removing per country caps for employment-based visas would result in people from countries with low demand waiting longer, as those who are capped out under the current system would then be ahead of them in the line.
