Illegal immigrant gets prison time in W.Va. sexual assault

MARTINSBURG, W.Va. — A 24-year-old man was sentenced Monday in Berkeley County Circuit Court to one to five years in prison in connection with the sexual assault of a 12-year-old girl in Berkeley County in 2014.
Eduardo Trejo-Ruiz of Mexico was sentenced after he pleaded no contest to one count of third-degree sexual assault.
Circuit Judge Gray Silver III also ordered that Trejo-Ruiz be placed on 10 years of supervised release and register for life as a sex offender.
Trejo-Ruiz is to be taken into custody by immigration officials and deported following his release from prison.
The court noted that Trejo-Ruiz is an undocumented immigrant, and the felony conviction prohibits him from returning to the United State.
Assistant Public Defender Tom Stanley told the court that Trejo-Ruiz had expressed an interest in returning home to Mexico.
Berkeley County Assistant Prosecuting Attorney Christine Riley told the court Monday that Trejo-Ruiz was 22 at the time of the sexual contact with the girl, and the prosecution had evidence that indicates he knew she was underage.
A second sexual assault charge contained in a February 2015 indictment against Trejo-Ruiz was dismissed as part of a plea agreement.
