The DHS planning document called for the construction of courtrooms with video conference capability in the San Diego area, among other resources.

Yes "could". Until this Mexico Border Deal was made unless they were from Mexico, they "could not" be returned to Mexico. It was a decades long "could not" that forced them to remain in the US until they were deported if they were OTM "other than Mexican".
