Trump may empower local police with 287(g) to round up illegal aliens

Trump may empower local police to round up immigrants

MIAMI — Deputizing local police officers from around the country to enforce the nation's immigration laws is one plan being proposed to President-elect Donald Trump to fulfill his pledge to crack down on undocumented immigrants.

The idea was on a sheet of proposals for the
Department of Homeland Security that was photographed when a member of Trump's immigration transition team met with him Sunday. The list of proposals carried by Kansas Secretary of State Kris Kobach also addressed Trump's campaign pledge to cut off the program that accepts Syrian refugees and to enhance screening of people from countries with ties to terrorism.

Kobach, who has helped several states draft laws that crack down on illegal immigration, did not respond to requests for comments about the proposals.

The so-called 287(g) program on the list allows the
U.S. Immigration and Customs Enforcement agency to train local police officers and sheriffs deputies to locate and catch undocumented immigrants living in their communities.

The program was created by Congress in 1996 and used by President George W. Bush. By 2010, local officers in 24 states were trained and empowered by ICE to respond to crime scenes, make traffic stops and check local jails to determine the immigration status of suspects.

The program was largely phased out by
President Obama. Local officers now only work in local jails, not on the street.

Kobach's proposal suggests the program be ratcheted back up to "at least 70 cities and counties" when Trump enters the White House in January. Trump said in a post-election interview that a top priority will be deporting an estimated 2 million to 3 million undocumented immigrants with criminal records.

Expanding local enforcement would be a quick, cheap "force multiplier" for a Trump administration intent on increasing deportations, said Jessica Vaughan, director of policy studies at the Center for Immigration Studies, a group that favors steps to curb illegal immigration. She said federal agents are already stretched thin, and adding local officers to do immigration work would help expand their reach.

"I would expect ICE to be inundated with applications" from local agencies interested in taking part, Vaughan said. "It's a great thing for public safety and our immigration enforcement.

You're going to have fewer criminal aliens falling through the cracks and more sent home rather than being allowed to stay in those communities."

Opponents counter that expanding local enforcement would alienate communities with significant Hispanic populations. Lake County (Ill.) Sheriff Mark Curran, a former prosecutor, said he looked into the program when it was created, but changed his mind once he thought through the downside of such a step.

Curran said solving crimes requires witnesses to step forward and talk to police, something the Hispanic community would not do if the officers were also acting as immigration agents.

"As soon as your police car pulls up, all the doors are going to shut," Curran said. "All they know is you dragged some relative of theirs out of the house a week ago who hadn't done anything but try to provide for his family. They're not going to want to cooperate with you."

Curran, a Republican who voted for Trump, supports many aspects of the president-elect's plan to crack down on illegal immigration and said his office regularly cooperates with federal immigration investigations. But he was disappointed to hear that Trump is considering the 287(g) program.

"My position is the same as most sheriffs in the country," he said. "We're not going to flip our nose at the Constitution.

We're not going to become sanctuary counties. But we don't want to be federal agents running around going into homes and grabbing people based on their immigration status."

Denver Police will not participate in Trump's immigration enforcement

DENVER – Police officers in Denver will not participate in President-elect Donald Trump’s immigration enforcement efforts, a department spokesman told Denver7 Investigates Monday evening.

“Immigration enforcement is handled at the federal level, not by local law enforcement,” a statement issued by Denver Police spokesman Doug Schepman said. “The Denver Police Department has not participated in those enforcement efforts in the past and will not be involved in the future.”

READ | Aurora Police join DPD, say they will not be changing policies to aid Trump's stances on immigration.

President-elect Trump pledged to deport as many as three million criminal illegal aliens. Trump first made the comments during a CBS News interview taped Friday and aired Sunday night.

Trump’s campaign website states that on day one, he will “move criminal aliens out in joint operations with local, state and federal law enforcement.”

The LA Times reported Monday that Los Angeles Police Chief Charlie Beck said he has no plans to change the department’s stance on immigration enforcement.

“We are not going to work in conjunction with Homeland Security on deportation efforts. That is not our job, nor will I make it our job,” the LA Times quoted Los Angeles Police Chief Charlie Beck as saying Monday.

It is unclear who Trump plans to deport or how he will define criminal aliens.

Current federal policy says federal agents should focus efforts on a select group of people in the United States illegally.

In general, our enforcement and removal policies should continue to prioritize threats to national security, public safety, and border security,” a Justice Department memo issued in 2014 outlined.

The memo says the highest priority enforcement action should be directed to:

    • Aliens engaged in or suspected of terrorism or espionage, or who otherwise pose a danger to national security;
    • Aliens apprehended at the border or ports of entry while attempting to unlawfully enter the United States; aliens convicted of an offense for which an element was active participation in a criminal street gang, or aliens not younger than 16 years of age who intentionally participated in an organized criminal gang to further the illegal activity of the gang; aliens convicted of an offense classified as a felony in the convicting jurisdiction, other than a state or local offense for which an essential element was the alien's immigration status; and
    • Aliens convicted of an "aggravated felony.”

Aggravated felonies include murder, rape, sexual abuse of a minor, illicit trafficking of a controlled substance, illicit trafficking in firearms or destructive devices

I always liked this 287 (g) program. I would also just announce that it's the interpretation of the US Constitution that all states and local governments have authority under the Constitution to enforce US immigration law, short of a deportation order, which can be promptly provided by the US government. Then more states would pass their own laws like SB 1070 to do more at the state and local level. This order by the President should then be followed up by an act of Congress and there's been a bill in Congress to do this for many years, past time to pass it.

LA County Sheriff Helps Deport Record Numbers of Immigrants

According to ICE figures L.A. county has turned over 30,093 people to the agency for deportation. That tops the 22,000 people that Maricopa County’s Joe Arpaio—the nation’s most infamous anti-immigrant sheriff—has relinquished to ICE...

Deport the criminal illegals. Empty out the jails and prison's...load them up and get them out.

Every one caught...put in jail and repeat the process. Especially the ones caught committing lesser crimes.

Start by doing this in the States that will cooperate. Those that do not...cut off ALL Federal Funding.

. . . My plan also includes cooperating closely with local jurisdictions to remove criminal aliens.

We will restore the highly successful Secure Communities program. We will expand and revitalize the popular 287(g) partnerships, which will help to identify hundreds of thousands of deportable aliens in local jails. Both of these programs have been recklessly gutted by this Administration. . .
