    Welcome H1b_Holder! Dixie and Nouveauxpoor have done a great job explaining the problems with family based immigration. I would like to tackle the other issue you mention--employment based immigration.

    While it's great to have legal immigration that fills a REAL need in our country, we have many companies here who are driven by greed to misuse the law. They look for ways to get around the H1B requirements that no American citizen can be found who meets their criteria for the positions they need to fill. If you'll click on the YouTube link in my signature below, you'll see one example of how employers misuse the H1B visas. The lawyer in the video even makes the comment that the point is NOT to find an American qualified for the position. They advise their clients to advertise in publications that will reach the FEWEST potential applicants! That is obviously NOT the way to find an employee! These companies are taking jobs away from Americans who have worked hard, and that's not right. Our nation should be looking after its citizens FIRST. Surely, you can understand that.

    Well I won't be happy until our government draws the line somewhere, I am all for legal immigration and agree totally with Dixie, but how many can we sustain, how many are the citizens expected to care for, how long are we suppose to watch our hospitals close down (more than 80 alone in Calif) How crowded do our schools get before it is enough, when our children are getting no education at all in the schools we build for them.

    If we don't look out for our country who will, are you going to say oh we better not go over there the poor Americans can not handle anymore people at the present time, Americas infratructure is falling apart, Americans are loseing their homes and jobs because of cheap labor, etc., I think not! yet when we try to get some control on this immigration issue, we are selfish because we do not want to turn the United States in to a 3rd world hell hole.

    What do you think, is it our duty to take in the whole world with out limits until we destroy us and our country??

    Do you believe it is not our right to prevent our lives from becoming what life is in India or China, Mexico and all points beyond are today?

    Do we Americans not do enough for the rest of the world??Seems like billlions of our tax dollars are going to aid to the rest of the world, just how much are we expected to give?

    Can we save alittle of this country for our children?

    people from other countries don't care about this country and this is why they should not and do not have any say or right to demand anything of our government, you see here in the States WE THE PEOPLE ARE THE GOVERNMENT, and we are sick and tired of OUR elected officals not hearing us and catering to people from other nations!!

    Its time for a moritorium and a deep breath until the ones here assimilate, and we sort out just how many we are letting in and just how many our infratructure can handle.We need to draw a line in the sand!! got it!

    Guess, Hb1 got the message loud and clear.

    Wow, you all rock. Thank you. I have had a belly full
    of these people complaining about our country and then not
    wanting to become Americans. I am sick of them wanting
    to maintain the very reasons they left their own countries.
    I am sick of immigration of any kind anymore.

    I was just looking at the Global Incident Map....and the USA
    has more going on in it than any other country in the world...

    One of the false dichotomies you hear in these debates sometimes is, if H-1B is legal, shouldn't we be for it? The answer is, as long as it is being used as intended, it is legal. However, the fake credentials, degrees, and resumes, the shell companies bringing in friends and relatives, the importation of rank and file workers with skill sets that are already abundant here, the diverting of job opportunities away from American candidates, the manipulation of salaries and job descriptions to lowball local workers, the fake job ads and sham interviews, and the ousting of American workers by foreign replacements falls out of the original intent of the framers of this program.

    The original intent was to temporarily fill spot shortages of highly skilled workers where local talent was not available.

    1. Bring in ordinary tech workers - no. Bring in someone with an esoteric skill set - ok.

    2. Have a team of H-1Bs shadow American employees to learn the business, then fire the Americans - no. Bring in an H-1b for a vacant slot you couldn't fill, then eventually sponsor him for a green card if he works out - ok.

    3. Advertise to specifically hire H-1Bs for a consulting bench, then send them out to other companies as contract workers - no. Hire an H-1B and train him to go back and represent your company in his country - maybe.

    If the program were being used as intended, there would only be a need for a few hundred or thousand of this visa. Not tens of thousands, or nearly 200K as it was for a few years.

    Boy, I am lost here.

    I thought H1B workers were temporary workers - I didn't know it was quasi-citizenship. I also didn't know they were allowed to bring their families, close and extended.

    We need to rethink this situation, big time.

    If we have a need for temporary workers - then let's hire them temporarily - until we can train American workers to do the job. They need to be hired for a certain time period.

    Frankly, I think in many instances, there are already American workers ready, welling, and capable of doing the job -

    Also, not to be mean, but I agree - Americans have got to run America the way we think best. It is way past time we allow anyone, ANYONE, other than Americans to make the decisions about our country.

    No matter how hard working, no matter how nice, no matter how anything.

    I too am irritated at foreigners telling us what their rights are, what we should be doing, how we should be running our country, etc. The H-1B is actually a 'dual intent' visa, they are allowed to want to immigrate, unlike with a tourist visa. There is an H4 visa for spouses, who are not allowed to work on that visa, but sometimes both husband and wife are H-1Bs.

    Between 2000 and now, hundreds of thousands - probably over a million - foreign workers were brough in on visas. During that same time, hundreds of thousands of us were let go. Isn't there something wrong with that picture?

    I visited this forum today. I am a skilled worker living in the United States for 8 years now on h1b visa and on path to Green Card. In past, in another discussion forum, I did talk to your President Willaim Gheen. He was not against legal immigration but says he is opposed to any increase or intake.

    I have been scanning some of your messages and seems like there is an immigrant phobia among the community here.

    I am eager to know what is your definiteion of legal immigrants. I live in Brooklyn, NY and all I see is immigrants of various nationalities, running groceries, pharmacies, etc.... I am sure all these immigrants are here for a living just like me.

    I work as a consultant and move around to various temporary client projects my company assigns me, I have worked in Atlanta, Rochester, Seattle, Connecticut, New Jersey, Las Vegas, Portland OR over all these years. I am currently a project manager managing a massive electronic payment system that will be installed in NYC cabs and also a tracking system that will be installed in NYC ambulettes. I have met so many people from different countries come here and settle and I have loved the fact that America is a melting pot with various cultures and fact that policies are framed in such a way that America always attracts talent and skill and gives a fair chance for immigrants like me.

    Over these years, I have built my career and have assimilated into the society. I have a lot of American friends from my own community and from other communities. We all hang out, keep in touch and go through everything that an average American (in your definition, people like you and not people like me) does.

    When I talk to family based immigrants, they have their own reason why family based immigration is good and employer based immigration is bad.

    When I talk to people who have crossed border, they have their own reasons to say they are purposfully dragged here by agents and America knows who these agents are but they dont act because they do want them here to do jobs that an avergae American cannot do.

    My wife is also on h1b visa and is a physician and pursuing residency at a non profit organization. Most of her patients do not even have a valid photo id and are funded the medicare system. One great thing America can do to humanity - treat these people for free with world's best medical facilities.

    We are not complaining about anything in general. We did send flowers and encouraged legal skilled immigrants to protest peacefully.

    I know that I will be attacked in this forum. But I would definitely like to make some points here.

    There is a lot of bashing against skilled immigrants for taking American jobs. One thing a lot of people here are not realising or willing to realise is that, we are in a rapidly changing world. After 8 years of staying here, when I go to my home country for a visit, I see things rapidly changing. The internet has revolutionised the world and the world is shrinking day by day and getting closer. With high tech and high speed communication, literally anything can be done anywhere in the world. Such a thing can never be reversed.

    Changes are happening everywhere and everyone must adapt to changes. Remember, we are just like you, we love you, we have friends among you and we want to interact more with you all so that cultural differences are reduced.

    There have been people posting about wage depression etc... It is not entirely true, there may be some unscroupolos employers paying less to some workers who do not know laws, but the system is designed in such a way that, this practice cannot hold good for a long run.

    Immigration lawyers are bashed for practicing methodologies not to hire American workers, now, this I am not sure how they can go against their ethcis. But if you all want to know and can prove that the lawyer in youtube video preached somethingw rong, you must sue this lawyer. Bar associations are very strict with lawyers acting in bad faith and ethics are most important for immigration lawyers. Believe me, we hate some of these lawyers as much as you hate them - As we are immigrants, they tend to take it easy on us and there are tons of cases where careers have been ruined by ego centric self centered immigration lawyers.

    Finally, immigrants do not steal jobs, but create jobs. In this rapidly changing world, alienating from the rest of the world is not the best solution. Remember, globalization is a 2 way traffic. One has to realize the impact of burning bridges in this globalized world.

    I am supportive of strengthening the borders, stop illegal immigration, and follow fair immigration policies. We are just like you and we do sympathize with people who have lost their jobs. In general, employers do not want to hire employees who are old and demanding high wage, they want young new people willing to work, like in a sweat shop, and get low wages. This is applicable to any employer and any employee, and just not h1b or green card employee.

    Old aged people who lose jobs do not get jobs again or quickly - this again applies to anyone, just not h1b. By blaming h1b and screwing a h1b, you cannot force an employer to hire you, instead employer outsources your job (this is the sad reality and is prevailent in IT, believe me this problem exists everywhere in the world, I am in my 30s and I am bracing for it too), unless you become an executive and bullshit around like a Vice president of a company, it is diffcult to keep your job. Now, don't shoot me (messenger) for this.
