KS - Resolution establishes Shawnee Co. is not a sanctuary county

TOPEKA, Kan. (WIBW) -- The Shawnee County Commission voted unanimously Thursday to formally establish that the county should not be considered a sanctuary for people in the country illegally.
Shawnee Co. Counselor Jim Crowl presented the resolution. Shawnee Co. has made national lists as a sanctuary, which Crowl says is an unfair label. The situation has taken on greater urgency as the Trump administration has threatened to pull all federal funding from jurisdictions considered sanctuaries.
The resolution states that, unless repealed or declared unconstitutional, Shawnee Co. officials and employees shall comply with 8 USC 1373 which prohibits any government entity from prohibiting the sending or receiving or immigration information of any individual.
"(The resolution) acknowledges that U.S. Congress has enacted 8 USC 1373. It requires, as do our oaths require that we all take, that we shall observe and honor the U.S. Constitution, (and) the state of Kansas Constitution," Crowl said.
The issue first arose several years ago, when Shawnee County landed on several sanctuary lists for a jail policy to not honor immigration detainers without probable cause or a warrant. Crowl has said that's in keeping with federal law and court rulings.
Crowl says no policies have changed, however the resolution will provide an official statement for future inquiries on the subject.
