Man Charged With Reckless Homicide In Wrong-Way Crash Has Immigration Hold

The man charged with reckless homicide in a wrong- way crash has an ice hold placed on him. But what exactly does that mean for the case?

The Warrick County Sheriff's Office says 18-year-old Osiel Marroquin was driving drunk, nearly three times the legal limit, when he hit a vehicle head on on state road 62 near Chandler. That crash killed 15-year-old Skylar Robinson-Williamson of Boonville.

Warrick County Prosecuting Attorney Michael Perry says, "I know that there are a certain level of crimes that are automatic deportation."

The Federal Immigration Department has placed a hold on Marroquin's case to determine the legality of him being in the U.S.

"If for some reason he was released from jail on a bond or something like that then he doesn't get released ICE comes down to pick him up," Perry says.

Perry thinks officials couldn't find proper documentation for Marroquin when he was booked into jail. However, Perry says if Marroquin is convicted, he will serve his sentence before immigration gets involved.

"I think some people get the idea if immigration gets involved they're going to come in and deport him and he's not going to face our courts and have to go through that process," Perry says. "That's not going to happen."

The prosecutor's office says this does not affect how they're going to handles the case. Marroquin will get the rights that everyone else has.

His initial court appearance has been set for December 27.

BOONVILLE, Ind. — A man involved in a crash that killed a Boonville High School freshman appeared in court Tuesday to face reckless homicide and multiple drunken driving charges.
An interpreter was on hand to translate the charges as they were read to Osiel Marroquin, 18, of Evansville, in Warrick County Superior Court No. 2.

The U.S. Immigration and Customs Enforcement agency also has a hold on Marroquin, according to court records. Because of that, Judge Robert Aylsworth told him that even if he were to post his $150,000-surety only bond, it was unlikely he would be released from custody.

Marroquin, who was brought into court in a wheelchair, communicated with court translator Melody Nelson in a nearly inaudible voice and nods of his head.

Aylsworth appointed Boonville law firm Martin & Martin to represent Marroquin as public defenders. He is scheduled to return to court at 1 p.m. Jan. 3.

The crash in the early-morning hours of Dec. 17 killed Skylar Robinson-Williamson, 15. She was a passenger in a Dodge Avenger passenger car driven by 20-year-old Whitney Winstead.
Winstead was released from the hospital earlier this week. Another passenger in Winstead's car, Megan Ripperdan, was still in critical condition at St. Mary's Medical Center in Evansville as of Tuesday.

Marroquin also was hospitalized after the crash but was not seriously injured, Warrick County officials said.

He is charged with reckless homicide, a level 5 felony; causing death when operating a motor vehicle with a blood-alcohol level of 0.08 or more, a level 5 felony; causing death when operating a motor vehicle while intoxicated, a level 5 felony; causing serious bodily injury when operating a motor vehicle with an blood-alcohol level of 0.08 or more, a level 6 felony; and operating a vehicle while intoxicated endangering a person, a misdemeanor.

In addition, he is charged with operating a vehicle while intoxicated causing death with a prior offense, a level 4 felony. Warrick County Prosecutor Mike Perry said that charge was filed after investigators discovered that Marroquin had a 2013 drunk driving conviction in Hillsborough County, Florida, where Tampa is located.

The most Marroquin could be sentenced to, if convicted, would be 12 years, Aylsworth told him. That is the maximum penalty for level 4 felonies in Indiana.

According to an accident report from the Warrick County Sheriff's Office, Marroquin appeared to have been driving the wrong way in the eastbound lanes of Indiana 62 when his red Ford Freestyle sport utility vehicle collided head-on with the other vehicle near Stevenson Station Road.

A caller had reported a red SUV driving the wrong way in the eastbound lanes of Indiana 62 in Chandler, Indiana, before the collision, according to the report.

Now that we have a pro- law enforcement government coming into power, I would love to see side investigations into a) how does an illegal have the means to own and operate a vehicle? b)where are they employed? c)where are they living? We need to follow up! Clean out the entire nest of illegals AND their opportunities to thrive here at our expense.

As soon as we get serious about prosecuting ALL illegal activities the faster they start leaving. It shouldn't take a tragedy for this to be happening! We've lost too many Americans already...
