    IRS Commissioner John Koskinen told Congress on Wednesday that even illegal immigrants who didn’t pay taxes will be able to claim back-refunds once they get Social Security numbers under President Obama’s temporary deportation amnesty.

    The revelation — which contradicts what he told Congress last week — comes as lawmakers also raised concerns Mr. Obama’s amnesty could open a window to illegal immigrants finding ways to vote, despite it being against the law.

    “While we may disagree about whether your deferred action programs were lawfully created and implemented, we are confident that we can all agree that these programs cannot be permitted to impair the integrity of our elections,” Republican members of Congress from Ohio wrote in a letter to Mr. Obama Wednesday, ahead of a hearing on the issue in the House on Thursday.

    Mr. Obama’s new deportation policies, which carve most illegal immigrants out of danger of being removed, and could proactively grant as many as 4 million illegal immigrants work permits and Social Security numbers, are increasingly under fire for ancillary consequences such as tax credits and competition for jobs.

    Mr. Koskinen, testifying to the House oversight committee, said the White House never asked him or anyone else at the IRS about the potential tax effects of his amnesty policy.

    “I haven’t talked to the White House about this at all,” he said.

    He also clarified his testimony to the Senate last week, where he acknowledged illegal immigrants who had paid taxes using substitute Social Security numbers but who gain real Social Security numbers when they are approved for the amnesty can apply for back-refunds of the Earned Income Tax Credit.

    On Wednesday, he said even illegal immigrants who didn’t pay taxes will be able to apply for back-credits once they get Social Security numbers.

    The EITC is a refundable tax credit, which means those who don’t have any tax liability can still get money back from the government.

    “Under the new program, if you get a Social Security number and you work, you’ll be eligible to apply for the Earned Income Tax Credit,” Mr. Koskinen said.
    He said that would apply even “if you did not file” taxes, as long as the illegal immigrant could demonstrate having worked off-the-books during those years.

    That expands the universe of people eligible for the tax credit by millions. He said only about 700,000 illegal immigrants currently work and pay taxes using an Individual Taxpayer Identification Number, but as many as 4 million illegal immigrants could get a stay of deportation and work permits under the temporary amnesty, which would mean they would be eligible to claim back-refunds if they worked those years.

    Rep. Mick Mulvaney, the South Carolina Republican who grilled Mr. Koskinen on the tax credits, said he was stunned the White House never checked with the IRS on the tax implications of its move.

    “That’s just outrageous,” he said. “If Congress had passed a law doing exactly what the president did, we would have had not only an estimate of the costs, but we would have also been required to propose ways to pay for the programs. This is just another example of the administration operating outside the rule of law.”

    Mr. Koskinen said he didn’t know how much money the tax refunds would cost, and said the White House never checked with him before announcing the amnesty. He said the maximum annual credit is between $500 and $600 for an individual.

    Meanwhile, the concerns over voting are beginning to bubble up.

    Rep. Jim Jordan, Ohio Republican, will hold a hearing on the issue Thursday.

    Ohio Secretary of State Jon Husted, who has told Mr. Obama that illegal immigrants could find ways to vote thanks to his policy, is slated to testify.

    Shut down the IRS. Pass the FairTax.

    We can't fix these problems when the IRS is handing out checks to illegal aliens and the Congress is inviting the Pope to its chambers to whine for amnesty on their behalf.

    The invitation to the Pope needs to be withdrawn and withdrawn now. Republicans must insist this be done.

    Passing the fair tax would a future event.

    Pay your income taxes everyone because the illegal aliens that come here to loot and spawn are counting on their amnesty bonus.

    Illinois Congressman Luis Gutierrez told The Daily Caller Friday that he didn’t know that illegal immigrants are eligible for tax refunds — even if they haven’t paid taxes.

    IRS Commissioner John Koskinen told members of Congress Wednesday that illegal immigrants who did not pay taxes will be able to claim back-refunds once they are issued social security numbers.

    “I know nothing of the sort,” Gutierrez snapped at a Daily Caller reporter Friday when asked about Koskinen’s testimony.

    “Of course it would be like you to raise that sort of question,” the Democrat continued. “Why don’t you ask the commissioner of the IRS?”

    The commissioner, of course, had already been asked about it.

    “Under the new program,” Koskinen told members of the House oversight committee Wednesday, “if you get a Social Security number and you work, you’ll be eligible to apply for the Earned Income Tax Credit.”

    “You will get an amount depending on your situation,” Koskinen added. “If you are an individual working and applying for the Earned Income Tax Credit, the maximum you can get is in the range of 500 to 600 dollars.”

    However, according to the IRS’ own website, a filer can receive a check up to $6,143 when they have “three or more qualifying children.”

    When asked whether the tax credit program was only eligible to illegal immigrants who has previously filed tax returns, Koskinen conceded that those who haven’t filed before could still be eligible for back-credits.

    “It turns out there was a lack of clarity about that,” Koskinen said. “If you get a social security number, you can then file for this year if you’re working and if you earned income in the 3 years you were working before that and filed you’ll be eligible.”

    “If you did not file, you’ll have to file a return and you’ll have to file to demonstrate with the same information anybody else would that you actually earned income and were therefore eligible. That’s on the assumption that you would get the earned income tax credit automatically whether you were working or not.”

    Despite Koskinen’s widely publicized remarks, Gutierrez seemed blindsided Friday when asked about the commissioner’s statements.

    “I knew you were going to bring something negative up,” Gutierrez whined during the press conference. “It doesn’t matter what I say. You will turn it against all of us here at this caucus. You know it.”

    Koskinen also said Wednesday that the White House never asked him or any other IRS official about the tax impact of Obama’s executive action on immigration.

    “I haven’t talked to the White House about this at all,” he said.

    Until Rep. Mick Mulvaney heard it directly from IRS Commissioner John Koskinen, the South Carolina Republican thought it was an Internet rumor that illegal immigrants could receive back tax refunds, Mulvaney said Friday on Newsmax TV's "America's Forum."

    At a recent Homeland Security Committee hearing on immigration, it was disclosed that illegal immigrants may be eligible to receive the Earned Income Tax Credit, allowing them to file an amended tax return for up to the last three tax years. Mulvaney asked Koskinen about it at a recent hearing.

    "I just asked (Koskinen) flat out and he said you don't have to have file a tax return, you just have to be able to prove that you had worked," Mulvaney said. "The president will issue them a Social Security number. Once they have that, they'll be able to file at least three years back taxes, file a tax return for three years in the past.

    "And if they can establish the earned income while they were here illegally, they'll still be able to collect the full earned income tax credit for those three years that they were working here illegally."

    The South Carolina Republican characterized it as an "outrageous amnesty bonus" that rewards law-breakers and penalizes rule-followers.

    "I feel bad for are the folks who have gone through the system legally and when they become citizens or they get the right to work, they're not going to be able to do this," he said.

    The secretary of state from Ohio also testified that in the Buckeye State, a Social Security number is the pathway to a voter ID.

    "Ohio is not alone in that. It is a real risk," Mulvaney said, adding that it's just another example of President Barack Obama acting unilaterally.

    "He doesn't care about anything other than amnesty," he said. "That means that people get to vote and they get the earned income tax credit. What does he care? He's only interested in the ends. Another unfair thing to do to folks, unfair to citizens and nationalized citizens who have worked hard to earn the right to vote.

    "If you play by the rules, you get the short end of the stick. That's patently unfair to people playing by the rules."

    Obama's executive immigration order also encourages employers to hire people who qualify for amnesty.

    "There's about a $3,000 per-employee incentive for employers to hire folks who qualify for this amnesty, and that is because the folks who qualify for the amnesty are specifically excluded from Obamacare," he said. "If you hire one of these folks that means you don't have to provide them health insurance or pay fees.

    "It gives employers a very real and tangible incentive to hire somebody who was here illegally, because it saves them $3,000 per employee."

    Republicans attack Obama over what they say are tax season 'amnesty bonuses'

    WASHINGTON (AP) – Millions of immigrants benefiting from President Barack Obama's executive actions could get a windfall from the IRS, a reversal of fortune after years of paying taxes to help fund government programs they were banned from receiving.

    Armed with new Social Security numbers, many of these immigrants who were living in the U.S. illegally will now be able to claim up to four years' worth of tax credits designed to benefit the working poor. For big families, that's a maximum of nearly $24,000, as long as they can document their earnings during those years.

    Some Republicans are labeling the payments "amnesty bonuses," one more reason they oppose Obama's program shielding millions of immigrants from deportation.

    "I represent hard working, law-biding Texans," said Rep. Sam Johnson, a senior Republican on the House Ways and Means Committee. "I think these amnesty rewards, and that's what they are, need to be stopped."

    Advocates argue that many of these immigrants pay taxes, so they should be able to claim the same tax credits as anybody else. Over the past decade, immigrants in the U.S. illegally have paid an estimated $100 billion in Social Security payroll taxes, even though few will ever be able to collect benefits, said Stephen Goss, Social Security's chief actuary.

    Obama has issued executive orders shielding about 4 million immigrants from deportation. Some were brought to the U.S. as children; others are parents of children who are either U.S. citizens or legal residents.

    Republicans in Congress oppose Obama's actions and are trying to use a funding bill for the Department of Homeland Security to overturn them. Democrats are resisting, resulting in a stalemate that is threatening to shut down the department.

    Funding for the department, which oversees immigration enforcement, runs out Feb. 27.

    The dispute over tax credits illustrates the complicated relationship that many immigrants have with the U.S. tax system. Social Security estimates that immigrants living in the country illegally work at about the same rate as the rest of the population, even though federal law bars them from employment.

    In general, they are less likely to pay federal taxes. Those who do have been boosting Social Security's finances for years.

    There are an estimated 11 million to 12 million immigrants in the U.S. illegally. At least half are paying income and payroll taxes, even though few have valid Social Security numbers, according to the nonpartisan Congressional Budget Office.

    By law, you must have a Social Security number to work in the U.S. But millions of people work without them.

    Some work in the underground economy and do not report their income to the government. For those who work and pay taxes, the IRS provides them with an Individual Taxpayer Identification Number (ITIN).

    Since 1996, the IRS has issued 21 million of these numbers. About one-quarter of them are still in use, the agency says.

    The IRS accepts these tax returns without reporting the taxpayers to immigration authorities, IRS Commissioner John Koskinen said. That encourages the workers to pay taxes.

    "We don't enforce the Social Security laws, we don't enforce the immigration laws," Koskinen said of his agency. "In fact, the reason illegal immigrants file taxes with us is they know we aren't sharing that data with anybody. We treat it as taxpayer-protected information."

    Even if these immigrants pay taxes, they are ineligible for most federal programs. They cannot legally get food stamps, unemployment benefits, Pell grants or federal student loans. They cannot get Medicaid, except for emergency medical services, and are ineligible for subsidies under Obama's health law.

    They can claim some federal tax breaks, if they file tax returns.

    But until now, they were not eligible for Social Security, Medicare or the Earned Income Tax Credit (EITC), one of the government's largest anti-poverty programs.

    Obama's executive actions will offer Social Security numbers to these immigrants, something that eventually could make them eligible for Social Security and Medicare. For Social Security, you generally have to work and pay payroll taxes for 10 years before you qualify for retirement benefits.

    More immediately, they can take advantage of the EITC. Last year, the credit provided low-income workers with about $70 billion.

    This credit is popular among conservatives because it rewards work — the more you work, the bigger your credit, as long as your income does not exceed certain limits. It is popular among liberals because it provides cash payments to low-wage workers, even if they do not make enough money to pay federal income tax.

    It is, however, a complicated program to administer that generates a significant amount of improper payments, according to the IRS's own estimates.

    Once the immigrants in Obama's program get Social Security numbers, they can file tax returns claiming the EITC, as long as they meet the income requirements and can document their earnings.

    There's more.

    They also can file amended tax returns for up to three years after they were due, which means these immigrants can claim tax credits going back as far as 2011. (Tax returns for 2011 were due in April 2012).

    The maximum credit for families with three or more children is about $6,000, so some families could get as much as $24,000 in credits.

    Koskinen said these tax returns would be processed just like any other.

    "You have to do the same thing any taxpayer would do, which is you're going to file a return, say this is what I earned, these are my expenses, deductions, whatever it might be," Koskinen said. "You have to have the supporting documentation."

    Some in Congress are outraged.

    "The administration may have blown open the doors for fraud with amnesty bonuses of more than $24,000 to those who receive deferred action," said Sen. Ben Sasse, R-Neb. "This program severely undermines the White House's lip-service to enforcing the law and would increase the burden on law-abiding taxpayers."

    Advocates for immigrants say that if these workers are paying taxes, they should get the same benefits as other taxpayers.

    "Let's not forget that these workers receive the lowest wages for what they contribute to their communities and local economies," said Ellen Sittenfeld Battistelli, policy analyst at the National Immigration Law Center. "What do we as a nation gain by further impoverishing them?"

    Immigrants already receive the same benefits as other taxpayers. We aren't talking about immigrants, we're talking about illegal aliens. Big difference.

    Hopefully they'll make like trees, and leave. The less comfortable it is here for them, they'll hopefully tire of it and go home.

    When a robber comes to your house do you offer him a roast beef sandwich and a beer on his way out the door with all your belongings? No, because he stole the roast and all the beer, and you'd call 911 but he stole your phone. And would you then give him the title to your house? Well, no, you wouldn't. But that is exactly what DHS is doing for illegal aliens with amnesty, a path to citizenship, welfare, jobs, educations, healthcare, tax credits and retroactive tax refunds for illegal work at illegal jobs collecting illegal pay and filing illegal tax returns. Who said "crime doesn't pay?" Well, it pays very well if you're an illegal alien in the United States.

    How badly informed are republican congress people? Rep, Mulvaney says he "thought" it was just an internet an internet rumor that illegals could get tax refunds/ I would like to ask Mulaney when he arrived in the USA? It must have been day before yesterday. What do we pay his staff for, obviously it is not for research!!! Are congress people getting any education at all? Two more like this one, we have reason to question it!
