March, Rally Planned for Pasadena Federal Building as Court Hears Temporary Protective Status Case

Three members of the U.S. Circuit Court for the Ninth District will convene Wednesday, August 14 to consider the Trump Administration’s termination of temporary protective status (TPS) for immigrants from certain countries and there will be a march and demonstration to greet them.
The event is being organized by the National TPS Alliance with local coordination from Pasadenans Organizing for Progress.
“Join the #TPSJustice movement to defend the rights of our community as well as challenge the Trump administration’s cancellation of the TPS…” reads a circular announcing the action.
TPS is extended by the Secretary of Homeland Security to countries with ongoing armed conflict, an environmental disaster, or conditions preventing a safe return of its citizens home.
The Trump administration has decided to end the TPS designations for El Salvador, Haiti, Nicaragua, and Syria.
That decision was put on hold in U.S. District Court, which found that opponents would likely prevail with their argument that the process by which the policy was adopted is not compliant with the federal Administrative Procedures Act (APA).
The administration appealed that Oct. 28, 2018, ruling and now the case, Ramos v. Nielson, is before a three-member panel at the Ninth Circuit’s Pasadena branch.
The decision to terminate the status itself can not be overturned by a court, but the way in which it was arrived at can be invalidated.
If the administration does not prosper at the Ninth Circuit, which the president considers a rogue appellate banc, it could petition the U.S. Supreme Court or start over with an APA compliant protocol.
The lower court ruling was a reprieve for some 300,000 TPS holders from the aforementioned countries.
A 1.5-mile march to the Federal Building at 125 South Grand Avenue will convene at All Saints Church,. 132 North Euclid Avenue, 7 a.m. The rally will start at 8:30 a.m.
