3 people in traffic stop where deputy killed in country illegally, Border Patrol says

First Coast News , WTLV 5:02 PM. EST November 22, 2016

A Border Patrol agent involved in the traffic stop that resulted in the death Tuesday of a Nassau County deputy after he was struck with a car identified at least three people in the country illegally, a statement from U.S. Border Patrol says.

A Border Patrol agent and two Nassau County deputies approached the stationary vehicle at a gas station on State Road 200 with five people inside early Tuesday morning.

The agent got the three suspected foreign nationals without clearance to be in the U.S. out of the car with the intention of arresting them when someone in the pickup got out and bolted across busy S.R. 200, Border Patrol says.

While the Border Patrol agent put the three people into his vehicle, Deputy Eric Oliver and another Nassau County deputy gave chase across S.R. 200. Oliver was hit by a vehicle on the roadway.

NCSO said the woman who was driving the vehicle that struck Oliver remained on the scene and cooperated with authorities.

After noticing Oliver go down, the Border Patrol agent left the pickup and the fifth and final person and ran to help the deputy, during which time the person in the pickup started it and took off - that person was later taken into custody.

The person that ran across S.R. 200 is still at large and multiple law enforcement agencies are working to bring him in. Florida Highway Patrol is the lead agency.

    Oliver died at the scene.

Please note: FHP originally said there were around six people in the pickup. Border Patrol reports a different number. At this time we only know the person that ran across S.R. 200 is a male - no other identifying information about any other person inside the pickup has been released.

Florida Deputy Killed While Chasing Suspected Illegal Alien

A Florida sheriff’s deputy was killed while assisting Border Patrol agents chasing a suspected illegal alien. The deputy was struck by an SUV while running across the road.

“It deeply saddens the Nassau County Sheriff’s Office to report the passing of Deputy Eric Oliver in the line of duty. Deputy Oliver was assisting the United States Border Patrol when a suspect fled on foot,” the department posted on its Facebook page. “Deputy Oliver gave chase across State Road 200, when he was struck by a passing motorist.”

Deputy Oliver was working with a fellow Nassau County deputy and a U.S. Border Patrol agent as they approached a suspicious pickup truck with six people loaded inside, News4Jax reported. The agent identified at least three of the vehicle’s occupants as illegal immigrants. The report did not disclose the nationality of the three illegal aliens.

As those people were being arrested, another person later identified as Francisco Obbidio Portillo-Fuentes fled the scene. Deputy Oliver and another instinctively took off after the fleeing suspect. As Deputy Oliver was crossing the roadway, the driver of an SUV struck the deputy from his left side. He received fatal injuries from the accident.

“It looked like there was nothing she could do,” Nassau County Sheriff Bill Leeper told the local news outlet.

“When the individual bolted, their instinct was to go after them, and they did that. It’s unfortunate what happened,” Leeper explained.

During the melee, the other two individuals fled in the pickup truck. They were later captured and arrested. Their identities and nationalities have not yet been disclosed.

Portillo-Fuentes was also eventually captured about 12 hours later. Breitbart Texas reached out to the Nassau County Sheriff’s Office to learn if Portillo-Fuentes was also an illegal immigrant or if he was involved in any other crime, such as human smuggling. A spokesperson for the sheriff’s office told Breitbart Texas that Portillo-Fuentes was in federal custody and referred us to the U.S. Border Patrol division chief for comment. No comment was immediately available from Border Patrol officials.

Deputy Oliver was recently divorced and leaves behind a 6-year-old daughter. Sheriff Leeper spoke with the little girl about her father’s death.

“I told her that her daddy died doing what he loved to do, protecting our community. And he is a hero and he’s looking down on her, protecting her and watching over her,” Leeper told the local reporter. “And hopefully she’ll take some gratification in that.”

He continued, “Law enforcement is a tough job. We just want to protect our community … and tragic things happen and it’s unfortunate, but that’s the risk we take when we take the oath of office to serve and protect the community, and Eric died doing his job.”

Deputy Oliver was the 128th law enforcement officer to die in the line of duty during 2016. He was the seventh officer to be killed after being struck by a vehicle, according to the Officer Down Memorial Page.

    UPDATE

Miami Sector Division Chief Todd Bryant informed Breitbart Texas that Francisco Obbidio Portillo-Fuentes in an illegal alien from El Salvador. He confirmed that all six people in the pickup truck were illegal immigrants. He said they were not part of any human smuggling operation, but some had criminal histories and had been previously deported.

Get these people out of here and keep them out. Records or not, someone without a record is just one who hasn't been caught or a crime waiting to happen. STOP IT ALL NOW.

Deportee Connected to Florida Deputy’s Death Re-Entered in Texas

    by BOB PRICE
    25 Nov 2016

The illegal alien reported to be responsible for the death of a Florida sheriff’s deputy had been previously deported and illegally reentered through Texas.

Nassau County Sheriff’s Deputy Eric Oliver was killed Tuesday morning when he attempted to catch an illegal alien fleeing on foot. The deputy accidentally ran in front of an SUV and was fatally injured. The fleeing illegal alien was later identified as Francisco Obbidio Portillo-Fuentes, 25, a Salvadoran national.

Breitbart Texas learned that Portillo-Fuentes had previously been deported from the United States following a DUI conviction. He reentered the U.S. near Laredo, Texas, on November 19, according to Miami Sector Division Chief Todd Bryant.

Three days later, Portillo-Fuentes was found in Yulee, Florida. Deputy Oliver is survived by his 6-year-old daughter.

Oliver responded with another deputy to assist a Border Patrol agent who was investigating six men in a truck. The agent identified three of the men as illegal aliens and took them into custody. As the deputies and the agent were putting the men into the patrol vehicles, Portillo-Fuentes allegedly took off running to avoid apprehension.

Deputy Oliver instinctively gave chase but was struck by an SUV as he attempted to cross the roadway. He died on the scene from his injuries, Breitbart Texas reported on Wednesday. “When the individual bolted, their instinct was to go after them, and they did that. It’s unfortunate what happened,” Nassau County Sheriff Bill Leeper explained to local reporters.

“It looked like there was nothing she could do,” Leeper told News4Jax.

The two remaining men fled the scene in the pickup truck. They were found and arrested a short time later. Portillo-Fuentes was also eventually captured about 12 hours later.

Chief Todd confirmed to Breitbart Texas on Wednesday afternoon that all six men were illegal aliens from a variety of countries.

Portillo-Fuentes “had been deported from the U.S. on two separate occasions and is being held on felony reentry into the U.S. by Border Patrol at this time,” Sheriff Leeper said Wednesday afternoon in a written statement obtained by Breitbart Texas.

Information is not currently available as to why Portillo-Fuentes traveled from Laredo to Florida so quickly after reentering the U.S. He could face additional penalties in connection with Deputy Oliver’s death after he fled the scene to avoid being apprehended.

Man in Pursuit That Killed Deputy Was Illegal

STEVE PATTERSON ON NOV 30, 2016

NASSAU COUNTY, Florida -- An illegal immigrant who was being chased when a Nassau County sheriff's deputy was killed by an SUV told a federal judged Monday he wants to plead guilty to reentering the country illegally.

Francisco Portillo-Fuentes, a 26-year-old Salvadoran, could theoretically face up to two years in prison.

But his attorney told reporters the usual sentence is time served and another seven days behind bars, which immigration officials use to arrange deportation.

Portillo-Fuentes was arrested in Jacksonville about 12 hours after Nassau Deputy Eric Oliver was struck as he ran across Florida 200 in Yulee last week.

Portillo-Fuentes had been riding in a truck with other men that U.S. Border Patrol agents approached, and he ran to avoid the agents.

He had been removed from the country in September, the month after a DUI conviction in Jacksonville, and he had returned by crossing the Rio Grande just three days before Oliver was killed.

U.S. Magistrate Joel Toomey had scheduled the hearing Monday as a continuation of a detention hearing that began Wednesday.

Toomey told Portillo-Fuentes, who remained locked up, to come back next Monday for a hearing where he might be allowed to waive the formal indictment process and simply plead guilty.

Defense attorney Mark Rosemblum said after the hearing that it's common to plead guilty to illegal reentry. Rosenblum said Oliver's death was tragic but that he'd argue Portillo-Fuentes didn't deserve any greater punishment, since he had simply run to get away from authorities.

2-year sentence for illegal immigrant arrested after Nassau deputy’s death

    Posted March 6, 2017 03:04 pm
    By Steve Patterson

The undocumented immigrant who was being chased when a Nassau County sheriff’s deputy was hit and killed by an SUV was sentenced Monday to two years in prison before being sent back to El Salvador.

Francisco Portillo-Fuentes, who first sneaked into the U.S. in 2008, pleaded guilty in December to reentering the U.S. after an earlier removal.

Portillo-Fuentes, 26, was arrested in November after running from a truck that U.S. Border Patrol agents approached at a gas station in Yulee.

Two deputies who were already at the station on other business joined the agent, and Deputy Eric Oliver followed when Portillo-Fuentes ran across Florida 200, but was killed before he made it across the road.

Portillo-Fuentes’ attorney had argued there had been intent for Oliver to be harmed, but U.S. District Judge Marcia Morales Howard said that Portillo-Fuentes was still accountable for actions that “ultimately cost a life.”

Two years is the maximum sentence allowed for illegal reentry.

The judge said that term was “certainly not greater than required. … Whether or not it’s actually sufficient is somewhat of an academic question.”

Illegal immigrant charged in connection to death of Nassau County deputy

By: Stephanie Brown, News 104.5 WOKV

    Updated: Sep 10, 2018 - 4:55 PM

The illegal immigrant who ran from law enforcement in Nassau County, leading to the death of a Deputy who was hit by a car while chasing him, has now been charged in direct connection to that death.

WOKV has confirmed with the Florida Highway Patrol that Francisco Portillo-Fuentes has been indicted by a grand jury in Nassau County for aggravated manslaughter, felony murder, escape, and resisting without violence. FHP announced in April that they intended to seek charges, but they have continued to put the case together with the State Attorney’s Office and immigration officials, until now.

Since the 2016 incident, Portillo-Fuentes- who is from El Salvador- has been serving a federal sentence for illegally re-entering the country, but that sentence is up this week. He remains in the Duval County Jail at this time, where he was transported from federal custody because of the local charges that would be pending.

Nassau County Deputy Eric Oliver was hit by a vehicle, while chasing Portillo-Fuentes across SR 200 in November 2016. Investigators say Portillo-Fuentes had run off after federal investigators approached him and several other men in a truck. Court records show Portillo-Fuentes illegally entered the US only days before the incident, and he had been deported twice before that. He pleaded guilty to the illegal re-entry charge, and was sentenced to two years in prison.
