Report: US-Mexico reach deal on asylum overhaul

The Washington Post reports that the Trump administration has cut a deal with the incoming Mexican government potentially overhauling long-standing asylum rules; Bryan Llenas reports from West Palm Beach, Florida.



Reports on Saturday said the Trump administration had struck a tentative deal with Mexico’s incoming government to require all asylum-seekers from south of the border to wait in Mexico while their asylum claims go through court.
But by early evening, the picture grew more complex, as the incoming Mexican government said there was "no agreement of any sort."

The Washington Post, citing Mexican officials and senior members of president-elect Andrés Manuel López Obrador’s transition team, reported early Saturday that the Remain in Mexico plan would require asylum applicants to stay in Mexico, therefore ending the “catch-and-release” practice whereby those seeking asylum are allowed to stay in the U.S. while their claims are being processed. This is one of several options the Trump administration has been pursuing in negotiations for months.

Implementation of such a policy would mark a significant victory for President Trump, whose tough immigration stance -- including his promises to end catch-and-release and build a wall -- has formed a central part of his political platform both before and after his election.

The Wall Street Journal, in its own report on the agreement, said it strives to control how many migrants are allowed to stay on the American side of the border during the asylum process.

The White House did not comment on the reported deal on Saturday. “President Trump has developed a strong relationship with the incoming Obrador Administration, and we look forward to working with them on a wide range of issues,” Deputy Press Secretary Hogan Gidley told Fox News.

Trump did turn to Twitter on Saturday evening to discuss the migrant matter, vowing that those at the U.S.-Mexico border wouldn't be permitted into America "until their claims are individually approved in court."

That ran contrary to The Post's account of the agreement with the incoming administration of Andres Manuel Lopez Obrador, who takes office Dec. 1.

The Post had also quoted Sanchez as saying, "For now, we have agreed to this policy of Remain in Mexico."
Sanchez, in her statement to AP, did not explain why The Post had quoted her affirming the existence of an agreement.

The statement shared with AP said the future government's principal concern related to the migrants is their well-being while in Mexico.

Trump has been battling with international pressure, a tight control of the Senate, and significant judicial pushback over a number of his immigration policies.

This week a federal judge in San Francisco barred the administration from refusing asylum to those who cross the southern border illegally, after the White House said that anyone crossing illegally would be declared ineligible for asylum.

The deal appeared to be coming at a time when Trump has set his sights on the latest migrant caravan to travel through Honduras and Guatemala toward the U.S. southern border. He has expressed determination to stop the caravan from reaching the U.S., deploying troops to the border and warning of consequences should countries assist the caravan in its journey.

It was not clear at press time what the policy implications of this latest disagreement on an asylum-seeker deal might be.

MEXICO CITY (AP) — Mexico’s incoming government denied a report Saturday that it plans to allow asylum-seekers to wait in the country while their claims move through U.S. immigration courts, one of several options the Trump administration has been pursuing in negotiations for months.

The deal was seen as a way to dissuade thousands of Central American migrants from seeking asylum in the U.S. In effect, Mexican border towns are already acting as waiting rooms for migrants hoping to start new lives in the U.S. due to bottlenecks at the border.

“There is no agreement of any sort between the incoming Mexican government and the U.S. government,” future Interior Minister Olga Sanchez said in a statement.

Hours earlier, The Washington Post quoted her as saying that the incoming administration of Andres Manuel Lopez Obrador had agreed to allow migrants to stay in Mexico as a “short-term solution” while the U.S. considered their applications for asylum. Lopez Obrador will take office on Dec. 1.

The statement shared with The Associated Press said the future government’s principal concern related to the migrants is their well-being while in Mexico.

The Washington Post reported Saturday that the administration of U.S. President Donald Trump has won support from the Mexican president-elect’s team for a plan dubbed “Remain in Mexico.”

The newspaper also quoted Sanchez as saying: “For now, we have agreed to this policy of Remain in Mexico.”

Sanchez did not explain in the statement why The Washington Post had quoted her as saying there had been agreement.

White House spokesman Hogan Gidley said, “President Trump has developed a strong relationship with the incoming (Lopez) Obrador Administration, and we look forward to working with them on a wide range of issues.”

Stephanie Leutert, director of the Mexico Security Initiative at the University of Texas at Austin, described the Remain in Mexico plan as a strategy to take away the ability of migrants to live and work in the U.S. while cases are processed. “The hope is that asylum seekers will not want to live in (Mexico) for months/years and won’t come,” Leutert said via Twitter.

U.S. officials have said for months that they were working with Mexico to find solutions for what they have called a border crisis. One variation, called “Safe Third,” would have denied asylum claims on the grounds that asylum seekers had found haven in Mexico. President Enrique Pena Nieto offered thousands of Central Americans asylum on Oct. 26 if they agreed to remain in southern Mexico. Close to 3,000 migrants took Mexico up on the offer.

Sanchez said Saturday that the next government does not plan for Mexico to become a “third safe country.”

Approximately 5,000 Central American migrants have arrived in recent days to Tijuana, just south of California, after making their way through Mexico via caravan. But agents at the San Diego port of entry process fewer than 100 claims per day.

Tijuana Mayor Juan Manuel Gastelum on Friday declared a humanitarian crisis in his border city of 1.6 million, which he says is struggling to accommodate the influx. Most of the migrants are camped inside a sports complex, where they face long wait times for food and bathrooms. Hundreds of Tijuana residents have protested their arrival, complaining that recent caravans forced their way into Mexico from Guatemala.

Trump threatened Thursday to shut down the border crossing entirely if his administration determines that Mexico has lost “control” of the situation in Tijuana.

Julieta Vences, a congresswoman with Lopez Obrador’s Morena party who is also president of Mexico’s congressional migrant affairs commission, told the AP that incoming Foreign Minister Marcelo Ebrard has been discussing with U.S. officials how to handle a deluge of asylum claims at the border.

“They’re going to have to open the borders (for the migrants) to put in the request,” Vences said. “They will also give us dates, on what terms they will receive the (asylum) requests and in the case that they are not beneficiaries of this status, they will have to return here,” Vences said.

She spoke to the AP after a visit to the crowded sports complex in Tijuana.

Local churches and charities have been feeding the migrants, with assistance from state and federal agencies. They have also distributed thousands of blankets, thin mattresses and personal hygiene kits.

Meanwhile, the government of the state of Baja California has identified 7,000 jobs for which migrants could possibly earn income while they await hearings in the U.S.

Trump took to Twitter again Saturday to reiterate that he plans to do away with the U.S. catch-and-release system, which allows asylum seekers to work and study sometimes for years while their cases are pending.

Mexico's incoming interior minister, Olga Sanchez Cordero, said Saturday that a plan for Mexico to be a safe third country for asylum claimants in the U.S. were "ruled out," following reports in the Washington Post of a deal with the Trump administration.


Sanchez told Reuters ongoing talks with the United States on the situation of migrant caravans were "very delicate."


Citing Mexican officials and senior members of president-elect Andres Manuel Lopez Obrador's transition team, the newspaper said the agreement would break with long-standing asylum rules and mount a new obstacle to Central American migrants attempting to reach the United States and escape poverty and violence.


Reached for comment by Reuters, incoming deputy interior minister Zoe Robledo said details of the "Remain in Mexico" scheme were still being worked out.


He confirmed the plan in essence foresaw migrants staying in Mexico while asylum claims are being processed, and said the incoming government wanted to find jobs for them in sectors that are short-staffed, such as maquila assembly plants.


"What we're aiming for is that people leaving their countries due to security issues or violence can find a place to stay in Mexico if that is their decision," Robledo said.



Lopez Obrador has vowed to try to eliminate the causes of migration by creating more jobs and improving living conditions in Mexico and Central America.


In exchange, he hopes U.S. President Donald Trump and the Canadian government will agree to help spur economic development in the region.
Outgoing President Enrique Pena Nieto has also sought to stem the flow of migrants north by offering jobs to them, and has received backing from the private sector in his efforts.


Olga Sanchez Cordero, Mexico's incoming interior minister and the top domestic policy official for Lopez Obrador, who takes office Dec. 1, told the Washington Post the plan, known as Remain in Mexico, was a "short-term solution."


"The medium- and long-term solution is that people don't migrate," Sanchez Cordero said. "Mexico has open arms and everything, but imagine, one caravan after another after another, that would also be a problem for us."


The paper said that according to the outlines of the plan, asylum applicants at the border will have to stay in Mexico while their cases are processed, potentially ending the system Trump decries as "catch and release" that has until now generally allowed those seeking refuge to wait on safer U.S. soil.

The incoming Mexican administration of Andrés Manuel López Obrador now says that there is no deal with the United States that would allow asylum seekers to wait in Mexico while their cases are decided after reports Saturday indicated such an agreement had been reached.

On Saturday, The Washington Post reported that a deal between the Trump and Obrador administrations would begin a "Remain in Mexico" policy to replace the existing system – ofter derisively called "catch and release" – of permitting migrants to remain in the United States while their cases move through the courts, a process that can take years.

"For now, we have agreed to this policy of Remain in Mexico," Mexico’s incoming interior minister, Olga Sánchez Cordero, told the Post. She described the policy as a short-term solution, while the "medium- and long-term solution is that people don’t migrate."

But later , Sánchez said, "There is no agreement of any sort between the incoming Mexican government and the U.S. government." Sánchez, who will serve as Obrador's top domestic policy official when he takes office on Dec. 1, did not explain the reason for the conflicting statements.

President Donald Trump had appeared to tout the agreement in tweets, declaring, "Migrants at the Southern Border will not be allowed into the United States until their claims are individually approved in court."

"There is no way that the United States will, after decades of abuse, put up with this costly and dangerous situation anymore!" he added.

Sánchez said the migrants also pose a major headache for Mexico.

"Mexico has open arms and everything, but imagine one caravan after another after another. That would also be a problem for us," she told the Post.

Rep. Elijah Cummings, D-Md., said Sunday that he does not support a "Remain in Mexico" agreement "because that's not the law."

"They should be allowed to come in, seek asylum, that's the law," Cummings, who is expected to chair the Oversight Committee when his party takes control of the House of Representatives in January, told "Meet the Press" host Chuck Todd.

"I think we have a system that has worked for a long time. This president's come in, wants to change it, that's up to him. But now the Congress has got to stand up and hopefully they will," Cummings said.

Stephanie Leutert, director of the Mexico Security Initiative at the University of Texas at Austin, said on Twitter that officials from the U.S. and Mexico hope that a "Remain in Mexico" policy could deter Central American migrants fleeing gang violence and poverty from seeking asylum in the U.S.

"This is the most recent move by the Trump admin to deter asylum seekers from coming to the border," Leutert said. "The idea is to take away the ability to live & work in the US while cases are processed. The hope is that asylum seekers will not want to live in MX for months/years and won't come."

She said the policy, if enacted, would likely cut the number of asylum seekers, but cautioned that it could persuade others to try and illegally cross the border "undetected."

This is the most recent move by the Trump admin to deter asylum seekers from coming to the border. The idea is to take away the ability to live & work in the US while cases are processed. The hope is that asylum seekers will not want to live in MX for months/years and won't come

If enacted, it would likely decrease number of asylum seekers. While some people will still find it preferable to wait in these cities - especially those with more money - others are more likely to look elsewhere. Others may even try to sneak in to the USA undetected.
