    Judge Rules Teen Must Stand Trial in Death of 15-Year-Old Gi

    I wasn't going to post this and wondered why it came in on my alerts till I read the comments section, so I decided to post it. I wish I knew how to find the picture of him on MySpace that one of the people who posted said was there.

    ST. GEORGE, Utah (AP) -- A judge has ordered a 15-year-old boy charged in the death of a teenage girl to stand trial on charges of rape, aggravated assault and murder.

    Keely Amber Hall, 15, was found strangled in a St. George park on Jan. 10.

    A hearing will be scheduled to decide whether the boy should be tried as an adult.

    During a probably cause hearing Thursday in 5th District Juvenile Court, prosecutors presented detailed evidence from the scene at Dixie Downs Park.

    St. George police detective Allen Johnson described what he saw when he arrived at the park, which serves as the playground for a nearby elementary school.

    He described finding the girl's partially nude and battered body with a cell phone lying beside it.

    Johnson said he called the last number that came through the cell phone and the defendant, then 14, answered. Police brought the boy and two others in for questioning.

    "He (the defendant) said he just met Keely earlier that day," Johnson testified. "All through the interview he referred to her as 'that girl' and said he and the others had been hanging out at his house earlier drinking alcohol and smoking marijuana."

    Later that evening, the defendant and Hall met up at the park, Johnson said.

    During the interview with Johnson, the defendant described how he grabbed Hall and she called him a bad name, which the boy said caused him to "trip out." Johnson testified that the defendant told him he put his hand over Hall's mouth with his arm around her neck to hold her down while he ripped off her clothes and raped her. The boy said at some point he realized Hall was not breathing and he left, Johnson testified.

    The boy did not intentionally kill Hall, defense attorney Kenneth Combs said. "The issue before the court is whether she was actually dead during sexual intercourse," Combs said.

    Judge Thomas Higbee ruled there was probable cause that the defendant committed the crimes. He also scheduled a July 5 hearing to determine if experts can testify for the defense during a later hearing to decide if the boy should be tried as an adult.

    Higbee has ordered news media not to publish or broadcast the boy's name.

    This kid SHOULD be tried as an adult. Rape and murder are heinous crimes. Sure he was only 14, but if at that age he can do something this inexplicable, then HE WILL KILL AGAIN and is beyond any hope of rehabilitation (anyone who says he can be rehabilitated has been on the crack pipe too long!). I don't buy for a moment his explanation that "strangling her was an accident." Upon conviction he should be sentenced as an adult to Life in Prison without any chance at parole or pardon. If this girls death was an "accident," then it is only obvious that this boys life was an accident. Since he was only 14 at the time, the Supreme Court has ruled he is not eligible for capitol punishment, but life without parole is awfully close and if tried and convicted as an adult he is eligible to spend the rest of his life in maximum security at the Lone Peak Correctional facility after he turns 18.

    To chop it off and send him back to where he came from if he is from out of the country.

    How do you get messed up that fast without parental support.

    Parents need jail time for sure.

    Why would the judge want to hide the perpetrators name from the public? This is really outrageous especially if the rumours are try that the perp. is an illegal alien from Mexico.

    Will the local police be investigating claims that Marijuana and alchohol were available at a 14-year-olds home? Perhaps the parents of this boy should be arrested as well for contributing to the delinquency of a minor.

    I'm a big fan of quick justice when an animal like this admits to such a heineous crime, which he obviously did. A good hangin' rope costs about $5 and I'll foot the bill (and slap the horse).

    So-called "civilized society" really irritates me sometimes.

    I think it's awful that the supreme court has prohibited execution for murderers under 18. That's like giving somebody one or many free passes to kill someone without being held accountable. It will just embolden more minors to go out and kill. What if a 17 year old bombs downtown buildings killing thousands of people. Are we going to say he/she shouldn't be executed because of his/her age? Hopefully someone in prison will give this kid what he deserves. A visit from the Grim Reaper.

    I am curious....If the boy is tried as an adult...Does that mean they release his name and could that mean they could seek the death penalty???

    I hope this is a speedy trial......LOL....Right.

    This kid is going to need some protective services...I have heard that inmate will not tolerate something like this to happen.

    My kids go to her school and from everything I have heard he is an illegial alien. I think that is why this has been kept so quiet... the local police are afraid that those of us who live here (who are sick of illegials raping and murdering our CHILDREN!)will probably not take that news too well. Too much has happened around southern utah lately that is directly due to illegial immigrants. Wrecks that kill many, the truck left in the middle of the highway by a drunk illegial that killed a wonderful local nurse. When will the government get a clue that the immigration that is in the news so much is just bringing in criminals. How can we expect them to live by any laws when the very fact that they are here shows that the laws mean nothing to them!!!!!

    knows right from wrong and should suffer the consequences when they are wrong. Maybe that is why there is so many bad adults now??....Should have been spanked before they got out of hand...instead our jails are too full and they are releasing the bad to keep the worst and the good are afraid to be out at night because of it.

    There is a court order not allowing them to release a lot of facts about the case, one of them being this kids legal status. It probably comes straight from our great illegal alien loving state attorney.
    As much as I think KSL sucks, we can't blame them. Heck, KSL can't even get a decent pic from the family, they have to keep posting the one they jacked from myspace.

    This case illustrates that we do have increased crime from first generation illegal immigration. This is something the liberal media chiefs don't want us to believe.

    In fact I read an article last night that alleges crime is rising in our eastern cities because they don't have enough (illegal) immigrants. The article asserted that immigrants, especially illegal ones are motivated by fear to avoid law enforcement problems.

    That doesn't jive with several Utah cases that have been publicized. Many of them involve child molesters and drunk drivers.

    Dear Senator Bennett,

    On January 10th, a fifteen year old girl was raped and murdered in St. George. Is this what you want to continue to occur in Utah? Why isn’t the name of this murderer allowed to be made public?

    Incidents like this are so commonplace in Los Angeles, where I reside, that they just may make
    page 8 of the Metro section. I can’t imagine that is the case now in Utah, and I can’t imagine that is anything you’d ever want to eventuate in your beautiful state.

    Californians have been up against the ravages of unfettered, illegal immigration for many years. If the effects aren’t obvious to the rest of America, that this once great state is falling rapidly into anarchy, they certainly need to be. You cannot possibly want what’s happening here to happen in Utah. Many people here have conceded that California is lost, but many more fight on in hopes that the rest of America will come to its rescue, to restore the magnificence that once was.

    But in order for America to come to the rescue, America itself needs to avoid the lessons that California so ruefully learned.

    Illegal immigration must come to a halt now.

    I’m very aware of how you voted on the cloture motions, and I cannot understand what your reasoning may have been. But I am urging you to now stand up strongly with the American people in order to put trust back into the government that they have chosen to represent them. I urge you to demand that our nation’s existing laws be enforced. That includes strengthening our porous borders, workplace enforcement, and harsh sanctions to any cities, counties, or organizations that hold themselves out as “sanctuaryâ€

    ST. GEORGE — A 15-year-old boy pleaded guilty in 5th District Court on Tuesday to rape and murder in the Jan. 10 death of a St. George girl.



    A juvenile court judge earlier certified Carlos Hernandez to be tried as an adult. His case was moved from the 5th District Juvenile Court system to the district court on Dec. 3, which also allowed the media to publish the boy's identity.


    A plea agreement between Washington County prosecutors and Hernandez avoided a public trial, said deputy county attorney Ryan Shaum. Defense attorney Alan Boyack said Hernandez agreed to the plea deal after prosecutors dropped a first-degree felony charge of aggravated sexual assault.



    Hernandez admitted in court on Tuesday that he raped and killed 15-year-old Keely Amber Hall at a neighborhood park in St. George. He was 14 years old at the time and had just met Hall earlier that day.



    A St. George Police detective testified during a juvenile court preliminary hearing that two other boys cutting through the park found Hall's partially nude and battered body near playground equipment. A pathologist's report stated Hall had been raped and then strangled to death.



    Hernandez answered, "Yes," when Judge James L. Shumate asked if he believed the state's evidence would be enough to convict him of the charges he faced.
    Hall's father, Troy Hall, spoke during the hourlong proceeding, saying he loved his daughter "very, very much."



    "I would ask Carlos why, if it would do any good," he said. "But I'm sure his answer would make no sense to me. I don't know why people hurt other people like that."



    His daughter was an "awesome person," who made people laugh and "brought their spirits up while they were down," Hall said.



    The crime occurred at Dixie Downs Park not far from where two of Keely Hall's sisters live and where a younger sister attends elementary school, he said.

    "Carlos left a memory of the brutal rape and murder in the minds of Keely's sisters. He left a nightmare in their mind," Hall said, adding he hoped that Carlos' actions would weigh "very, very heavily" on him and that he could find a way to become a better person while he is in prison.



    Keely's mother, Julie Johnson, said through sobs that she "truly, truly loved" her daughter and missed her with all her heart.


    Boyack said although his client had been counseled not to talk about the crime, that didn't mean he wasn't full of remorse.



    "Carlos is doing today, which is shallow at best, what he can do. He is ready to take the judgment of the court," said Boyack.


    The boy's mother also addressed the judge through a Spanish-language interpreter, crying as she begged the Hall family to try and find a way to forgive her and her son.



    "I don't understand how he could have done this," she said. "I only ask you to forgive my son for the damage he has caused."



    Shumate sentenced Hernandez to an indeterminate term of 15 years to life on the first-degree felony murder charge and a consecutive term of five years to life on the first-degree felony rape count. A restitution fine of $15,000 was also imposed.



    Hernandez will be moved to the Utah State Prison within the next five days, his attorney said.



    "We have had extensive conversations with the Department of Corrections about him. He's the only inmate of that age," Boyack said. "They're prepared to do whatever they have to do to take into consideration his age. I doubt he'll be put with the general population."
