Presidents Bush and Obama to blame for harm caused by illegal immigrant deported 17 times

    May 26, 2017
    By Todd Starnes

Former Presidents Bush and Obama owe a personal apology to the family of a California boy gravely injured by an illegal alien. They should also pay for the child’s medical bills.

I’ll explain why in just a few minutes. But first, here’s the back story:

On May 6, the Lake family was returning to their home in San Ysidro after a day trip to Disneyland.

They were just about a block from home when a truck driven by an illegal alien broadsided their car. Benjamin Lake and his wife suffered minor injuries. Their six-year-old son was severely injured.

Lennox spent 18 days in the hospital – recovering from deep skull fractures, a broken nose and other injuries. The little boy faces a long and arduous recovery.

Constantino Banda-Acosta, the driver of the truck, has been charged with violating federal immigration laws. He’s also facing a number of charges in connection with the crash.

But here’s the kick the pants: The San Diego Union Tribune reports that Banda-Acosta had either been deported or allowed to voluntarily return to Mexico 17 times over the past 14 years.

And not once was he charged with violating federal immigration law.

So let’s get right to the point:

An American child was nearly killed on American soil by an illegal alien – and I blame the Bush and the Obama administrations.

Banda-Acosta was able to come and go as he pleased because Republicans and Democrats turned a blind eye to our immigration laws. They refused to secure the border and that decision nearly cost Lennox his life.

How many more Americans have to suffer at the hands of the foreign invaders?

Immigration attorney Andrew Nietor told the newspaper it was unfair to politicize the Lake family’s accident.

“I think this is the sort of case the Trump administration tries to politicize and tries to portray as typical, but it’s not typical,” Nietor said. “One of the reasons this case is noteworthy is because of the extreme circumstances.”

Unfortunately, it’s become quite typical for American blood to be shed on American soil at the hands of illegals. Remember Kate Steinle? What about Joshua Wilkerson, Jamiel Shaw Jr. and David Kriehn?

“Every study shows that the non-citizen population, including the undocumented, is more law-abiding than the U.S. citizen population,” Nietor said.

First of all, there is no such thing as a “non-citizen population.” They are called illegal immigrants. Second of all, that argument is a load of bull.

Every single person living in our nation illegally is a criminal. They’re called illegal immigrants because they are breaking the law.

And that brings me back to Presidents Bush and Obama.

Had they only done their job and secured the border, Lennox would not have spent 18 days in the hospital.

But their administrations failed the Lake family of San Ysidro, California. They failed to defend American sovereignty. They failed to secure the border. And as a result foreign enemies were allowed to set foot on American soil.

Fortunately, President Trump is in the process of making sure that never happens again.

As for Bush and Obama – they need to make things right with the Lake family. I suspect they are facing a mountain of medical bills – not to mention a long road to recovery.

So I am calling on both former presidents to pay for Lennox Lake’s medical bills. It’s the only good and honorable thing to do.

After all, their political expedience and capitulation nearly got an American boy killed.

DUI Suspect Previously Deported 15 Times - Back in Court

    Eric Scheiner
    June. 27. 2017

A preliminary hearing is scheduled Tuesday in California for an illegal alien deported 15 times, and now stands accused of driving drunk and fleeing the scene after an incident that seriously injured a 6-year-old boy.

KSWB reports, Constantino Banda Acosta, 38, is charged with hit-and-run causing permanent injury, DUI causing great bodily injury and driving without a license.

Federal immigration officials said the defendant has been deported from the United States at least 15 times over the past 15 years.

Banda was speeding on May 6 when he ran a stop sign and crashed his pickup truck into a Honda sedan, police and prosecutors allege. He fled but was arrested about a half-hour later, police told KSWB.

Doctors are "cautiously optimistic" that Lennox Lake, a 6-year old boy that was in the sedan Banda crashed into, will make a full recovery from his head injuries suffered in the incident.

After the preliminary hearing, a judge will decide if enough evidence was presented for Banda to stand trial.

Opening Statements: Undocumented immigrant accused in DUI hit-and-run

    Posted: Aug 21, 2017 11:27 AM PDT
    Updated: Aug 21, 2017 3:57 PM PDT

CHULA VISTA (CNS) - An oft-deported Mexican citizen drove drunk and caused a hit-and-run crash in San Ysidro that seriously injured a 6-year-old boy, a prosecutor alleged Monday, but a defense attorney told jurors that her client wasn't behind the wheel at the time of the collision.

Constantino Banda, 39, is being tried at the Chula Vista courthouse on charges of hit-and-run causing serious injury, DUI causing injury, driving with a blood-alcohol content over .08 percent, vandalism, battery and driving without a license.

The defendant has been deported from the United States at least 15 times over the past 15 years, most recently on Jan. 18, according to federal immigration officials.

Deputy District Attorney Christopher Chandler said in his opening statement that Banda was behind the wheel when his truck blew through a stop sign at Camino de la Plaza and Dairy Mart Road and T-boned a Honda Accord carrying 6-year-old Lennox Lake and his parents as they returned home from a day at Disneyland about 11:20 p.m. on May 6.

Chandler said Banda, his brother and a man who worked for the defendant, Jorge Adame Ariza, had been at a Chula Vista seafood restaurant/bar watching a boxing match before the crash.

Banda's estranged wife and her friend were also at the eatery, and the defendant flattened the tires on the friend's vehicle and another car before leaving, the prosecutor alleged. He also grabbed the friend of his estranged wife, and a bystander who intervened got into a fistfight with Banda, according to the prosecutor.

Adame drove away with Banda in the passenger seat, but Adame told police that Banda was behind the wheel when the accident occurred about a half-hour later, Chandler told the jury.

When Border Patrol agents found Banda's truck parked on a street not far from the crash scene, he was in the driver's seat. The defendant failed a number of field sobriety tests and his blood-alcohol content was measured at more than .15 percent, the prosecutor said.

Investigators looked at Banda's body and found seat belt markings that indicated he had been driving the truck at the time of the collision, according to the prosecutor.

But Deputy Public Defender Juliana Humphrey said police made up their mind quickly that Banda was the driver who plowed into the Lake family.

Later, evidence was developed that showed Adame was the driver of the truck at the time of the accident, Humphrey told the jury.

"It was he (Adame) who did not stop. It was he (Adame) who did not render aid," the defense attorney said.

Humphrey admitted that Banda popped the tires in the restaurant parking lot so his wife would have to go home with him.

The attorney alleged that Adame -- who was given immunity to testify -- lied and gave inconsistent statements to police.

Humphrey said Adame -- who had only been in the United States for 14 months -- got confused and first headed south before turning around near the border and driving north before getting into the accident with the Lake family.

Banda faces seven years and eight months in prison if convicted.

Illegal Alien Deported 15 Times on Trial for Alleged Drunk Hit-and-Run

An illegal alien who was previously deported at least 15 times is now on trial for an alleged drunk driving hit-and-run incident that severely injured a young boy.

Constantino Banda, a 39-year-old illegal alien from Mexico, was allegedly drunk when he hit a couple and their 6-year-old son as they were driving home from Disneyland that day, prosecutors said according to FOX 5 San Diego.

Banda allegedly ran a stop sign and hit the family while allegedly being drunk, blowing a .08 percent blood-alcohol level.

“There was significant intrusion into the rear compartment of the passenger side of the vehicle,” Deputy District Attorney Christopher Chandler said of the incident, according to FOX 5. “You can see the current airbag deployed where [the 6-year-old boy] was seated in his child seat.”

According to prosecutors, the illegal alien was with his brother and another man before the accident, eating at a Chula Vista, California restaurant. At the restaurant, when Banda was leaving, he allegedly flattened the tires of his estranged wife’s friends’ car. Banda also allegedly grabbed the wife’s friend and ended up in a fistfight with a bystander who was trying to stop it.

While the illegal aliens’ defense attorney says he was not driving at the time of the incident, the mother of the child disputed those claims.

“Knowing that he’s lying and you know the struggles we are having because they’re not, Mr. Banda or his wife are not cooperating with insurance, the investigation or anything it’s getting harder to go in all the time and see him,” Ingrid Lake told FOX 5.

In the State of California, illegal aliens are allowed to register and obtain driver’s licenses. Left-wing politicians and open borders activists first pushed the initiative on the basis that it would make California roads safer, with now nearly 1 million illegal aliens having driver’s licenses, Breitbart Texas reported. Banda, at the time of the incident did not have one of these driver’s licenses.

Banda was last deported from the U.S. in January.

Driver accused of DUI crash to be sentenced for immigration violations

SAN DIEGO (KGTV) - A man involved in a DUI hit-and-run crash that seriously injured a young boy in the South Bay is expected to be sentenced Wednesday for violating federal immigration laws.

Constantino Banda Acosta, a Mexican national who had previously been deported from the U.S. at least 15 times in the past, has been in federal custody since March over federal criminal re-entry charges.

He was transferred to federal custody after charges against him stemming from a 2017 crash were dismissed.

Banda faced charges in the May 6, 2017, crash in San Ysidro that sent young Lennox Lake to the hospital with serious injuries, including head trauma.

Banda was initially charged with drunk driving and hit-and-run after authorities said he ran a stop sign at Dairy Mart Road and slammed his pickup truck into the Lake family’s car as they were heading home from a Disneyland trip.

Banda left the scene but was arrested about two miles away after Border Patrol agents spotted his damaged truck parked on a street, police said.

San Diego police Officer Michael Muniz testified in the first trial that Banda's blood-alcohol content measured .151 and .152.

Following a mistrial, a judge dismissed the case against Banda in March, saying there was no clear evidence that showed he was behind the wheel at the time of the crash.

Banda’s lawyers had argued that another man in the truck, Jorge Adame Ariza, may have been driving the truck after a night of drinking with Banda.

Adame said Banda got into a fight with another man outside a Chula Vista restaurant before the crash. During testimony in a preliminary hearing, Adame said he picked up Banda but later moved into the passenger seat with Banda behind the wheel during the crash.
