Immigration detainer placed on man charged in fatal Omaha crash

    Jan 2, 2018 Updated 2 hrs ago

    Vismar Carmona-Martinez

Immigration officials have placed a detainer on the man who police say was driving drunk and traveling above the speed limit when his car rear-ended another vehicle, killing the 67-year-old woman inside.

Ann Smock had been driving home from a New Year’s Eve party. She died at the Nebraska Medical Center shortly after the crash.

Vismar Carmona-Martinez, 19, has been charged with motor vehicle homicide, said Douglas County Attorney Don Kleine.

Carmona-Martinez, who is younger than the legal drinking age of 21, had a blood-alcohol content of 0.24, or three times the legal limit for adults, police said. Furthermore, witnesses told police that the car he was driving was traveling in excess of the posted 60 mph speed limit.

A spokesman for U.S. Immigration and Customs Enforcement said Tuesday that an immigration detainer has been placed on Carmona-Martinez. ICE orders a detainer only in cases where someone is suspected of violating U.S. immigration laws, the spokesman said.

An immigration detainer requests law enforcement to hold an individual up to 48 business hours beyond the time that person would normally have been released. In addition to those in the country illegally, a detainer can be issued for an immigrant in the country legally.

It’s not clear how long Carmona-Martinez has been in the U.S. He attended all four years of high school at Omaha South and graduated in May 2016, according to Omaha Public Schools spokeswoman Kala Morrissey.

He is being held at the Douglas County Jail.

The crash occurred on northbound U.S. Highway 75 near O Street and was reported at 21 minutes after midnight Sunday. Police say Smock’s 2016 Chevrolet Spark was on the L Street exit ramp when it was struck by the 2011 Chevrolet Malibu driven by Carmona-Martinez. After striking the rear end of the Spark, the Malibu crossed the two northbound lanes and struck the concrete jersey barrier, police say. Carmona-Martinez was not seriously injured.

$1 million bond set for illegal immigrant in deadly Omaha crash

    JANUARY 3, 2018 BY
    KARLA JAMES

    Vismar Carmona-Martinez

It was in January of 2016 that Sarah Root of Omaha was hit and killed by an illegal immigrant in Omaha. He posted a $5,000 bond and skipped town. Officials never want a situation like that to happen again.

A $1 million dollar bond was set today for an illegal immigrant accused of motor vehicle homicide. Police say 19 year old Vismar Carmona-Martinez slammed into the back of 67 year old Ann Smock’s vehicle in south Omaha on New Year’s Day. His blood alcohol content was three times the legal limit.

Jim Masteller is a prosecutor with the Douglas County Attorney’s Office and the defendant is a flight risk and they had to make sure that sufficient bond was set.

Masteller says, “It is so important that everyone involved in the system do their part and our part is working with the local ICE officials to make sure we have accurate immigration information. It is our responsibility to make sure we let the judge know that so the judge has all the relevant information necessary to set a bond that is appropriate. That was done in this case. We are very pleased with the bond set.”

Carmona-Martinez will have to pay 10% of the $1 million, or $100,000 to get out on bond and Masteller believes that amount will be impossible for the defendant to pay.

Carmona-Martinez is a citizen of Mexico. His preliminary hearing is set for February 5th.
