There would be something wrong with any judge who doesn't throw this case out after the first couple of hours.

22,000-acre ranch is frequently crossed by illegal immigrants and drug smugglers, and that he holstered the weapon after assuring himself that the trespassers were unarmed.
I would do the same thing if I was in that situation and this should never even get to court. In fact I would laugh at MALDEF

    2 million dollars.........what a joke
MALDEF= MAL usually short for malfunction and DEF= they evidentally do not hear that America wants them gone

Looking at the limited facts about the case and applying it to the law, there are potential issues that can raise a case for a plaintiff. Such issues are perfect for a jury.

"Perfect for a jury?" Do you mean perfect for some ambulance chasing attorney to extort a monetary award from some gullible jury on behalf of a client who should not even have standing to bring such a case before a jury in this country?

    So much for "perfection."

Can anyone in their wildest imagination believe that an American Citizen should be punished for protecting his rights and his property against a criminal??? We need to protect and support this guy!!

Amen TB! We have a group of illegal invaders, tresspassing on private property, during the commission of a FELONY (atleast one of them had been previously been deported for distribution of a controlled substance) and these thugs have access to our legal system! It's outrageous!

It's cases like this that beg for serious Tort reform in this country! Tort laws should be modified so as to hold the petitioner/plaintiff liable for all legal fees of the defendant/respondent in the event they do not prevail.

This would make these schisters think long and hard before they hit the court house steps with frivolous litigation, such as this case is!
