Man charged in 3 killings wanted by immigration authorities

SPRINGFIELD, MO. — A man who federal authorities believe is in the U.S. illegally has been charged in the fatal shooting of two former roommates and a woman whose home he moved into after his first victims threw him out, police in southwestern Missouri said. A second man has been charged as an accomplice.

Police said in charging documents that Luis Perez opened fire on Steven Marler, 38, and Aaron Hampton, 23, at their home in Springfield on Nov. 1. Two other people were wounded but survived. Perez then shot and killed Sabrina Starr, 21, a day later at her house, the documents say. The 23-year-old suspect faces eight other felony counts in the shootings.

Aaron Anderson, 19, told investigators that he was waiting with Starr in an SUV outside Hampton and Marler's home when Perez shot them. Anderson said he was on the phone with Perez at the time and that he could hear the victims "begging for their lives."

Anderson was charged as an accomplice with two counts of first-degree murder in those killings and three other felonies.

After the first shootings, Anderson, Perez and Starr drove to Starr's home, and police said she was shot six times there on Friday. A relative found her body the following day. No other details of that killing have been revealed.

The probable cause statement doesn't list a motive in any of the shootings, although Perez and Anderson had recently been kicked out of Hampton and Marler's home. A witness identified by the initials K.M. told police Perez said after the shootings that "they had to go" because "they knew too much," court documents say.

Springfield police homicide detective Scott Hill said in charging documents that Perez had recently arrived in Springfield from New Jersey, and that his immigration status was in question.

"I checked Luis Perez criminal history and it showed he had active warrants out of the state of New Jersey. The criminal history also showed Perez was not a U.S. citizen. Contact was made with federal authorities who confirmed they would detain Perez if contacted due to him being illegal," Hill said.

U.S. Immigration and Customs Enforcement spokesman Shawn Neudauer said in an email that the agency is reviewing its records and plans to issue a statement once that review is complete.

Police obtained a warrant to search several Facebook accounts and found messages from Perez after the killings indicating he was trying to trade a handgun. Perez called it a "dirty" handgun because it "Got bodies," the charging documents said.

Anderson told police a stolen gun was used in the killings. Charging documents say Starr had recently given Perez a stolen gun in exchange for a tattoo, but police haven't said that gun was used in any of the killings.

Two Glock 9mm magazines were found in a detached garage of the home where Starr's body was found. Shell casings at her home matched the 9mm shell casings from the home where the men were killed.

Perez and Anderson are jailed without bond in Greene County. No attorneys are listed for them in online court records.

Police also said Perez's girlfriend, Dalia Garcia, arrived on a bus from New Jersey on Friday and helped to burn evidence. She was charged with tampering with evidence and jailed on $75,000 bond.

Illegal immigrant released by 'sanctuary' charged with triple murder: ICE

Feds say three people would be alive today but for sanctuary policy

By Stephen Dinan - The Washington Times - Updated: 4:33 p.m. on Friday, November 9, 2018

An illegal immigrant released by a “sanctuary city” county in New Jersey was charged this week with a triple homicide halfway across the country in Missouri, authorities said Friday.

Luis Rodrigo Perez stands accused of being the gunman in a shooting spree last week that claimed the lives of two men and one woman, at two different homes.

U.S. Immigration and Customs Enforcement said it tried to deport Perez after he was arrested on domestic violence charges in Middlesex County, New Jersey, last year. But the county, which has a non-cooperation policy with ICE, refused to alert the feds when it released Perez in February of this year, ICE said.

“Had ICE’s detainer request in December 2017 been honored by Middlesex County Jail, Luis Rodrigo Perez would have been placed in deportation proceedings and likely sent home to his country — and three innocent people might be alive today,” said Corey Price, acting ICE executive associate director.

John Tsoukaris, ICE’s deportation operations field director in Newark, New Jersey, called Middlesex County’s policy “reckless.”

He said Perez had a history of violence and would have been a clear candidate for cooperation.

“We hope that this tragic turn of events forces Middlesex to reconsider its policy and that the local elected officials stop protecting criminal aliens,” he said.

In a statement the county government rejected blame and said it was ICE that dropped the ball.

Officials said they have repeatedly told ICE they will only cooperate in some instances, such as someone convicted of a “first or second degree offense.” They said Perez’s case didn’t reach that level.

Still, they said, ICE had 51 days while Perez sat in jail during which the agency could have tried to get a deportation order for Perez. The county said it would have honored that order.

“Instead ICE officials chose to do nothing, which places all responsibility of Mr. Perez’s actions squarely upon ICE,” the county government said in a statement.

Police in Missouri say Perez attacked a home which he had been kicked out of. The victims could be heard “begging for their lives,” The Associated Press reported, citing charging documents.
Perez later returned and fired on yet another person, authorities said.

Perez still had outstanding warrants from New Jersey, The Associated Press reported.

ICE: Man who killed 3 should have been deported before murders

    Luis Rodrigo Perez

NEWARK, N.J. (AP) -- A man charged with killing three people in Missouri this month should have faced deportation proceedings after he was arrested last year for a separate offense in New Jersey, instead of being released, federal immigration officials said Friday.
Twenty-three-year-old Luis Perez, who is from Mexico, is charged with fatally shooting two men and wounding two others Nov. 1 and then fatally shooting a woman the next day. He is jailed without bond on 11 felonies, including first-degree murder and assault. No attorney is listed for him in online court records.
U.S. Immigration and Customs Enforcement officials said they placed a detainer on Perez in December after he was jailed in Middlesex County, New Jersey, on multiple felonies, including assault. But Perez was released in February.
"Had ICE's detainer request in December 2017 been honored by Middlesex County Jail, Luis Rodrigo Perez would have been placed in deportation proceedings and likely sent home to his country -- and three innocent people might be alive today," said Corey Price, ICE's acting executive associate director.
The Perez case is a microcosm of the tug of war being waged nationally between federal immigration authorities and local communities that have limited cooperation with ICE. ICE has railed against so-called "sanctuary cities" and policies it says compromise public safety; immigrant advocates argue the agency targets suspects who have been charged but not yet found guilty, depriving them of the right to contest the charges.
Middlesex County adopted a policy last year that honors detainer requests from ICE if the inmate has previously been convicted of a first- or second-degree offense or was the subject of a final order of deportation signed by a federal judge.
In the case of Perez, county officials said via email from a spokeswoman Friday, ICE was advised the county wouldn't honor its detainer request in December because it didn't meet the necessary criteria. During the ensuing 51 days Perez was in custody, officials wrote, ICE didn't request an order of deportation from a federal judge.
"This order would have authorized Middlesex County to turn over custody of Mr. Perez prior to, or upon completion of his sentence," they wrote. "Instead ICE officials chose to do nothing, which places all responsibility of Mr. Perez's actions squarely upon ICE.
According to authorities in Missouri, Perez opened fire on Steven Marler, 38, and Aaron Hampton, 23, at their home in Springfield, Missouri, on Nov. 1. Two other people were wounded but survived. Perez then shot and killed Sabrina Starr, 21, a day later at her house, the documents say. Perez faces eight other felony counts in the shootings.
Aaron Anderson, 19, told investigators he was waiting with Starr in an SUV outside Hampton and Marler's home when Perez shot them. Anderson said he was on the phone with Perez at the time and that he could hear the victims "begging for their lives."
Anderson was charged as an accomplice with two counts of first-degree murder in those killings and three other felonies.
Police also said Perez's girlfriend, Dalia Garcia, arrived on a bus from New Jersey and helped to burn evidence. She was charged with tampering with evidence and jailed on $75,000 bond.

Illegal alien killed 3 after release from custody in New Jersey

Advocates don't care if a few of us are murdered, as long as the "sanctuary principle" is upheld.

    November 11, 2018
    By Rick Moran

An illegal alien arrested last December on domestic violence charges in New Jersey, ended up in Missouri early this month and murdered three people.
The New Jersey authorities knew that Mexican citizen Luis Rodrigo Perez was in the country illegally following his arrest. They knew because federal immigration officials informed them of that fact, and requested a detainer so that they could deport him.
But New Jersey, being a sanctuary state, refused to hold Perez and let him go. About 11 months later in Missouri, he went on a killing spree.
    Fox News:
Luis Rodrigo Perez, 23, a native of Mexico, is charged with fatally shooting two men and wounding two others on Nov. 1 and fatally shooting a woman the next day.
He was being held on domestic violence charges at the Middlesex County Jail in New Jersey in December 2017 and was released in February, NJ.com reported.
U.S. Immigration and Customs Enforcement (ICE) officials said they placed a detainer on Perez while he was in custody, but the request was not honored nor was the agency notified when he was let go, said Corey Price, acting executive director of ICE.
“Yet again, an ICE detainer was ignored and a dangerous criminal alien was released to the streets and is now charged with killing three people,” Price said. “Had ICE’s detainer request in December 2017 been honored by Middlesex County Jail, Luis Rodrigo Perez would have been placed in deportation proceedings and likely sent home to his country – and three innocent people might be alive today.
"It is past time that localities realize the perils of dangerous sanctuary policies and resume their primary goal of protecting their residents," Price added.
Mr. Price misses the point. Those who support the concept of sanctuary cities know full well that some of the criminal illegals that are released from local custody because officials refuse to cooperate with federal immigration authorities will commit murder. They know it and don't care. They figure that the number of murders committed by illegals will be small enough that they can justify letting dangerous criminals out on the street rather than put in deportation proceedings and sent home.
After all, it's "for the greater good." Surely we can afford to have a few American citizens murdered so that we uphold the idea that all are welcome here - even if they're violent criminals who end up making children, orphans or wives, widows. To them, it's worth the price.
Somehow, I don't think the loved ones of the three Missouri residents murdered by Mr. Perez would agree.
