Jeff Sessions Says Donald Trump Is Mulling Making Undocumented Immigrants ‘Self-Deport’

Top Donald Trump surrogate Sen. Jeff Sessions (R-Ala.) said on Wednesday that the Republican presidential nominee is considering a plan that would require undocumented immigrants to “self-deport” before they could get legal status to return to the U.S.

The comment was revealing not because the policy was different than what Trump has discussed previously ― it wasn’t ― but because he was willing to use the term “self-deport,” once considered radioactive among leading Republicans after 2012 nominee Mitt Romney famously discussed it. In 2012, even Trump called it “crazy” and “maniacal” and said it cost the Republican party votes.

Of course, things have changed over the past four years, and self-deportation is back.

“You basically would have [to] self-deport if you want to get a legal status in the United States,” Sessions said on CNN’s “New Day,” the day after the vice presidential debate.

Sessions said he was “not sure how firm [Trump] is on the details,” but that he was thinking about a policy in which undocumented immigrants would have to go back to their native countries and apply to come to the U.S., a proposal the senator noted has been put forward by politicians previously.

“He has discussed that and will wrestle with it,” Sessions said. “But what he said he’s absolutely going to do is end the future flow, end the lawlessness and put this country on the right path.”

Trump has spoken frequently about immigration since the beginning of his campaign, but often with vague language and pronouncements that he allowed people to interpret as they wished. This was especially true on enforcement ― Trump promised a “deportation force” last year and said all undocumented immigrants would have to leave.

Democrats jumped on the “deportation force” comments. Democratic vice presidential nominee and Virginia Sen. Tim Kaine referenced them during Tuesday’s debate, saying Trump wanted to send agents house to house and school to school.

Republican vice presidential nominee and Indiana Gov. Mike Pence called that “nonsense,” although he acknowledged Trump had used the words “deportation force,” which he said meant the existing Immigration and Customs Enforcement.

Sessions gave a similar explanation for the “deportation force,” something Trump aides have said as well.

“Well, he certainly said that,” Sessions said of Trump on CNN. “But he didn’t say that they’re going to go out house to house and round people up.”

Trump says he would deport certain undocumented immigrants and encourage the rest to leave on their own. That’s “self-deportation” in principle, whether or not candidates and their supporters use the term.

Take the way Romney described it in 2012. He said he would not “round people up,” but they would instead be encouraged to leave the country and apply for legal residency to return to the United States.

“The answer is self-deportation, which is people decide they can do better by going home because they can’t find work here because they don’t have legal documentation to allow them to work here,” Romney said during a Republican primary debate. “And so we’re not going to round people up.”

Trump insisted last year that his plan was different, in response to a question about his 2012 comments on Romney’s “self-deportation” remark.

“It’s mean-spirited,” he said at the time on Fox News. “This doesn’t work at all ... this would never have worked. Look, I want people to go out and they have to come in through the legal process.”

LOL!! CNN .... they just can't tell the truth or even let the truth prevail on its own.

Self-deportation is existing law. If you self-deport before you're arrested and deported, then you legally preserve your right to apply to enter the US legally at some future point in time. Self-deportation is not something a government does, it's what the individual does. It's no different than fleeing a crime scene before getting caught. Under US law, until you're caught and prosecuted, you're innocent until proven guilty and have all your rights intact. That doesn't mean you'll be allowed back in the US because the US has no legal obligation to let anyone from anywhere into the United States.

Yes, many will self deport (yipee yio) and they should expect that if a real American becomes potus. Our laws have been broken to procure illicit votes.

Self-deportation is an approach to dealing with illegal migrants in the United States that involves the creation of legal structures which will make life in the US so difficult as to encourage illegal migrants tovoluntarily return to their home countries, rather than organized efforts of law enforcement to locate and deport them. The 2012 Republican Party platform included self-deporation as a response to illegal immigration to the United States. The platform also calls for robust border enforcement, opposition to “any forms of amnesty,” enforcement of the use of E-Verify by employers for employment eligibility verification, and other “humane procedures to encourage migrants to return home voluntarily.”^[1]

This term was used as early as 1984 in a People article about the film director Roman Polanski, which referred to his self-deporting.^[2] The term gained its current association with illegal immigration in the 1990s, especially in California.

In 1994, William Safire described its usage by California governor Pete Wilson's immigration strategy, exemplified by Proposition 187, which prevented illegal aliens from using a variety of state social services. Safire summarized the philosophy of the approach as holding that "the most cost-effective way to change behavior is to make life unbearable under present behavior."^[3][4]

The same year, Lalo Alcaraz and Esteban Zul launched a satirical campaign involving a character named "Daniel D. Portado" (a pun on deportado, Spanish for deported), who facetiously promoted self-deportation.^[4][5]

The concept was popularized by Mark Krikorian of the Center for Immigration Studies and was endorsed in 2016 by Senator Ted Cruz and Governor Chris Christie.^[6]

Many people believe that there is no difference between a voluntary departure, a voluntary return, and a deportation. When, in fact, there is a significant difference between each one of them and each has a different immigration consequence if and when a person decides to seek admission to the United States.

Voluntary Departure : This type of departure can take place at the border, a port of entry, or anywhere in the United States, including immigration court or detention. It can be given by border patrol or by ICE – Immigration and Customs Enforcement.

• If at the border, typically there is a short detention period, usually less than 6 hours, fingerprints and pictures are taken, and a paper is signed. After which the person is allowed to go back to their home country. This type of immigration procedure is common at the border between Mexico and the United States if you are a Mexican national. It is also common if the person is not a habitual immigration violator and does not have a criminal record.
• This type of immigration procedure will not harm a person if they apply for a visa or a green card.

Voluntary Return : This type of departure only takes place at the border It can be given by border patrol.

• At the border, there is a short detention, usually less than 30 minutes, fingerprints are taken but nothing is signed. Basically, border patrol turns the person back around and sends them back to their home country (typically Mexico) without gathering any data or very little data about the person.
• This type of departure will not harm a person if they apply for a visa or a green card.

Deportation or Order of Removal: This type of departure takes place at the border, port of entry, or any immigration court in the nation. It can be given by border patrol or ICE – Immigration and Customs Enforcement.

• If at the Border or Port of Entry, a deportation is called a Expedited Removal. This type of order is allowed to be given to a person by border patrol within 90 miles of the border. A person will not be able to see a judge or contest an Order of Expedited Removal. It is up to border patrol alone whether or not to give someone an expedited removal order. A person’s fingerprints will be taken, notice will be given, and the person will sign something. Detention is usually more than 24 hours.
• In immigration proceedings, if the Judge determines that a person is not eligible for a certain type of relief or denies a person’s relief, an Order of Removal will be entered. If not detained, a person will receive a bag and baggage letter stating a place and time to report to in order to be deported.
• This type of departure will harm someone if they apply for a visa or a green card.
• An expedited removal order bars a person from applying for admission into the United States for five (5) years.
• An order of removal bars a person from applying for admission for ten (10) years.

Rapid REPAT

The ICE Rapid REPAT (Removal of Eligible Parolees Accepted for Transfer) program is designed to expedite the identification and removal of criminal aliens process by allowing selected criminal aliens incarcerated in U.S. prisons and jails to accept early release in exchange for voluntarily returning to their country of origin.

Background

In November 2007, ICE began meeting with state executive agencies to discuss the concept of ICE Rapid REPAT as part of the ICE ACCESS (Agreements of Cooperation in Communities to Enhance Safety and Security) initiative. The concept, implemented in Georgia and Rhode Island, is modeled after two programs in the states of New York and Arizona that capitalize on ICE’s ability to more effectively identify and ultimately remove criminal aliens from the United States while still preserving the integrity of the criminal justice system. ICE field offices recently began to reach out to state agencies to present ICE ACCESS partnership opportunities, including ICE Rapid REPAT, where appropriate.

Key Elements

• In states where Rapid REPAT is implemented, certain aliens who are incarcerated in state prison and who have been convicted of non-violent offenses may receive early conditional release if they have a final order of removal and agree not to return to the United States.
• Eligible aliens agree to waive appeal rights associated with their state conviction(s) and must have final removal orders.
• If aliens re-enter the United States, state statutes must provide for revocation of parole and confinement for the remainder of the alien’s original sentence. Additionally, aliens may be prosecuted under federal statutes that provide for up to 20 years in prison for illegally reentering the United States.

This program allows ICE to more effectively identify and quickly remove criminal aliens from the United States. ICE Rapid REPAT also allows ICE and participating states to reduce costs associated with detention space.

The Criminal Alien Program (CAP) provides ICE-wide direction and support in the biometric and biographic identification, arrest, and removal of priority aliens who are incarcerated within federal, state, and local prisons and jails, as well as at-large criminal aliens that have circumvented identification.

It is incumbent upon ICE to ensure that all efforts are made to investigate, arrest, and remove individuals from the United States that ICE deems priorities by processing the alien expeditiously and securing a final order of removal for an incarcerated alien before the alien is released to ICE custody.

The identification and processing of incarcerated criminal aliens, before release from jails and prisons, decreases or eliminates the time spent in ICE custody and reduces the overall cost to the Federal Government.
