Joe Biden: U.S. Constitution ‘Clearly Requires’ Illegal Aliens Be Included in Congressional Apportionment

Former Vice President Joe Biden says the United States Constitution “clearly requires” illegal aliens to be counted for the purpose of apportioning congressional districts in states.

On Tuesday, the U.S. Supreme Court heard arguments in Trump v. New York where President Donald Trump seeks to exclude illegal aliens from congressional apportionment counts that decide how many lawmakers represent each state in Congress.

Trump’s argument has been that including illegal aliens, and many temporary visa-holders, in apportionment counts dilutes the congressional representation of American citizens who live in states with small illegal alien populations.

In a statement, Biden claimed the Constitution actually requires that illegal aliens be included in apportionment counts:

Today, the Supreme Court of the United States heard a case about whether everyone in America will be counted in the Census for the purpose of apportionment of Congressional seats, as the Constitution plainly and clearly requires. Or whether the partisan politics of intimidation and xenophobia will intentionally exclude specific groups of people from being counted. It’s a case about whether we deny our ability to govern responsibly and undermine our fidelity to our laws and values as a government of, by, and for all people. [Emphasis added]

In America, we make ourselves heard when we fill out the Census to be counted. It’s a critical way the power of the nation resides in the people. That’s America. We can’t keep rewriting history, scrambling norms, and ignoring the Constitution and the precedents we abide by. It is my hope the Supreme Court does the right thing. And, Congress must give the experts at the Census the time to make sure everyone gets counted accurately. Let everyone be counted and let us begin the work to heal and unite our nation. Already, two lower courts in California and Maryland have ruled that illegal aliens must be included in the counts.

This week, Census Bureau officials said they will not have the counts needed for the apportionment until late into January, by which time Trump may have already left office, depending on the final outcome of the presidential election. Biden is almost certain to reverse the memorandum.

States such as Alabama, Arkansas, Georgia, Idaho, Indiana, Iowa, Kentucky, Louisiana, Mississippi, Missouri, North Carolina, Oklahoma, South Carolina, Tennessee, Utah, and West Virginia are projected to lose congressional seats if the illegal alien population is included in congressional apportioning.

Today, there are an estimated 11 million to 22 million illegal aliens living in the U.S. The Census estimates that based on current legal and illegal immigration levels, by 2060 about one-in-six residents will have been born outside the country.

The Founding Fathers had NO idea we would have airplanes flying in here from all over the world full of thousands of foreign citizens. And that those foreigners would be coming here with Visa's, and then never leave!

The Founding Fathers had NO idea we would have 100,000 illegal aliens pour over our border every month or that they would come over in the thousands for decades!

At that time, people came here by ship. We had vast open land. Many had to be vetted and in good health. They were self sufficient.

The Founding Fathers would have NEVER allowed this unfettered, unrelenting, invasion of our country go on for decades. They would have considered this an invasion and an Act of War by corrupt countries. It should be treated as such...they are not sending their "best" and it does matter what they are, they are here illegally.

Illegal aliens are a "class" of "persons" who should not be included in our Census and they should be deported.

The offspring of illegal aliens are not our citizens. They are here just as illegally as the mother who gave birth. They should not be counted, nor issued a U.S. birth certificate. The mother is here illegally, the baby in the womb is here illegally, and the baby out of they womb is therefore here illegally. They ARE citizens of the mothers country.

Visa overstays are a "class" of "persons" who should not be counted in our Census.

Foreign citizens who come here on vacation are a "class" of "persons" who should not be in our country...whether they came with a Visa, or walked over the border with no Visa. Illegal aliens have no Visa and no right to be here.

Foreign citizens in our detention centers, jails, prisons, ICE custody, orders for removal, waiting status, etc., are a "class" of "persons" who should not be counted in our Census. Deport them all.

We do not "represent" foreign citizens in our government nor should we allocate our "Federal Tax Dollars" to the cities and states who violate our Federal Immigration & Visa Laws. It is not the responsibility of our Mayors, our Governors, our Government to WORK for these foreign citizens.

Our President is the President of the United States of America. He or she is not the President of the World or it's people!

Their job is to serve and protect the American people.

You cannot violate Federal Laws and then turn around and be rewarded with Federal Tax Dollars. These swamp rats cannot pick and choose the Federal laws they like and the Federal laws they do not like!

Our laws have no color.

We do not want any "deal" for Amnesty or a Path to Citizenship. We demand they are deported and not rewarded!
