    Judge denies federal government's request to lift temporary hold on Obama's immigration action

    HOUSTON (AP) — A federal judge in Texas has refused to lift a temporary hold on President Barack Obama's executive action that could shield millions of immigrants from deportation.

    U.S. District Judge Andrew Hanen turned down the request from the U.S. Department of Justice on Tuesday.


    Hanen issued a preliminary injunction on Feb. 16 to halt the immigration action by Obama, who wants to spare from deportation as many as five million people who are in the U.S. illegally. The injunction was sought by a coalition of 26 states, led by Texas, that argued Obama's executive action was unconstitutional.


    The Justice Department has already asked the 5th U.S. Circuit Court of Appeals in New Orleans to step in. The appeals court is scheduled to hear arguments April 17. A decision could take months.

    Judge refuses to stop temporarily blocking Obama immigration programs

    BROWNSVILLE — A federal judge ruled late Tuesday to not lift his stay on President Obama's administration's immigration reforms and that government attorneys misrepresented facts in the ongoing lawsuit led by Texas and 26 other states.

    U.S. District Judge Andrew Hanen issued an order late Tuesday that stays his decision on halting the Deferred Action for Childhood Arrivals program and Deferred Action for Parents of Americans and Lawful Permanent Residents programs.

    Hanen wrote that further delaying implementation of the Obama administration's immigration programs wouldn't cause imminent harm and that they shouldn't move forward without further consideration.


    "The issues contested in this case are of national importance, and the outcome will affect millions of individuals," Hanen wrote in his memorandum opinion and order. "The parties’ arguments should be decided on their relative merits according to the law, not clouded by outside allegations that may or may not bear on the ultimate issues in this lawsuit."


    At issue in a court hearing last month was whether government attorneys had misled him about the implementation of expanding DACA from two- to three-year terms.


    Last month, government attorneys told him that about 100,000 immigrants in the U.S. illegally had been granted extended stays. Hanen excerpted a transcript from a Jan. 15 court hearing, where he said Justice Department attorney Kathleen Hartnett failed to make clear that immigrants had already been granted extended stays from two years to three years, as had been announced by Obama in November.


    Hartnett in a court hearing last month apologized to Hanen, saying the expanded program had been partially implemented between late November when the Department of Homeland Security memo on the new programs was issued and Feb. 16.

    The stays of more than 108,000 immigrants were increased from two to three years during that period, but Harntnett said it only affected those who were already enrolled in the initial 2012 DACA program.

    Hanen wrote that the federal government has misled him since December, when attorneys told him that applications for expanded work stays and authorizations wouldn't be accepted until February.


    "This Court expects all parties, including the Government of the United States, to act in a forthright manner and not hide behind deceptive representations and half-truths," Hanen wrote in an order filed Tuesday. "That is why, whatever the motive for the Government’s actions in this matter, the Court is extremely troubled by the multiple representations made by the Government’s counsel ― both in writing and orally ― that no action would be taken ..."


    Hanen's ruling came a day after the 5th Circuit Court of Appeals upheld the dismissal of a lawsuit challenging the original DACA program implemented by the Obama administration in 2012.
