A 40-year-old man trying to cross into the United States near Nogales was convicted in 1998 for fondling a minor, U.S. Customs and Border Protection said Tuesday.

Agents initially arrested Jose Rivera-Fuentes, 40, on suspicion of illegally crossing the border in Nogales on Saturday night.

During processing, a records check revealed Rivera-Fuentes was convicted in 1998 in Orlando for fondling a minor, the agency said. He had previously been deported.

Rivera-Fuentes is in federal custody pending prosecution on criminal immigration violations, the agency said.
