Man Charged in Attempted Murder of Officer Was Previously Deported

The Toms River Police Department has identified and charged a New York man with attempted murder, aggravated assault on a police officer, and resisting arrest. Early reports suggest he was in the country illegally, and that he had previously been deported.
The charges stem from an incident Tuesday in which the suspect allegedly dragged a police officer 75-feet with his vehicle as he attempted to flee the scene of an investigation. Officer Daniel Brennan has been released from the hospital after treatment of his injuries.
Giomar Diaz, 33, whose last listed address was East 172 Street, Bronx New York, is being held on $500,000 bail. Police believe Diaz is in the United States illegally, and are currently holding him on an additional no-bail detainer from the US Immigration and Customs Enforcement Division.
Diaz is believed to have previously been detained on criminal charges in the United States, and was deported to the Dominican Republic at that time. Initial reports, according to the Toms River Police, are that these charges were weapon and drug-related.
In addition, an active warrant for Diaz exists from New York City.
Charges were also been filed against Alvin A. Hernandez Almanzar, 28, of Marlton Avenue in Camden New Jersey. He has been charged with hindering the apprehension of Diaz and driving with an expired license. The charges arise as a result of Almanzar picking Diaz up after he abandoned the vehicle used to assault Officer Brennan.
Bail has not yet been set for Hernandez -Almanzar.
Diaz was initially detained by Officer Daniel Brennan as a suspect in a document fraud. Diaz was allegedly attempting to use a false identity and documents in an attempt to gain additional government documents using a false name.
The female seen with Diaz earlier on Tuesday is still wanted for questioning and has not yet been identified.

TRENTON — The unauthorized Dominican immigrant who ran over a Toms River police officer with his car has drawn the ire of the Christie administration.
Giomar Diaz, 33, a Dominican Republic native who entered the United States illegally, was on Tuesday charged with attempted murder, aggravated assault on a police officer and resisting arrest.
Toms River police Officer Daniel Brennan suffered non-life threatening injuries on Monday after he was struck by Diaz's black Honda, according to a Toms River police spokesman. Diaz was fleeing police by driving his car in reverse with the driver side door open after having tried to obtain state-issued documents from a Motor Vehicle Commission office using fraudulent identification.
"Right now this remains a law enforcement matter," Christie's spokesman Kevin Roberts said. "But if reports and what is alleged in his charges are true, this crime never should have happened to begin with and is more evidence of the federal government's failure to secure the border and fix our broken immigration system."

Diaz had previously been deported back to the Dominican Republic for weapons and narcotics offenses.
In August, Christie joined GOP front runner Donald Trump in calling for the passage of Kate's Law, which calls for the creation of a mandatory minimum sentence of five years for undocumented immigrants who reenter the country after they were previously convicted of an aggravated felony or of illegally reentering the country twice. The bill is named for Kate Steinle, a San Francisco artist shot and killed by a Mexican national and convicted felon who was in the United States illegally.
The Kate's Law bill has cleared the U.S. House but has not advanced in the Senate. President Obama has threatened to veto it, fearing it will cause a swell in the federal prison population.
Diaz is being held on a no-bail detainer from the U.S. Immigration and Customs Enforcement (I.C.E.) division.
