Justice Department Sues Alamance Co. Sheriff to protect Illegal Aliens

ALIPAC NOTE: What this article does not tell you is that Alamance County is part of the 287(g) program which allows local police to enforce immigration law when they arrest illegal aliens for other crimes.

Alamance County Sheriff Sued By US Justice Department

Burlington, NC-- The U.S. Justice Department has sued Alamance County, its sheriff's office and Sheriff Terry Johnson, saying employees fear retaliation if they talk with federal investigators looking into allegations of discriminatory policing and discriminatory searches and seizures.

A news release issued Thursday says the department is seeking a judicial declaration that its attorneys can interview particular sheriff's department employees outside the presence of the lawyer for the sheriff's office. It says that's necessary because numerous current and former sheriff's office employees are scared to talk.

Alamance County Manager Craig Honeycutt tells WFMY News 2 that Sheriff Terry Johnson received a call around 4 p.m. Thursday saying they were being served by the Justice Department. The Sheriff's Department and the County had not yet received the paperwork.

Honeycutt said he would not comment on the lawsuit until he had the opportunity to read over the paperwork.

The Justice Department says it sued after all other measures failed. It says it's worked since July 2010 to get the sheriff's office to comply voluntarily.

Just a guess but I bet the sheriff was enforcing the 287(g) Law, not just applying the policy.

You got that right Ratbstard! He is one of the good guys. I honestly don't believe there are many "employees" who would come out against him. There was a counter protest right outside his jail back in 2008, many of the cops thanked us for being there!

I guess now Holder, Obozo, etal. will be going after any LEO who enforces the law! My Senators will be hearing about this... Kay Hagan is from the Greensboro area. Worthless as she is I will be dropping her an email and calling her office... pronto

Alamance Co. Sheriff Calls Justice Department Allegations "Not True"
    Staff Writer
    6:39 p.m. EDT, June 24, 2011

    BURLINGTON, N.C. (WGHP)—
Alamance County Sheriff Terry Johnson said Friday the allegations in a lawsuit filed by the U.S. Justice Department are untrue.

Johnson called a news conference on Friday, one day after the DOJ announced in a news release that it was suing Johnson, the Alamance County Sheriff's Office and the county itself.

Since last July, the DOJ has been investigating allegations that the sheriff's office and the county have engaged in discriminatory policing and unconstitutional searches and seizures.

The DOJ said the lawsuit seeks a judicial declaration that current and former employees can speak to them without the county's attorney being present. Johnson said Friday he has made the DOJ aware that the county attorney can be present during questioning of deputies, because deputies can "bind" the sheriff.

Johnson did not elaborate and did not take questions after reading the statement. He deferred to the county attorney, who also attended the news conference. He said, "No comment."

The DOJ alleged the employees currently fear retaliation if they cooperate with the investigation.

"I strongly dispute the allegations lodged against me by the United States Department of Justice in their lawsuit. The Alamance County Sheriff's Office has acted accordingly to established state and federal laws in all stages of this investigation," Johnson said.

Johnson said the DOJ has "violated my First Amendment rights to free speech" in bringing the lawsuit and conducting the investigation.

Terry Johnson needs to come out and let the world know that the Justice Department is targeting him because he rounds up illegal aliens for prosecution, just like Sheriff Joe in AZ.

Graham, NC -- Alamance County Sheriff Terry Johnson issued a written response on behalf of the Sheriff's Department to a lawsuit filed by the Department of Justice on Thursday.

The response states that the Sheriff's Office strongly disputes allegations lodged against it. It says the Alamance County Sheriff's Office has fully complied with all requests for documents made by the DOJ. They also state that they have never "forbid any personnel from speaking with Department of Justice"

The Department of Justice lawsuit claimed that employees of the Sheriff's Department fear retaliation if they talk with federal investigators looking into allegations of discriminatory policing and discriminatory searches and seizures.
