    Document drop: Court upholds long sentences for Border Patrol agents

    I’m posting the ruling by the Fifth Circuit Court of the Appeals in the case of Border Patrol agents Ignacio Ramos and Jose Alonso Compean that came down today.

    Sen. John Cornyn’s office has pressed President Bush to commute the sentences:

    [quote]U.S. Sen. John Cornyn, R-Texas, a member of the Senate Judiciary Committee, expressed his strong disappointment with today’s ruling by the U.S. Court of Appeals for the Fifth Circuit, which upheld virtually all of the convictions against imprisoned Border Patrol Agents Ignacio Ramos and Jose Alonso Compean. Sen. Cornyn said that with their legal options virtually exhausted, save for intervention by the U.S. Supreme Court, President Bush must step forward and commute their sentences. Sens. Cornyn and Dianne Feinstein first requested a commutation of their sentences in a letter sent to President Bush on July 18, 2007. Both Senators also sent a follow-up letter to the President reiterating this request on April 21, 2008.

    “While I am still reviewing this opinion, it’s clear that Ignacio Ramos and Jose Compean will not receive the relief that they deserve. It’s been more than one year now since Senator Feinstein and I first called on the President to address this miscarriage of justice. With this court decision, it is now more important than ever for the President to act.

    “As I have long said, it is incomprehensible to me that an illegal alien drug smuggler was allowed to violate his immunity agreement, perjure himself and be granted a series of unlimited visas to roam free in our country while two border patrol agents were given excessive prison sentences. The sentences of 11 years for Agent Ramos and 12 years for Agent Compean were significantly higher than for many other serious crimes.

    “This administration has now had ample time to carefully gather and review the facts of this case. The facts, in my view, point to a clear case of prosecutorial overreach and a case where the sentence does not match the crime. This case cries out for a commutation that is fair and just, and I once again call on President Bush to act.â€

    This is disgusting!

    This is beyond disgusting! We can no longer depend on our government to protect us from the criminals because our government is largely worse than criminal factions! Our government is the preverbial "Rooster protecting the Hen house".

    Our loyal Amercan citizen border guards Compean and Ramos need to be freed today! They have been political hostages for far too long! Justice must prevail! The drug dealer who made a deal and Willie Sutton as well as all of the pro-Amnesty political thugs in on this deal and/or not acting to get the border guards out of jail need to be jailed in their place.... and let the good citizens of America run our own country..Pure evil prevails!

    Ramos And Compean Appeal Rejected - Lou Dobbs [Video]

    Below is the Lou Dobbs report on the rejection of Border Patrol Agents Ramos and Compean's appeal before the 5th circuit court.

    Included are quotes from Ted Poe and Duncan Hunter and Casey Wian explains that there are other legal avenues the agents can explore - even taking it as far as the US Supreme Court.

    Congressman Brian Bilbray (R-CA) and Dana Rohrabacher (R-CA) called on President Bush to immediately pardon the two agents.

    Rep Ted Poe (R-TX) issued this statement in a release:
    "It was never the intent of Congress to have the 924c charge applied to law enforcement officers - carrying a firearm is a requirement of the job" -

    Rep Duncan Hunter (R-CA) issued this statement in a release:
    "Agents Ramos and Compean were convicted based on the testimony of a known drug dealer that has since been convicted for running drugs across the border ... The fact that the drug dealer's criminal activity persisted even as he took the stand against these agents is reason enough to vacate these two convictions."

    last thing i heard on this was that about six weeks ago bush was asked about commuting the sentences and he basically said "he will not even consider a pardon until they ADMIT GUILT."

    We want Justice for Agent Ramos and Compean!

    This week I thought I would lose my mind when I heard of the horrifying decision by the Fifth Circuit Court of Appeals against Agents Ignacio Ramos and Jose Compean. So many of us who had followed this case for the last few years were hoping that once all the evidence had finally been heard, unlike with the first trial that justice would be done. Wrong!! Justice was not done!!!

    You may recall in the first trial that the illegal alien, drug thug Osbaldo Aldrete-Davila, who brought 743 pounds of marijuana over our border was given immunity by Prosecutor Sutton to testify against the two agents. I remember hearing Sutton and his cronies implying that the two agents were rogue, racist against Mexicans and had shot a poor, desperate illegal alien in the back of the butt while he was running away from them. On and on the distortion, misinformation….ok….lies went on. I had thought from the very beginning that the racist accusations regarding the two agents against Mexicans was fascinating since Ramos and Compean are Mexican Americans. It was also fascinating that ‘suddenly’ these two long standing, almost awarding winning agents, Dads and husbands would suddenly decide to break the rules and try and kill an unarmed, desperate illegal alien running away from them.

    The only problem with Sutton’s idiot revelations was that folks like Dr. Jerry Corsi, lawyers and those concerned with the real truth started uncovering the facts and it was crystal clear that the poor little illegal alien wasn’t just a one time, accidental tourist of sorts but a career drug thug who had come across the border with several drug shipments. It also became clear that there was no bullet hole in the back of poor little Davila’s butt, but rather it was through the side of his hip and had traveled into his groin area. This reflected the exact testimony of the two agents that they shot in self-defense and thought he had a gun pointed at them. He would have been turned back toward them to get shot through the side of the hip, NOT the back of the butt as Sutton testified.

    Who would you believe in court? The illegal alien drug dealer who lied to everyone and was arrested many times carrying drugs, but was magically given immunity to testify against Ramos and Compean, or the two long standing and well liked border patrol agents who said they fired in self defense and didn’t even know they had hit Davila?

    Given the insanity that they were even arrested in the first place, let alone convicted and thrown in prison, I was naturally so relieved and thrilled that finally an appeal was in process. Those of us looking on for the last few years of suffering and horror with these two families, hoped that justice would finally be done. Apparently not yet!

    I couldn’t help but notice as the families did how LONG the decision by the 5th Circuit Court took. It took way longer than usual. Why? Also, many of us also remember the many public statements by at least 2 of the 3 Judges who said several times on the record they were suspicions of the federal case against the agents and the inappropriate out of context use of 924c. How is it now, with all that was revealed this time, the immunity given to a guy who had continuously been arrested for bringing drugs across our border, the misuse of 924c to justify the obscene 11 and 12 year sentence and the endless other inconsistencies revealed in this case that this kind of decision could occur?

    What now? We can’t just say this was another bad decision but that is how it goes. Congressman Duncan Hunter said this week. “Those of us who have been following this case from the very beginning were confident that the Fifth Circuit, based on the evidence at hand, would rightfully correct this miscarriage of justice,â€
