Thread: Mexican native faces 5th deportation after Boaz traffic stop arrest

An illegal immigrant from Mexico who was living in Boaz now faces deportation from the U.S. for the fifth time.

A federal grand jury indicted Gerado Frasco- Gutierrez on the illegal re-entry charge.

“This was the 5th time he’d been caught inside the United States,” said First Assistant U.S. Attorney Lloyd Peeples. “This individual in fact had been caught for drug trafficking and had served time in prison back in 2007 for drug smuggling, drug trafficking.”

Peeples says Gutierrez was caught during a routine traffic stop, where his identity was checked.

Alabama’s Northern District, led by U.S. Attorney Jay Town, has prosecuted about 70 re-entry cases in the last year.

“Most of the time when they come to our attention, those cases are individuals who are also breaking the law, or they’ve broken the law while they’ve been in this country illegally,” Peeples explained. “A lot of times, just a regular illegal re-entry case, we don’t handle it. That person is just merely deported. A lot of times if they have a firearm, they’re trafficking drugs, they’ve committed a violent felony, or if they’ve done other stuff like that, those are the cases we then seek to prosecute.”

If convicted, Gutierrez now faces a maximum sentence of 20 years for his illegal re-entry charge, as he has a prior aggravated felony conviction.

“It’s a problem,” Peeples said. “You’ve got people coming here illegally. They’re able to get in through the border and then they make their way through other parts of the United States.”

“We need to make sure folks know a very small percentage of the people who reenter are serious criminals,” countered Isabel Rubio, Executive Director of the Hispanic Interest Coalition of Alabama.

She sees re-entry differently.

“Most people who re-enter are coming back to jobs and families that they’ve left behind,” she said. “We certainly believe in any criminal has committed a serious crime, they need to be dealt with the way the law has spelled out for them.”

Rubio added serious crimes should be prosecuted fairly and with due process, no matter the ethnicity of the offender.

Peeples explained 70 new prosecutors nationwide have been dedicated to immigration cases.

As for here in the northern district, several prosecutors here handle the cases, in addition to their other duties.

That is why we need a nationally mandated E-Verify, tougher penalties against employers that hire illegals, and an intense interview/investigation to reveal the illegals other family members that are here illegally. They need to be deported as a family, not individually.
