    Illegal alien convicted in death
    Home News Tribune Online 05/9/06

    STAFF REPORT
MIDDLESEX COUNTY — A 21-year-old Mexican national was convicted yesterday of the aggravated manslaughter of a Perth Amboy woman whose decomposed body was found two years ago in an apartment building basement next to the hotel where she lived.

Assistant Prosecutor Judson Hamlin said Graciano Martinez Rosales was found guilty of aggravated manslaughter and hindering apprehension.

Hamlin said Rosales was acquitted of a knife charge.

Rosales, an illegal alien from Oaxaca, Mexico, faces between 10 to 35 years in state prison when he is sentenced July 8, Hamlin said.

He was remanded to the Middlesex County Adult Correction Center in North Brunswick where he will be held without bail while he awaits sentencing.

Hamlin said he and the family of 38-year-old Carolyn Arrington, who was stabbed 42 times, are pleased with the verdict.

Hamlin said the verdict came yesterday after the jury deliberated for about three and half days following a weeklong trial before Superior Court Judge Frederick DeVesa, sitting in New Brunswick.

During the trial Hamlin argued Rosales stabbed Arrington 42 times after she struck him during an argument about money for sex.

Arrington's badly decomposed body was found Aug. 5, 2004, in the basement of an apartment house at 285 Bertrand Ave., Perth Amboy. The apartment house is adjacent to the Remington Hotel, where Arrington lived in a $160-a-week room.

An autopsy by the Middlesex County Medical Examiner's Office estimated Arrington died seven to nine days prior to the discovery of her body by the owner of the apartment building, who detected an odor inside the three-story, six-unit building on Aug. 3, 2004.

A cleaning staff was directed to get rid of the smell, but the odor was still present two days later. Arrington's body was discovered at the foot of the basement stairwell.

Rosales was arrested and charged with Arrington's murder on Aug. 9, 2004. Authorities said he confessed to the murder after being questioned during a series of interviews over about 15 hours.

Rosales, represented by William Fetky of New Brunswick, tried to have his statement suppressed during a hearing in February.

He claimed he was tricked into making the confession when police told him he would be subject to immediate execution in the electric chair unless he told them when they wanted to hear and confessed to the murder.

    Who is in control?

Once again this just proves the callousness and utter contempt this Mr Ed's posterior of a president has for the American people. Despite the tremendous increase in crime against Americans and their property and the deleterious effects his policies have had on other aspects of society he continues to ignore our plight. He places a higher value on the lives of his Latino brothers and sisters then he does American Citizens. If he spent just a fraction of his time and resources on taking care of the electorate that made the huge mistake of putting him in office instead of focusing all his energy on illegal aliens we could solve many of the social problems that beset our society. He is the most contemptible piece of crap to ever occupy the Treason House and needs to be impeached. I am more than furious that this useless waste of taxpayer dollars with inert material between his ears continues to ignore the fate of our society.

They've been showing the "heartbreaking" stories of illegals who are being deported that have had criminal records. How it's breaking their families heart etc. It's about time some of these families had a chance to have a tear-jerking interview of the heartbreak they have endured at the hands of illegal immigrants.

    20 years for fatal assault
Illegal alien stabbed Perth Amboy woman 42 times

MIDDLESEX COUNTY — A 21-year-old illegal immigrant from Mexico was sentenced yesterday to a 20-year prison term for killing a Perth Amboy woman whom he stabbed 42 times.

Graciano Martinez Rosales was acquitted by a Middlesex County jury in May of murdering Carolyn Arrington, 38, but was convicted of aggravated manslaughter and hindering his apprehension in the case.

Arrington's badly decomposed body was discovered on Aug. 5, 2004, in the basement of an apartment house on Bertrand Avenue in Perth Amboy.

The illegal alien from Oaxaca, Mexico, a landscaper, killed the woman during an argument over money for sex, prosecutors said. The fee was less than $20.

Just one of those 42 stab wounds — to the carotid artery in her neck — was enough to kill her, a medical examiner testified during the trial.

Rosales said nothing during his sentencing except that he understood the proceedings.

His attorney, William Fetky of New Brunswick, argued for a lighter term after his motion for a new trial was rejected by Judge Frederick DeVesa.

Rosales faced up to 35 years in prison.

A four-year term for the hindering charge will run concurrent with the 20-year sentence for aggravated manslaughter.

Rosales must serve 85 percent of his sentence, or 17 years, before becoming eligible for parole. He has credit for 718 days served at the Middlesex County Adult Correction Center in North Brunswick.

Rosales will be deported when he finishes the sentence, authorities said.

Arrington's family members burst into tears as they addressed the court.

"He took a mother, he took a sister and he took a grandmother," said Margaret Harrell, Arrington's sister.

"She was a good woman," said Arrington's daughter, Amanda Ortiz, 19. "I have a baby that she's never going to see and I have to live with that for the rest of my life."

When she turned to Rosales, she said, "May God bless you."

During the trial that began in April, Fetky told the jury his client did not commit the murder and the state has no physical evidence linking Rosales to the crime.

Rosales was arrested and charged in the early hours of Aug. 9, 2004. Authorities said he confessed to the murder after he was questioned during a series of interviews over a period of 15 hours.

Rosales, during a hearing in February, seeking to have his statement suppressed, said he was tricked into making the confession when police interrogators told him he would be subject to immediate execution in the electric chair unless he told them what they wanted to hear.
