Illegal immigrant deported five times could get death

"This murder case is a textbook example of how wide open borders expose the Valley to violent crime," Thomas said in a news release. "It is amazing -- but, sadly, all too common -- that a criminal suspect who had been deported from this country five times was back again, committing more crimes. The government's continuing failure to control our borders has made Maricopa County’s residents vulnerable to the worst kinds of violence."

County Attorney Andrew Thomas said today that his office will go for the death penalty in the murder case against an illegal immigrant who had been deported five times.

Demetro Acosta-Uribe is accused of killing Ivan Santos in Phoenix back in May.

According to the county attorney's office, Santos' body was found in the front yard of a west Phoenix home. He had been shot to death and his head was covered in plastic.

Two other men were found at the same time, police reports show. Both were restrained in the same way. Neither had been shot, but investigators said one of the men would have suffocated if a neighbor had not come to his rescue.

Police believe Santos was shot and killed as he tried to escape.

Investigators arrested Acosta-Uribe in connection with the killing in July.

The county attorney's office said Acosta-Uribe, who is a citizen of Mexico, had been deported five times, first on April 29, 1988, and most recently on May 7, 2004.

    Illegal Immigrant Faces Death Penalty

An illegal immigrant who's been deported five times will be facing the death penalty for a Phoenix murder.

Demetro Acosta-Uribe is accused of shooting Ivan Santos to death earlier this year.

According to police reports, Santos' body was found in May 2007 in the front yard of a west Phoenix home. The victim had been shot to death after he was bound and his head covered in plastic wrap.

Two other men were also found on the property, restrained in the same manner. Neither had been shot, but one of the victims would have suffocated had a neighbor not rescued him.

Police allege Santos was shot and killed as he tried to escape.

The Maricopa County Attorney's office says the case is an example of how wide open borders expose the Valley to violent crime.

Andrew Thomas said the government's continuing failure to control the border has made Maricopa County residents vulnerable to violence.

Acosta-Uribe is a citizen of Mexico and had been deported five times.

The last deportation took place on May 7, 2004. He was also deported Nov. 21, 2003; Sept. 18, 1997; July 9, 1993; and April 29, 1998.

The Maricopa County Attorney's Office is releasing the deportation dates despite a federal policy that claims releasing the dates of official deportation would violate Acosta-Uribe's privacy.

The County Attorney's Office has concluded the public's right to know is more important than a federal policy that has no basis in law, and that represents the expansion of special rights for illegal immigrants.
