KENT — A town man is being held at the Putnam County jail after he raped a woman while her 5-year-old son was home on Friday, police said.

Victor Cruz-Garcia, 42, was being held on $100,000 bail after his arrest around 7 p.m., Chief Alex DiVernieri Jr. said.

Police said Cruz-Garcia was intoxicated when he got into an argument with the 39-year-old woman at her home. He threw her onto a bed, where he raped her, police said.

After the woman broke free, Cruz-Garcia smashed a glass against the wall near the boy and threatened to hurt the woman’s family if she called police, DiVernieri said. The woman’s 11-year-old daughter arrived home and called 911.

Police charged Cruz-Garcia with first-degree rape, a felony; and endangering the welfare of a minor and fourth-degree criminal mischief, misdemeanors. Jail officials had a federal immigration-detainer warrant placed on Cruz-Garcia because he is suspected of being an illegal Mexican immigrant.
