    A man who allegedly killed a 16-year-old boy on his birthday has pleaded guilty to federal charges that were filed in connection with the case.

    Octavio Bringas-Posados, 50, pleaded guilty at the federal courthouse in the courtroom of Judge Shelly Dick Wednesday, June 7 to illegal possession of a firearm by a prohibited person (1 count) and illegal reentry (1 count). Brignas-Posadas and his attorney Mark Upton did not have a plea deal.

    During the hearing, Judge Dick said it is very likely that Bringas-Posadas will be deported. He responded, speaking Spanish through an interpreter, that he has no plans on returning to the U.S.

    Bringas-Posados admitted to illegally re-entering the United States after he was removed on March 22, 2012 by the U.S. Department of Homeland Security, Immigration and Customs Enforcement.

    Officials say sometime after being returned to Mexico, Bringas-Posadas illegally entered the U.S. and came to Baton Rouge.

    On March 13, 2017, Bringas-Posadas was reportedly inside his Baton Rouge home alone with Darius Plummer, 16. Plummer was reportedly at the home to visit with Bringas-Posadas' son.

    At some point, Plummer was shot and died.

    After the shooting, Bringas reportedly fled the scene. He allegedly told a relative that he was "not coming back and would not talk to police."

    The Louisiana State Police Fugitive Apprehension Task Force captured Bringas along I-10 in Lake Charles less than three hours after the shooting. During questioning, Bringas-Posadas allegedly told detectives he was playing with a gun when he mistakenly fired it.

    The firearm charge carries a maximum penalty of 10 years in prison, and the re-entry charge carries a maximum of two years. The courts will put together a pre-sentence report on the case, which normally takes around 90 days. After that, an official sentencing for the federal charges will be scheduled.

    A Mexican national who was in the United State illegally when he allegedly shot and killed a 16-year-old Baton Rouge boy on the teen's birthday in March was indicted Wednesday on a negligent homicide charge.

    Octavio Bringas-Posadas, 50, told a relative he was playing with a gun inside his Southpark Drive apartment off Airline Highway when it fired by accident, striking Darius Plummer, authorities have said.

    Plummer was the best friend of Bringas-Posadas' son.

    The negligent homicide charge returned by an East Baton Rouge Parish grand jury is punishable by up to five years in prison. Bringas-Posadas had been booked on a second-degree murder charge, which would have carried a mandatory sentence of life behind bars. It also would have required a showing of specific intent to kill or inflict great bodily harm.

    "For the victim's family, we're pleased that we're moving forward with the case," East Baton Rouge Parish Assistant District Attorney Darwin Miller said Wednesday at the 19th Judicial District Courthouse after the grand jury's decision was announced.

    Plummer's mother, Trina Plummer, chose not to comment when contacted by phone.

    Bringas-Posadas also has legal troubles in federal court in Baton Rouge. He pleaded guilty last month to federal gun and immigration charges stemming from the fatal March 13 shooting and faces up to 12 years in federal prison on those counts.

    U.S. District Judge Shelly Dick has not set a sentencing date for Bringas-Posadas, who remains in federal custody. A federal pre-sentence investigation is being conducted.

    Trina Plummer said previously her son befriended Bringas-Posadas' son when her family lived in the same apartment complex as the Bringas-Posadas family. She said she did not know of Bringas-Posadas' past arrests or that he was residing in this country illegally. She also said she had no reason to suspect he was a bad person.

    Trina Plummer has said her son stayed with the Bringas-Posadas family at one point when her own family was going through a difficult time.

    Bringas-Posadas was deported to Mexico in 2012 after a Baton Rouge drug arrest. In his federal court guilty plea, he admitted to illegally re-entering the United States.

    Dick told Bringas-Posadas last month that he likely will be deported as of result of his guilty pleas to counts of illegal re-entry into the United States and possession of firearms and ammunition by a person illegally in this country.

    "Yes, and I will not return," a shackled Bringas-Posadas told the judge June 7.

    East Baton Rouge Parish District Attorney Hillar Moore III has said Bringas-Posadas will remain in this country while the state charge is pending.

    In addition to saying the fatal shooting was accidental, Bringas-Posadas told a relative on the phone after the shooting that he was not coming back to Baton Rouge and would not talk with police, according to his arrest warrant. He was stopped on Interstate 10 in Lake Charles and arrested.

    A search of his car and residence uncovered three handguns and ammunition.

    An undocumented immigrant accused of killing a 16-year-old boy in Baton Rouge pleaded not guilty to negligent homicide in court Thursday, August 24.

    Octavio Bringas-Posadas allegedly shot and killed Darius Plummer in March. He told detectives he was playing with the gun when it went off. In court Thursday morning, 19th Judicial District Court Judge Lou Daniel appointed a public defender for Bringas-Posadas.

    That attorney advised his client to plead not guilty.

    In June, Bringas-Posadas pleaded guilty in federal court to illegal possession of a firearm and illegal re-entry.

    His next hearing is scheduled for September 26.
