    NC Republicans wanted to change birthright citizenship, well before Trump’s new push

    WASHINGTON Less than a week before Election Day, President Donald Trump has thrust the 14th Amendment — and its promise of citizenship to anyone born in the United States — into a mid-term election issue. But congressional members, including some North Carolina Republicans, have signed onto legislation to limit birthright citizenship long before Trump’s tweets.


    Five North Carolina Republicans were co-sponsors on bills in 2015 and 2017 to more narrowly define who the 14th Amendment would apply to. Rep. Steve King, R-Iowa, introduced the legislation.

    Under the Birthright Citizenship Act — which have not gotten hearings in the House, but have been introduced in each Congress since 2007 — citizenship would be limited to those born in the United States with at least one parent who is a citizen; a national of American Samoa and Swains Islands; a legal permanent resident or a non-citizen that is actively serving in the military.
    Most legal scholars believe it would take a constitutional amendment to make the change.

    The language of the bill would eliminate the children of legal immigrants without a green card, including H1B visa workers, or those in the country illegally. There are tens of thousands of H1B workers in North Carolina, many of them from India and working in the technology sector.

    “Some of them are having kids when they come here legally. Are they going to have to leave or are the kids going to have to leave?” said Steve Rao, a city councilman in Morrisville and member of the New American Economy, a group that favors immigration as a way of boosting the economy. “We don’t want someone to move back to India and create the next Google or SAS. I do believe that this would be negatively perceived.”

    Rao was born in West Virginia to Indian immigrants, making him a U.S. citizen under the 14th Amendment’s protections.

    North Carolina Reps. David Rouzer of Wilmington, Richard Hudson of Concord, Virginia Foxx of Banner Elk, Walter Jones of Greensville and Robert Pittenger of Charlotte were among the bill’s 48 co-sponsors in 2017.

    Trump told Axios that he could change it by executive order and would not need a constitutional amendment. In later tweets, Trump wrote that “So-called Birthright Citizenship, which costs our Country billions of dollars and is very unfair to our citizens, will be ended one way or the other.” It is unclear exactly what changes Trump would make. In 2015, then-candidate Trump and other GOP presidential hopefuls also discussed ending birthright citizenship.

    The 14th Amendment was ratified in 1868, just after the end of the Civil War.
    “Birthright citizenship has been exploited to reward those here illegally and encourages illegal immigration,” Foxx said in a statement to McClatchy. “Our national security and rule of law demand that we do not reward those who have come here and stayed here illegally.”

    Foxx said the best way to solve the problem is through comprehensive immigration reform and a secure border, not — as Trump has suggested — through an executive order.

    Rouzer said “final resolution of this issue will only rest with a change to the Constitution.”

    “Constitutional experts have differing views on whether birthright citizenship established in the Constitution by amendment applies to those born to illegal immigrants. It’s my belief that such an interpretation is counter to the true intent of the 14th amendment,” he said in a statement to McClatchy.

    Hudson said in a statement that eliminating birthright citizenship should be included in comprehensive immigration reform, which has proven elusive on Capitol Hill for several administrations.

    “We need better border security and comprehensive immigration reform, and that includes the elimination of automatic birthright citizenship for children born to illegal immigrants,” he said.

    The 14th Amendment says “all persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.” Trump and other critics have seized on the “subject to the jurisdiction thereof” part. Some legal scholars believe that phrase applies narrowly to foreign diplomats, who are not subject to U.S. laws, and their children.

    Leon Fresco, a former Department of Justice official in the Obama administration, said that terminating that clause would mean any undocumented immigrant could not be subject to U.S. laws.

    “It’d literally be like the movie ‘The Purge.’ It’s such an absurd proposal on its face,” said Fresno, who was deputy attorney general for the Office of Immigration Litigation. “If you’re not subject to the jurisdiction of the United States, then the U.S. can’t apply its laws to you.”

    Fresco, like others, said the only way to make a change is to amend the Constitution.

    North Carolina Sen. Jay Chaudhuri, who represents Wake County, said the president’s rhetoric is a continuation of his attacks on immigrants. Chaudhuri was born in Tennessee to Indian immigrants who were legally in the United States. His parents subsequently obtained green cards and are naturalized U.S. citizens.

    “The president’s (threat of an) executive order is designed to continue to create anxieties and create fear,” he said. “If that has applications toward children of H1B workers then it just seems to extend kind of the larger rhetoric that we’ve seen by the president.”

    The Trump administration said it plans to end a program that allows the spouses of H1B workers to work legally in the United States, though it has yet to enact the change.

    Virginia Foxx on Immigration

    As the granddaughter of Italian immigrants, I am thankful America has always opened her arms to people looking to build a better way for themselves and their families. But today America’s immigration system is broken. It’s not working for families; it’s not working for employers; it’s not working for taxpayers. We must work to reform our immigration system with humane and common-sense policies.

    Our first principles on immigration reform should be to secure the borders, uphold American laws, and protect our national security. This is why I support enforcing our current immigration laws.

    The incentive for illegal immigration into the United States must also be removed. Workplace enforcement is a critical component to immigration reform. Those who knowingly hire illegal workers are complicit in the broken state of immigration in this country. America currently operates with an optional E-Verify system that allows employers to confirm whether prospective employees are, in fact, legal to hire. Congress should explore making E-Verify mandatory and consider consequences for employer violations that amount to more than a slap on the wrist.

    Furthermore, immigration reform must also correct glaring problems with the current visa system. It is estimated that as many as 40 percent of illegal residents in this country have overstayed once-legal visas. The existing visa bureaucracy has to be overhauled in favor of a responsive system that tracks individuals upon entry and ensures timely exits. We should also give priority to those with sought-after skills.

    In June, I voted in favor of H.R. 4760, the Securing America's Future Act, although it failed to pass. I supported H.R. 4760 because it would have reformed America’s immigration system by ending chain migration, providing funding for a southern border wall, enforcing biometric entry-exit tracking, halting funding to sanctuary cities, and providing a legal, renewable status for those who have received DACA status. Additionally, the legislation clarified the "Flores decree," allowing children and their parents to remain together while in the custody of DHS.

    America is a nation of immigrants, but we are also a nation of laws. Deference to the rule of law is a defining feature of our great country and part of what makes us a beacon of hope for those escaping corruption and poverty in their home countries.

    Yep, anyone that has been in the game awhile knows "comprehensive immigration reform" is code for illegal alien amnesty.

    Most of N.C.'s congressional delegation oppose Trump's immigration policy on separating children from parents

    Some members of North Carolina’s congressional delegation say they are opposed to the Trump administration’s policy of separating children from their migrant parents at the U.S.-Mexico border.

    Other congressional members, notably Republican U.S. Sen. Richard Burr of Winston-Salem, and U.S. Rep. Virginia Foxx, R-5th, of Banner Elk, indicated they support President Donald Trump’s “zero tolerance” policy on immigrants who are accused of illegally crossing the U.S. border. In Washington, many Republican lawmakers are publicly stating they are opposed to the Trump’s policy that results in children being separated from their parents.

    The national debate on the issue continued Tuesday with news reports of children crying for their parents at detention centers. About 2,000 children have been separated from their parents.

    Republican U.S. Sen. Thom Tillis of Cornelius said in a statement that Congress “can take action to provide better long-term certainty and consistency ... that does not incentivize unauthorized border crossings.”

    “We should not be separating children migrants from their families,” Tillis said, adding, “Our nation is long-overdue for commonsense immigration reform, particularly when it comes to providing a path to naturalization for DACA recipients and securing our borders. I believe we can strike the right balance between being compassionate — especially towards children who were brought here through no fault of their own — and also being smart by taking steps needed to prevent future illegal immigration.”

    Burr said Trump is enforcing a long-standing law that requires adults crossing the board illegally to face criminal penalties.

    “I am open and willing to consider any legislative proposals with bipartisan support that resolve the issue of family separation while securing our border,” Burr said. “The previous administration ignored the law, and as a result family border crossings increased by 400 percent in President Obama’s last three years in office. The fact is that any changes to current law must be made by Congress.”

    Foxx said that the nation must uphold the rule of law, and that the U.S. House plans to vote on two immigration-reform bills that would improve immigration policy for families and strengthen border security.

    “And while I hate to see families separated, it is important that prosecution for violating the law continues,” Foxx said in a statement. “Both bills would keep families together and continue to protect children brought by traffickers and other nefarious actors.

    “I support the work of the administration and members of Congress to find a comprehensive solution to all of the problems related to immigration and border security,” Foxx said.

    U.S. Rep. Ted Budd of Davie County, R-13th, said in a statement released Monday that he blames the country’s broken immigration system.

    “I am in no way in favor of separating families at our southern border and will work with my colleagues to find a quick resolution to this matter,” Budd said. “In no developed country should you be able to illegally cross a border without any ramifications.

    “But due to the previous administration’s amnesty agenda, it has unfortunately incentivized more illegal immigration,” he said.

    The offices of U.S. Reps. Mark Walker of Greensboro, R-6th; Alma Adams of Charlotte, D-12th; and Walter Jones Jr. of Farmville, R-3rd, didn’t respond to email requests for comment.

    Meagan Lynch, a spokeswoman for U.S. Rep. George “G.K.” Butterfield of Wilson, D-1st, said that Butterfield is opposed to the president’s family-separation policy.

    “He has called it immoral and inhumane,” Lynch said of Butterfield. “He also said that it runs counter to American values.”

    Butterfield was among 190 House Democrats who are supporting the bill, Keep Families Together Act, that would end family separation at the U.S. border. The legislation would prohibit the U.S. Department of Homeland Security from separating children from the parents, expect in extraordinary circumstances.

    The bill also would limit criminal prosecutions for asylum-seekers.

    U.S. Rep. George Holding of Raleigh, R-2nd, said that there must be a better way to handle the immigration dilemma.

    “Nobody likes separating children from their mothers and fathers,” Holding said in a statement. “We should stop the political howling and find a solution quickly.”

    U.S. Rep. David Price of Chapel Hill, D-4th, said he is also supporting the bill, Keep Families Together Act.

    “The Trump Administration’s policy of separating immigrant children from their parents at our nation’s border is a cruel and deliberate practice designed to sow fear and panic in migrant communities,” Price said in a statement. “This policy ... is the direct result of an administration action which can be reversed at any time, contrary to the president’s lies.”

    U.S. Rep. David Rouzer of Johnston County, R-7th, said that the country’s immigration laws must be reformed.

    “I share the concern of many who are troubled that children are being separated from their families at our southern border,” Rouzer said in a statement. “It is my hope that the House and Senate will ultimately produce a bicameral bill with meaningful reforms that can be sent to the president for his signature. Time is of the essence.”

    U.S. Rep. Richard Hudson of Concord, R-8th, said in a statement that he supports Trump’s zero-tolerance policy.

    “But we can do it without separating children from their families, and we need to find that path,” Hudson said. “We can and should be tough on securing the border and stopping illegal immigration, but we can be tough without being cruel.”

    U.S. Rep. Mark Meadows of Transylvania County, R-11th, said in a statement Tuesday that he has introduced a bill, the Equal Protection of Unaccompanied Minors Act, that would close the loopholes in the U.S.’s immigration border-enforcement system. The legislation would clarify U.S. policies regarding family detention and the treatment standards of unaccompanied immigrants.

    “The president’s agenda of cracking down on illegal immigration is critical,” Meadows said, “and yet many of us, including the president, agree: there is a better way to solve the complications of illegal immigration proceedings than separating children from their parents at the border.”

    The solution to separation is not to let them into our country to begin with and if they sneak in, you bounce them right back out and report them to their home countries as possible child traffickers. In other words, if you show up at our border with a child in tow you're rejected immediately, entry denied, if you sneak in and get caught, you're on a plane immediately back to your home country to be met by the federal authorities of your home country at the airport for investigation and further action if any is needed. And of course, alert all media.

    Have Army transport planes on stand-by, load 'em up and fly them home within 24 hours.

    They are not "migrants". They are trespassing illegal aliens criminals.

    Keep them together on a bus back home!

    No asylum at Ports of Entry.

    We cannot have 500,000 people a day show up on our doorstep.

    Shut it down completely and terminate this foolish program!

    Rep. Virginia Foxx's support of illegal alien amnesty was a surprise to me, however, the support of illegal alien amnesty by Rep. Tillis comes as no surprise. He has made the fact that he is owned by big business interests very obvious over the last few years. Someone who supports more foreign workers to appease corporate and big business is also normally an amnesty supporter.

    Unfortunately, Rep. Virginia Foxx also has a career report grade of "F" on the reduction of foreign labor visas. Guess her support for amnesty really shouldn't have been that big of a surprise. To be fair, she is strong on a lot of issues that we support, however, the amnesty supporter thingy really disappointed me.
