    Illegal alien allegedly molested girl

    PORTSMOUTH — An illegal alien wanted by the Department of Homeland Security is being held on $75,000 cash-only bail for charges alleging he restrained and sexually assaulted a 14-year-old girl in a Water Country wave pool Sunday.

    Marvin Hernandez, 27, of 11 Ingall St., Lynn, Mass., is alleged to have twice grabbed an inner tube in which the minor girl was floating, pulled her toward him and put his hand inside her bikini bottom. As a result, he is charged with a felony count of criminal restraint, felony false imprisonment and two Class A misdemeanor counts of simple assault.

    Prosecutor Corey MacDonald said the simple-assault charges are expected to be upgraded to reflect the sexual assault allegations.

    According to an affidavit by Officer Laura Purslow, she was dispatched to the Lafayette Road water theme park on Aug. 5 at 2:29 p.m. Purslow's report says the girl told police Hernandez put his hand down her bikini bottom twice and the second time she "got away" and told a lifeguard. The girl later identified Hernandez to authorities and his only form of personal identification was a Mexican voter's card, according to police.

    Hernandez was arraigned in Portsmouth District Court through a Spanish interpreter Monday, when not-guilty pleas were entered on his behalf and he requested the assistance of a public defender. He told the court he works as a roofer, shares a Lynn, Mass. apartment with four friends and offered the explanation that he was holding an inner tube with one hand and keeping afloat with the other.

    MacDonald told the court police have learned Hernandez is in the country illegally and is wanted by the Federal Immigration Department for deportation.

    "Mr. Hernandez is both a danger to the community and a flight risk," the prosecutor told Judge Sawako Gardner.

    At the conclusion of the arraignment, Judge Gardner set bail at $75,000 cash and $20,000 personal recognizance. If he is able to post bail, Hernandez is court-ordered to stay away from Water Country and return to the court for an Aug. 14 probable cause hearing.

    Absolutely disgusting.
    I saw this on the local news this morning. Hopefully, between this and the illegals beating each other with hammers in Manchester, people in New Hampshire will wake up. Yes, there are people here who are educated and opposed to illegal immigration. More letters are starting to appear in the newspaper opposing illegal aliens. However, a lot of people think that it is not a problem and NH will never become like California, Texas, NJ, etc.

    My husband and I are constantly talking about this to friends, coworkers,etc. Some care and have become involved-calling, faxing,etc.

    However,the majority don't care because it does not affect them(even though you explain to them how it does). Then you get the others who laugh and call you right wing nut job.My favorite is that I am "an entitled mean spirited bigot who fears other cultures."

    The thing that bothers me is why the illegals are not coming down harder on these vile people - and the legal people of Mexican ancestry.

    You know these creeps choose their victims by availability - in other words, it's the Hispanic community that is suffering the most from them.
    I think there is probably a lot of it that is not reported because of that.

    Of course, why would a grown man grabbing a young teenager and holding her, be called 'simple assault'? Even if he hadn't sexually molested her - it isn't just simple assault.

    PORTSMOUTH — A Mexican man who authorities believe is illegally in this country is in Rockingham County jail on $75,000 cash bail and faces possible deportation for allegedly touching a girl underneath her bikini bottom in an incident Sunday at Water Country.

    Police say Marvin Hernandez, 28, Lynn, Mass., grabbed the inner tube of a 14-year-old girl at about 2:37 p.m. in the water park's wave pool. Hernandez held her in the middle of the wave pool so she could not swim away and assaulted her.

    Hernandez, who did not know the victim, also faces deportation by Immigration and Customs Enforcement.

    "He's not a U.S. citizen, nor is he a documented worker. He's an illegal alien," said Prosecutor Sgt. Corey MacDonald.

    Immigration officials have requested that Hernandez be held pending a hearing.

    Hernandez was arraigned on a felony charge of criminal restraint and Class A misdemeanor charges of false imprisonment and two Class A misdemeanor charges of simple assault. MacDonald added that he plans to amend the simple assault charges to sexual assault charges.

    Hernandez told the court through a Spanish language interpreter that he works as a roofer in Danvers, Mass. and lives with four friends. He said there were a lot of women in the pool that day and he did not assault anyone.

    "All he did is hold onto his water tube with one hand and swim with the other. He has no recollection of touching anybody," Hernandez said through his interpreter.

    Judge Sawako Gardner set bail at $75,000 cash and $20,000 personal recognizance. He is prohibited from going back to Water Country or entering Portsmouth, except to travel on Interstate 95 or Route 16, meet with an attorney or attend court.

    Hernandez is scheduled to return to court for a probable cause hearing on Aug. 14.
