Immigration Hall on Hold - Hazelton

With illegal immigration law on hold, Hazleton needs more than new words
Hazleton has put its controversial illegal immigration ordinance on hold. The Luzerne County city had been sued in federal court by the ACLU and Latino organizations who claimed the law was unconstitutional, unenforceable and likely to cause discrimination.

Instead of arguing the merits of the ordinance or the challenge in court, however, Mayor Louis Barletta agreed to delay enforcing it as scheduled next week. While the challengers considered the agreement a victory of sorts, Mayor Barletta put a different spin on things. ''We're not enforcing it because we are in the midst of amending it,'' he said. ''The amended ordinance will be even stronger and more defensible.''

That remains to be seen. The mayor says he has a crack legal team working on a revision, which is expected to pass city council later this month. Council Vice President Jack Mundie said he thinks the city should eliminate any mention of illegal immigrants in the ordinance's rental provision and simply require tenants to provide driver licenses or other documentation. Hazleton's original ordinance, passed in July, threatened landlords and employers with $1,000-a-day fines and license revocations if they rented or hired illegal immigrants. It also established English as the city's official language.

It's hard to see how doing a word dance around what this ordinance is all about is going to make it any better. Regulating immigration still remains a federal responsibility. While there's reason to be frustrated with the job the feds have done, this ordinance won't control immigration. All Mayor Barletta and council accomplished was to push the problem onto landlords and employers, putting them in the difficult position of trying to determine a person's citizenship. That's unreasonable and ineffective.

The agreement reached last week also stipulates that the city will provide notification 20 days before it intends to enforce the existing or amended ordinance. That will give the ACLU and others plenty of time to file a challenge, which means that sooner or later, the city's efforts probably will end up back in court.

This is something that should be changed as well. I would think it logical for the states to be able to take their own action if the feds aren't doing their jobs.

What is this guys opinion? Just what does he think this ordinance all about? I went to the link because I was going to publish the authors name but it's not included in the article. Actually, Mr. Unknown Opinion, it's to push the problem back to where it belongs.

I don't know about the employers part of the comment above, but as for the landlords, it was my understanding that new renters had to get a permit to rent from the city town hall. If that's true, there should be no burden on potential landlords.
