ICE auditing 1,000 more companies' hiring records

WASHINGTON—More U.S. businesses are about to feel the sting of the Obama administration's immigration enforcement strategy.

Immigration and Customs Enforcement says it has sent notices of inspection to 1,000 employers in the U.S., warning that agents will be scrutinizing their hiring records to check for employees working illegally in the U.S.

The administration has been using the audit tactic since 2009 and audited such companies as Krispy Kreme and Abercrombie and Fitch. An immigration official has said such audits doubled in 2010 over 2008.

ICE says the latest inspections will include employers of all sizes and in every state and that no single industry is being targeted nor is any one industry immune.

Just another dog and pony exhibition to falsely show the naive American sheeple this administration is enforcing the 1986 IRCA so they then can ram amnesty down our throats. Any illegal aliens found during these "audits" are not deported (but what good would that do anyway with wide open borders - they just return) but are given work permits or they will find another employer willing to cheat the system. This administration doesn't care one iota about unemployed and suffering Americans. This is government sanctioned 21st century slave labor to bolster profit margins for GOP's business masters including the Chamber of Commerce and more illegal alien votes for Democrats.......

I think ICE is doing a great job. Little by little employers will get the message that it is no longer acceptable to hire illegals. I just wish they would audit 10,000 companies instead of 1,000. I guess they can only do so much so fast. But I think we are moving in the right direction. I dont think they will be pushing too hard for amnesty right now, because people have had enough and the economy is still slow. But it is still on the table, so we have to be ever vigilant.

Why in the heck are they warning them, they should make it a surprise audit.

Most employers will stop hiring illegal aliens the first time you put the in jail.

The Obama administration is targeting a major segment of U.S. businesses nationwide, requiring as many as 1,000 employers to make available their employment records for review by U.S. Immigration and Customs Enforcement agents as part of a newly reinstituted law enforcement initiative against illegal immigration.

"The inspections will touch on employers of all sizes and in every state in the nation — no one industry is being targeted nor is any one industry immune from scrutiny," ICE said. ICE declined to name the businesses to be inspected.

The new audits are an expansion of a work-site enforcement program that began in April 2009 when Homeland Security Secretary Janet Napolitano issued guidelines calling on ICE to focus its resources on the criminal prosecution of employers who knowingly hire illegal workers in order to target the root cause of illegal immigration.

At the time, Ms. Napolitano said ICE would continue to arrest and process for removal any illegal workers who were found in the course of the work-site enforcement actions in a manner consistent with immigration law and Homeland Security priorities.

She also said ICE would use all available civil and administrative tools, including civil fines and debarment, to penalize and deter illegal employment.

Nearly 3,600 U.S. companies have been audited since the program began, with more than $50 million in fines having been collected.

ICE has the responsibility of enforcing the law and engaging in effective work-site enforcement to reduce the demand for illegal employment and protect employment opportunities for the nation's lawful work force.

The agency maintains a work-site-enforcement strategy that addresses employers who knowingly hire illegal workers as well as the workers themselves.

The new audit targets are expected to be made public in the next several days.

The ICE enforcement effort, first reported by the Wall Street Journal, will be aimed at employers who knowingly hire illegal immigrants.

This is a change from George W. Bush administration policies, under which ICE agents focused on the undocumented workers.

They were detained and then deported if they had no criminal records or warrants and were incarcerated if they did.

In 2008, 6,000 arrests were made during work-site enforcement actions; just 135 of them were of employers.

Under the Immigration Reform and Control Act (IRCA), employers are required to verify the identity and employment eligibility of each new hire.

This is done through a document known as Form 1-9, or the Employment Eligibility Verification form, which all U.S. employers must complete and retain for each person they hire for employment in the United States.

The form includes citizens and noncitizens and requires the employer to examine the employment eligibility and identity documents an employee presents to determine whether employees "reasonably appear to be genuine and relate to the individual and record the document information on the Form I-9."

Civil fines for paperwork violations range from $100 to $1,100 for each violation, and fines for substantive violations — employing an unauthorized worker — range from $375 to $16,000.

I surly hope Virginia Marble Inc. is one of the companies on the investigation list because, the company has abused the State of Virginia longer enough, working illegal immigrants and paying them for many years under the table. In the early 90's I worked there for a few months, so I know the truth.

If enough people complain about a specific company and can give some proof of claim then they will take action or put that company on the radar. We need to post specific companies and give some type of proof and then menbers can add their 2 cents and drop the (use to be a dime, now is I think 50 cents) and make a formal complaint. We would need address and phone# of that company as well as any information. I for one would not hesitate to email, phone or write a lettter to the local ICE division in the area of that company.

That sounds like a great idea to me. I have reported the company to ICE and I am quite sure they have the information I emailed.

If we can have it approved, we should create a web page here on Alipac and post business and companies that hire and work illegal immigrants. What are your thoughts Bill?

These audits should clean out the illegals and when they replace workers, the new I-9's should prevent them from hiring more illegals.

At a meeting of the District of Columbia Bar Association on February 15, 2011, Brett Dreyer, Chief of the Worksite Enforcement Unit of Homeland Security Investigations, U.S. Immigration and Customs Enforcement (ICE), verified that ICE continues to focus its investigations both on businesses that were brought to their attention by tips and leads and those that work in areas of national security and critical infrastructure. Mr. Dreyer would not comment on the possibility of a new round of audits, however, we now have confirmation that Notices of Inspection (NOIs) were served around the country beginning February 16, 2011. Indeed, ICE’s stepped up worksite enforcement strategy has turned away from workplace raids to focus instead on employer compliance and much higher administrative fines.

ICE acknowledged in a statement that “the inspections will touch on employers of all sizes and in every state in the nation — no one industry is being targeted nor is any one industry immune from scrutiny.â€

For practical purposes of taking action against employers, we get more "bang for the buck", with audits.

Remember, most employers don't get jail time, because illegals use false documents. These audits prove E-Verify is necessary, to weed out illgal residents.

Half of companies audited by I.C.E. get fined $110,000 or more.

If you're like most employers, 30-50% of your I-9 forms may have issues that put you at risk.

I think raids have their place. For instance, companies who hire large numbers of illegal aliens are worth raiding. It's a two for one deal. You get the employer and you can deport the workers, instead of putting them back out to find another job. In some cases, they would leave one job to work for another local company who has similar hiring practices. Like locations that have a high number of meat packing plants in the area could adsorb the dismissed illegal aliens.

Illegal aliens are actually deported following a raid. Wish I could say the same thing for the audits. Look, I have no problem with the audits, however, I do have a problem with giving illegal aliens a free pass. Enforcement needs to be balanced, and I believe raids combined with audits help to create that balance.

Nobody gets deported after an audit. Oh, and as for bad publicity, I guess that depends on who you are. Personally, I think raids are a great way to show our immigration laws are being enforced. I certainly don't vew them as a bad thing. Of course I'm not a member of La Raza, MALDEF, SPLC, or the ACLU.
