A Migrant Teen Died In Border Patrol Custody After Being Detained For A Week

A 16-year-old Guatemalan boy died Monday after being detained for a week by US Border Patrol agents in Texas.

Carlos Gregorio Hernandez Vasquez is the fifth Guatemalan minor to die after being apprehended at the southern border since December, officials said. Four have died in US custody, while one died in a hospital.


Hernandez was apprehended on May 13 after crossing the border without authorization near Hidalgo, Texas. The teen was transferred from a processing center to a Border Patrol station and was set for placement in a shelter for migrant youth when on Sunday he told staff that he wasn't feeling well. A contracted nurse practitioner determined he had the flu and Border Patrol agents went to a local pharmacy to pick up medication, a CBP official told reporters.


Hernandez was then transferred to a Border Patrol station in Weslaco, Texas. On Monday, he was found unresponsive. The cause of death was not known and the case is under review, officials said. While Hernandez wasn’t hospitalized after he was diagnosed with the flu, the CBP official said the decision was left up to medical care providers.


Guatemala's foreign ministry said Hernandez was from Baja Verapaz, an area north of Guatemala City, and was hoping to reunite with family who was already in the US. Ministry officials warned parents not to endanger the lives of their children by sending them on an "irregular" journey to the US border.


The death comes as the Trump administration continues to confront the increase of migrant families and unaccompanied children crossing the border. In early April, the government division responsible for unaccompanied migrant children, the Office of Refugee Resettlement, said it was on track to detain the most children in its history. Meanwhile, last month, almost 100,000 families crossed the border, according to border officials.


Border Patrol can legally hold unaccompanied minors for up to 72 hours. Asked why Hernandez was held beyond that period, a CBP official said that ultimately ORR decides who they can take based on available space.
“The men and women of U.S. Customs and Border Protection are saddened by the tragic loss of this young man and our condolences are with his family,” said John Sanders, acting CBP commissioner. “CBP is committed to the health, safety and humane treatment of those in our custody.”
In a speech in El Paso in March, then–CBP commissioner Kevin McAleenan said that the border had reached a “breaking point."


At the time, McAleenan, now acting secretary for the Department of Homeland Security, said his agents were trying to prevent a “tragedy” at their facilities — but predicted that the high number of migrants and medical issues that it was only a “matter of time."


In recent weeks, a 2-year-old boy from Guatemala who was detained by US agents at the border died, and a 16-year-old unaccompanied boy also died in government custody in Texas.
Sen. Jeff Merkley, a Democrat from Oregon, told BuzzFeed News that his office would be demanding answers.
"The gross inadequacy of the so-called ‘welfare checks’ is patently obvious, and now five children have lost their lives as the price. I want to see specific plans from the administration to provide real medical checks, including checking vitals, on every child who comes into our government’s custody," he said. "We need urgency, and we need answers, not excuses.”


Astrid Dominguez, director for the ACLU Border Rights Center, said the latest CBP in-custody death was appalling. The ACLU filed a complaint last week regarding the conditions of migrants detained in Border Patrol's Rio Grande Valley facilities, where Hernandez was held.


"We’ve received complaints from migrants about inhumane conditions, prolonged detention, lack of shelter, poor medical attention and abuse from agents," Dominguez said in a statement. "We need more than an investigation, children ought to be protected. CBP needs to hire child welfare and medical professionals to humanely receive and process all arriving families.”

Brother of Guatemalan teen who died in U.S. Border Patrol custody speaks out


Last Updated May 22, 2019 8:30 AM EDT Dallas — A 16-year-old boy from Guatemala who survived the thousand-mile journey to the U.S. border died Monday in U.S. custody.
The Congressional Hispanic Caucus is calling for a federal investigation after the fifth migrant child since December died after arriving at the U.S. border.
"This is an epidemic of death. Nobody had died for 10 years. And in the last six months, you've had five deaths," Rep. Joaquin Castro said.

On May 19, he told the medical staff he didn't feel well and was given Tamiflu. He was found dead the next day.
By law, immigration officials have three days to transfer unaccompanied minors to the Office of Refugee Resettlement (ORR) — a special division that deals with children.


CBS News spoke to one of Hernandez's brothers, in New Jersey, who just wants to know what happened.
"The hardest part about it all is what happened to him because we never thought this would happen in a place where he's supposed to be in a better place," he told CBS News through a translation.
An official with the Guatemalan Consulate in New York told CBS News late Tuesday that Carlos was traveling with his sister. They were separated when apprehended by U.S. Customs and Border Protection because she's a 21 year-old woman and Carlos was a 16 year-old.
As a result of Carlos' death, the consulate asked CBP to release his sister, and the agency did. She was on her way to join her bothers in New Jersey.
The five Central American boys and girls who have died since December ranged in age from 2-1/2 to 16.

Four died in Border Patrol facilities, while the youngest died in an El Paso hospital after being released from government custody.
Acting Homeland Security Secretary Kevin McAleenan addressed the overcrowded southern Border Patrol facilities on Sunday's "Face the Nation."
"I'm very concerned about the conditions," he told moderator Margaret Brennan. "These are not appropriate facilities for families and children in particular. These are police stations built for single adults."


To ease the overcrowding, the Department of Homeland Security is now flying migrants to other cities across the U.S., just to start the immigration process.
CBS News was the only broadcast network on the tarmac in Brownsville, Texas, as Border Patrol and ICE officials loaded three busloads of migrants onto a jet.
Some family units could be seen: moms, dads and younger kids. From here, government officials check their pockets to see if the migrants have anything in them. They are then loaded onto an airplane and from there that plane will take off and transport them to a destination where they will be further processed. The migrants don't know where they are going.
Some migrants were taken on a short flight, roughly 400 miles, to Del Rio, Texas. The journey is expensive: each flight costs taxpayers between $20,000 to $60,000 each. ICE told CBS News that's about $9,000 an hour.
A United Nations monitor asked the Trump administration for a formal visit to U.S. Border Patrol facilities; they have ignored those requests.

Democrat Lauren Underwood Accuses Trump Admin of Murdering Children

First-term Democrat Rep. Lauren Underwood of Illinois accused the Trump administration of murdering children during a hearing with Acting Secretary of the Department of Homeland Security Kevin McAleenan on Wednesday.

Underwood said:

People keep dying, and so this is obviously more than a question of resources. Congress has been more than willing to provide the resources and work with you to address the security and humanitarian concerns, but at this point, with five kids that have died, 5,000 separated from their families, I feel like — and the evidence is really clear — that this is intentional. It’s intentional. It’s a policy choice, being made on purpose by this administration, and it’s cruel and inhumane.

McAleenan responded: “That’s an appalling accusation, and our men and women fight hard to protect people in our custody every single day. We’ve asked for those resources three weeks ago, it hasn’t been responded to by Congress, and we’ve asked for changes in authority for the last three years that would have prevented this from happening.”
Ranking Member Mike Rogers (R-AL) objected, and moved that Underwood’s remarks be “taken down.”
After the chair, Rep. Bennie Thompson (D-MS), asked Underwood to clarify her remarks, she essentially repeated them.
Rogers protested: “Mr Chairman, you cannot impugn the character of the witness by stating that he intentionally murders children.” He asked that her words be taken down again.
“I did not say ‘murdered’,” Underwood objected, claiming that she merely said “that five children have died as the result of a policy choice that he stands by.”
The chair rejected Rogers’s request, ruling instead that Underwood’s language was “appropriate, and that it should not be taken down.”
A vote was taken to appeal the ruling of the chair, and after considerable confusion, the chair ruled that the committee was in recess. When the vote resumed after the recess, the committee voted 9-to-7, entirely on party lines, to overturn the chair’s ruling, and Underwood’s words were taken down. There are 18 Democrats and 13 Republicans on the committee.
