    A United States border patrol agent opened fire while responding to reports of alleged drug smugglers on Arizona’s southern border late Wednesday night, the U.S. Border Patrol told Fox News.

    Agents witnessed the smugglers drop a narcotics load on the Arizona side of the border and flee to Mexico, the agency said. One agent discharged his firearm after he was pelted with stones at the scene after his verbal commands were disregarded, the agency said. One person is believed to have been hit by a bullet.

    The scene at Nogales, Ariz., was secured and the Mexican government has been informed about the incident. The FBI is leading the investigation.

    In January, a similar shooting occurred in the city when an agent fired upon rock throwers while breaking up a drug smuggling attempt.

    A U.S. Border Patrol agent fatally shot a young Mexican man who had fled across the border into Mexico, the agency said.

    The Border Patrol issued a statement Thursday saying that agents responded around 11:30 p.m. Wednesday to reports of two suspected drug smugglers on the U.S. side of the border in Nogales, Ariz.

    The agents reported seeing the men “drop a narcotics load” on the U.S. side of the border before jumping a wall or a fence to flee into Mexico.

    Once in Mexico, according to the Border Patrol account, the men started throwing rocks at the agents. When they refused to stop, “one agent discharged his service firearm.”“One of the subjects appeared to have been hit,” the Border Patrol statement says. Border Patrol immediately notified the Mexican government; on the U.S. side, the investigation into the shooting is being led by the FBI.

    The man was hit 10 times from behind, a doctor in the area told Telemundo. Municipal and state investigative police also said the man was shot several times. They said they found the man, in his mid-20s or early 30s, lying on his stomach.

    The man was about 32 feet -- about the length of a yellow school bus -- from the international line when he was shot, Telemundo reported.

    About 5,200 Border Patrol agents patrol the Arizona border with Mexico, spokesman Victor Brabble said. That’s 859 more agents than in 2010, representing the Obama administration’s commitment to adding more agents to the border.

    A U.S. Border Patrol agent shot and killed a teen at the U.S.-Mexico border, Mexican state media reported Thursday.

    (CNN) -- One person was killed in a shooting involving Border Patrol agents at the U.S.-Mexico border, Mexican state media reported Thursday.

    A U.S. Border Patrol agent shot and killed an adolescent who had been throwing rocks alongside several others at the border, the state-run Notimex news agency said, citing anonymous sources.

    In a statement released earlier Thursday, the U.S. Border Patrol confirmed the Wednesday night shooting, but did not say whether anyone had been killed.

    Citing preliminary reports, the Border Patrol said agents saw smugglers drop drugs on the U.S. side of the border in Nogales, Arizona, then return to Mexico.

    "Subjects at the scene then began assaulting the agents with rocks," the Border Patrol said in a written statement.

    "After verbal commands from agents to cease were ignored, one agent then discharged his service firearm," the Border Patrol said. "One of the subjects appeared to have been hit."

    The FBI is investigating the shooting, the Border Patrol said.

    In response to similar shootings in September and July, Mexico's foreign ministry has criticized what it said was "disproportionate use of lethal force" at the border.

    In 2010, the FBI investigated after a Border Patrol agent shot and killed a Mexican teen along the border between El Paso, Texas, and Ciudad Juarez, Mexico. Federal officials closed the case in April, saying there was not enough evidence to pursue charges against the officer and that he acted within the agency's policies for use of force.

    The officer received widespread condemnation from critics who questioned his use of deadly force against 15-year-old Sergio Adrian Hernandez Guereca, who authorities said had been throwing rocks at the agent when he was shot and killed.

    Hernandez had a history of involvement with human smuggling and was on a list of repeat juvenile offenders, U.S. Customs and Border Protection spokesman Mark Qualia said after the shooting.

    An appeal is pending in a lawsuit filed by the teen's parents in U.S. federal court, accusing the officer of using excessive force. The Mexican government filed a friend of the court brief in the case, noting that its request to extradite the Border Patrol agent for prosecution had been denied.

    "As a matter of international responsibility, the fact that the victim was on Mexican soil when he was killed does not absolve the United States of responsibility for the acts of its agent," the brief said.

    A U.S. Border Patrol agent shot across the border and killed a 16-year-old in Nogales, Sonora, on Wednesday night.
    The agent fired after people on the Sonora side of the line started throwing rocks, the agency said.

    The body of the victim, José Antonio Elena Rodríguez, lay on the sidewalk across International Street in downtown Nogales, Sonora, a few blocks west of the DeConcini Port of Entry. He had received eight bullet wounds, El Imparcial newspaper reported, and the wall of an adjacent medical office was pocked with bullet impacts.

    The incident began about 11:30 p.m., when agents saw people drop a drug load over the border fence, the Border Patrol said in a news release. They fled back into Mexico, then others on the Mexico side began pelting the agents with rocks.

    Agents ordered them to stop, but they continued throwing rocks, the release said. That's when one agent stated firing.
    The FBI is investigating the incident as an assault on a federal officer.

    The mayor of Nogales, Sonora, Ramón Guzmán Muñoz, acknowledged that the victim and others in his city may have been committing a crime, but objected to the Border Patrol's response.

    "Aside from the fact that this may have resulted from illicit act, the logical response isn't to take a human being's life," Guzmán Muñoz told El Imparcial in Spanish.

    "I hope they don't say this was legitimate self-defense."

    The spokesman for the Mexican Embassy expressed concerns about the shooting.

    "Preliminary information at this time brings forth, once again, serious doubts about the use of lethal force by U.S. Border Patrol agents, something that both the Mexican government and Mexican society strongly deplores and condemns," Ricardo Alday, a spokesman for the Mexican Embassy in Washington, D.C., said in the statement.

    "It is imperative that the relevant U.S. authorities proceed with a timely and transparent investigation," Alday added. "Mexican authorities will proceed accordingly within their jurisdiction."

    Agents are allowed to fire their weapons when they are threatened with deadly force, said Sean Chapman, the attorney for the agent who fired into Mexico.

    It can include rock throwing, he said. The agent has not been publicly identified.

    Rodríguez was born in Nogales, Sonora, and lived in Colonia Fundo Legal, a district close to the border fence, according to the state attorney's office in Sonora
    .

    The case is being handled by detectives of Sonora's state police. Mexican authorities said they were working closely with the U.S. Justice Department.

    Wednesday night's killing by a Border Patrol guard is the latest of four deadly shootings since January 2010 in Southern Arizona.
    Ramses Barrón Torres, 17, was killed on Jan. 5, 2011, as he was trying to cross the border fence in Nogales, according to Mexican authorities.

    The FBI said border agents were trying to catch drug smugglers when a group of people started throwing rocks at them and agents responded with gunfire.

    A year before Torres' death, Border Patrol agent Miguel Torres-Vasquez shot and killed Jorge Alfredo Solís Palma, 28, near Douglas. Palma, who had a prior felony drug offense, threw rocks at border agents and fled after struggling with agents who had been tracking him and other undocumented crossers.

    The Cochise County Attorney's Office concluded after a two-month investigation that Torres-Vasquez was legally justified in the shooting.

    In March 2011, Border Patrol agent Lucas Tidwell shot Carlos La Madrid three times, twice in the back and once in the back of his thigh, as he climbed a ladder on the U.S.-Mexico border fence in Douglas, according to suit filed by his mother. La Madrid, a U.S. citizen, was allegedly transporting marijuana and was fleeing Douglas police officers in a Chevrolet Avalanche when he made his way to a border fence.

    Border Patrol agents arrived at the scene when La Madrid jumped out of the Avalanche and tried to climb a ladder next to the fence into Mexico. He was shot.

    An autopsy report indicates a Mexican teen who apparently was shot to death by a U.S. Border Patrol agent in October was struck by at least eight bullets, all but one hitting him in the back.

    The report, provided to The Associated Press on Thursday by an attorney for the 16-year-old boy's family, was conducted by medical examiners in Mexico and describes several other wounds, but it's unclear if they account for additional bullets, graze wounds or shrapnel.

    The attorney, Luis Parra, said he believes the report bolsters his contention that the Border Patrol used excessive force in gunning down Jose Antonio Elena Rodriguez. The family is considering a lawsuit.

    "I'm not saying it's a clear case of excessive force, but it is a very strong case for excessive use of force," Parra said. "The Border Patrol agent who was firing could have easily taken cover."

    Parra said the report was provided to him by the Sonoran State Attorney General's Office just across the border from Nogales, Ariz.

    Border Patrol officials declined to comment, citing an ongoing probe by the FBI, which investigates all Border Patrol shootings. FBI spokeswoman Jennifer Giannola also declined to discuss the investigation, noting there is no specific timetable for its completion.

    The autopsy report shows at least eight bullets struck the teenager, one through his head and the rest through various parts of the back of his body. Six bullets were found inside the boy.

    The Border Patrol has said several agents responded the night of Oct. 10 to reports of suspected drug smugglers along the border fence in Nogales, Ariz. The agents watched two people abandon a load of narcotics, then run back to Mexico, according to the agency. The agents were then pelted by rocks thrown from across the border. The Border Patrol said the people ignored orders to stop, and an agent opened fire.

    Rodriguez's body was found on a sidewalk in Mexico not far from the fence.

    Border Patrol agents generally are allowed to use lethal force against rock throwers, as the agency considers stones deadly weapons. It's common all along the border for agents to be hit with rocks, often to distract them from making arrests. Several investigations into similar shootings are under way in Arizona and Texas.

    Parra said Rodriguez's family is still awaiting any information from the FBI, and is growing frustrated.

    "They're very upset," he said. "They have not stopped grieving for the past four months."

    Within days of Rodriguez's death, Mexico's Foreign Relations Department issued a statement saying it condemned the shooting and called such deaths a "serious bilateral problem."

    Nogales Mayor Ramon Guzman Munoz said the teen died in a "hail of bullets" and called it "deplorable," urging a thorough investigation by both U.S. and Mexican authorities.

    U.S. government investigators are reviewing Border Patrol policies on use of lethal force amid a spate of deadly shootings in recent years. The probe by the Department of Homeland Security's Office of Inspector General involves a review of accusations of brutality and excessive force.

    Border Patrolman Justified in Fatal Shooting

    TUCSON (CN) — A federal judge found a Border Patrol agent justified in killing a suspected drug smuggler who was climbing a ladder over the border fence as the agent was being pelted with softball-sized rocks.
    The ruling put an end to a civil rights lawsuit from the mother of Carlos LaMadrid, a 19-year-old U.S. citizen who was shot to death by Border Patrol Agent Lucas Tidwell on March 21, 2011, in Douglas, a border town southeast of Tucson.
    U.S. District Judge James Soto found that Tidwell shot at someone who was throwing rocks at him from the top of a 10-foot border fence, and that LaMadrid was "injured in the cross fire."
    The incident began when Douglas police got an anonymous tip from someone who said he saw men loading a gold Chevrolet Avalanche with bundles of marijuana.
    Douglas police Officer Marcus Gonzalez spotted the Chevy and tried to pull it over, but LaMadrid ignored the sirens and sped through the streets of Douglas toward the border at 65 to 70 mph, according to Soto's April 25 findings, which followed a seven-day bench trial last July.
    At the border fence, which separates Douglas from Agua Prieta, LaMadrid stopped near a pre-placed ladder just as Tidwell came on the scene. The Avalanche sped directly toward Tidwell's vehicle and hit its front corner, Soto found.
    LaMadrid and an accomplice jumped out of the Avalanche and ran to the ladder. Officer Gonzalez testified at trial that he saw two people on top of the fence — one helping LaMadrid over and the other throwing rocks the size of softballs and bricks at Tidwell.
    "As one of the rocks slammed against his windshield, Tidwell simultaneously fired one shot through the windshield as he was in the process of exiting and drawing his gun," Soto wrote.
    Out of the vehicle now and with rocks raining down, Tidwell fired several shots at the rock thrower while LaMadrid climbed the ladder.
    "As LaMadrid climbed into the direct line of fire from Tidwell to the rock thrower, he was struck by some of the bullets aimed at and intended to stop the deadly actions of the rock thrower," Soto wrote. "Upon being struck, LaMadrid fell from the ladder. His associates on top of the fence then jumped off the fence onto the Mexico side, hopped into a vehicle, and quickly sped away from the scene. LaMadrid later died from the wounds he received."
    LaMadrid's mother, Guadalupe Guerrero, argued at trial, among other things, that the federal government, Douglas police and the Cochise County Sheriff's Department conspired to cover up evidence that Tidwell had "either intentionally shot LaMadrid, or otherwise engaged in other illicit actions."
    But Soto found the theory "unsupported, unconvincing, and not consistent with the evidence."
    He also was skeptical of the testimony of two Mexican construction workers who were nearby and claimed they had not seen anyone throwing rocks from the top of the fence. Soto noted that both witnesses had "grudgingly admitted that they had illegally entered the United States on numerous occasions, had been apprehended by Border Patrol, and were sent back to Mexico after their apprehension."
    "The credible evidence presented at trial reflected that Tidwell was justified in his use of deadly force under the very dangerous and rapidly evolving circumstances of this case," Soto wrote.
    Guerrero was represented at trial by William Risner, who did not return an email request for comment Friday.
