    PA-Man pleads guilty to assault of elderly woman

    NORRISTOWN — A man who dragged an elderly Hatboro woman from her home in the dead of night and sexually assaulted her on her lawn faces state prison time.

    Enrique Santacruz Perez, 39, formerly of the 2500 block of Horsham Road, Hatboro, pleaded guilty in Montgomery County Court on Friday to charges of involuntary deviate sexual intercourse and simple assault in connection with the September 2007 assault of the 74-year-old woman.

    "The circumstances of this make the crime utterly horrific," said Assistant District Attorney Stephen Geday, who is seeking a state prison sentence against Perez. "She was 74 years old, in the apparent safety of her own home and she was violently dragged from her home and sexually violated on her own lawn."

    "She was completely defenseless. There is no excuse for this. It doesn't get more horrifying than this," Geday added. "He's an animal."


    Judge William J. Furber Jr. deferred sentencing so that court officials can complete a background investigative report about Perez, a Mexican national who was reportedly working legally in the area as a landscaper and a cook in a Mexican restaurant at the time of the attack. Perez faces a possible maximum sentence of 7 ½ to 15 years in prison on the charges.

    U.S. Office of Immigration and Customs officials have filed a detainer against Perez and are likely to begin deportation proceedings against Perez after he serves his prison sentence, according to authorities.

    Perez, who remains in jail without bail pending sentencing, must be evaluated by the Pennsylvania Sexual Offender Assessment Board to determine if he meets criteria under the state's Megan's Law to be declared a sexually violent predator. Those deemed to be predators face more stringent restrictions under Megan's Law, including a lifetime requirement to report their addresses to state police.

    "He's sorry for what occurred. It was a direct result of his abuse of drugs and alcohol," said defense lawyer Craig Hosay. "He realizes it was an outrageous act and if he could apologize to the victim he would."

    The woman has since died of natural causes, not due to anything connected to the attack, according to authorities. The assault took place Sept. 18, 2007, and the victim died Dec. 23, 2007.

    Prosecutors previously said the injuries the woman suffered in the assault were too far removed from the time of her death to be linked to her death. Also, the woman had other health problems, said prosecutors, explaining why homicide was not added to the charges faced by Perez.

    The woman was attacked in her Lehman Avenue home during the early morning hours of Sept. 18. She was sitting at her kitchen table at about 3 a.m., enjoying a cup of coffee and a bowl of ice cream, when a Hispanic man burst through the door and dragged her into her backyard, according to the criminal complaint filed by Hatboro Detective Sergeant John Becker.

    "He immediately grabbed her by the arm and neck and dragged her from her kitchen, out her back door and off her back porch, choking her and covering her mouth in the process," Becker wrote in the criminal complaint. "Once in the back yard, the male stopped dragging (the woman) and began violently banging her head against the ground."

    The man first attempted to rape the woman and, when he was unsuccessful, sexually assaulted her. After terrorizing the woman for about an hour, the man dragged her back inside her home, throwing her onto her kitchen floor before leaving, police said.

    "(The woman) explained during the assault she thought she was going to die and be left in the ditch near her home," Becker wrote. "During the course of the assault (the woman) sustained injuries to her back, arms, hands, legs and feet."

    Armed with a description that the attacker was a Hispanic male, about 5'5" in height, who smelled of alcohol and fled toward the Robert Bruce apartment complex, authorities created a 50-plus member task force that included county detectives and police from municipalities from both Bucks and Montgomery counties to canvas the area.

    Receiving information that there had been a sexually aggressive man matching that description in a Hatboro bar earlier that morning and he had indicated he was from the Robert Bruce apartments, the task force focused there.

    Task force members went to the Robert Bruce complex where they took DNA swabs of any resident matching the description of the attacker. Eight swabs, all voluntary, were taken including one provided by Perez.

    On learning about the incident involving the elderly woman, a Hatboro woman contacted police to say she had heard footsteps on her roof at about 2:45 a.m. on the morning of the attack. Later that morning, she told police, she saw a written note in both English and Spanish on the wall above her mailbox.

    She told authorities she suspected that the person on her roof and the author of the note was "Enrique Perez." Perez worked at a Mexican restaurant she frequented and "had made her feel uncomfortable in the past," according to the criminal complaint.

    Realizing Perez was one of the eight from whom a DNA swab was taken, the forensic laboratory put a rush on the testing and determined that his DNA matched that of the elderly woman's attacker. Perez, who worked in the landscape business, was arrested at a job site.

    Involuntary deviate sexual intercourse?? What did he OD on viagra or something?
