MCALLEN, Texas – Border patrol agents have arrested three U.S. citizens who refused to answer immigration questions at a checkpoint 29 miles north of the border with Mexico. Two of the men recorded the verbal confrontation with their cell phones.

Earlier this week, Douglas Eugene McDaniel, Keith Introligator and his brother Joshua Introligator all went before U.S. Magistrate Judge J. Scott Hacker during separate hearings where he formally charged them with impeding the duties of a federal officer and set their bonds.

On Monday Hacker set bond for McDaniel at $75,000 and on Tuesday he set bond for the Introligator brothers at $30,000 each.

Keith and his brother Joshua drove their pickup truck to an immigration inspection station on I-35 about 29 miles north of the Laredo border on Sunday shortly after 11:15 a.m.; the brothers had their cell phones out and were recording as they pulled up to the inspection station where a U.S. Border Patrol agent asked them to lower their window, court records obtained by Breitbart Texas show.

In recent months activists have taken to YouTube and other social media websites to challenge the legality of border patrol checkpoints north of the border with Mexico where those who drive through are asked about their citizenship and may be asked to show identification.

Keith, who was the driver, lowered his window about four inches and when the agent asked about his citizenship he replied, “I’m not going to answer that.” Joshua also refused to answer the questions as he too recorded the encounter. The agents noted in their documents that the two brothers were smiling and laughing during the verbal confrontation.

The agent told the brothers to move their truck to a secondary inspection but they refused. The agent then called for a supervisor to help who told the Introligator brothers that they had legal authority to enforce immigration laws. The two agents asked the men to move their truck but Keith turned it off and refused to answer more questions about his citizenship. That is when the agents arrested the two men.

During the arrest, Keith told the agents that he had a Texas concealed handgun license and had handgun in his waistband. The agents ended up finding a .45 caliber Taurus pistol of unknown model, a 9mm Springfield XD pistol, and three Ak-47 magazines but no rifle. It remains unclear if the second handgun and the rifle magazines were in the vehicle or on Keith’s person.

U.S. Border Patrol agents arrested McDaniel -from Helotes Texas- on Friday around 9:40 p.m. when he pulled up to the same immigration inspection station on I-35. When asked by an agent about his citizenship, he replied “white”, court records obtained by Breitbart Texas show.

When the agent asked again if he was a U.S. citizen, McDaniel replied “I am not going to answer that question because I know my Constitutional Rights”; the agent told him that he had legal authority to enforce immigration law and then asked the Helotes man to move his truck to a secondary inspection area which he also refused, court records show.

The agent called for a supervisor and the two asked McDaniel to move his truck which he again refused. During the verbal confrontation McDaniel asked the agents to call the local police because the border patrol agents were not peace officers and didn’t have the authority to arrest him or question him. The agents ended up arresting him and turning him over to prosecutors on the charge of impeding their duties. Court record don’t mention if McDaniel had a video camera or not.

I tend to view these protesters as trouble makers having heard this same story from various agents, they are simply doing a job to catch illegals what these men done was make it much more difficult for the agents to do there job.

Over the past year, there's been a marked increase in the number local and state police officers working with federal Homeland Security agents along state highways. Perhaps this has always been the case and I never noticed (doubtful). More likely, it's the logical result of a Department of Homeland Security policy of throwing money at local and state enforcement agencies in the form of Homeland Security grants.



These federal grants are, of course, designed to buy more than just overtime pay for local police and new equipment for state agencies. They're designed to buy loyalty. Specifically, loyalty to federal handlers and policies at the expense of local communities and individual rights.

In a recent example of the increasing interchangeability of local and federal 'law' enforcement, I've included correspondence below from an individual who passes through Southern Arizona's I-19 Border Patrol checkpoint on a regular basis:

"I'd like to share with you last night's experience at the checkpoint on I-19. Since the last times that I have sent you messages I have crossed this same checkpoint many times. Each time, I answer citizenship related questions only so I am sent to secondary almost always.

This of course is wrong and you and I know this. I never consent to searches and the dog is passed around the car. I am then allowed to leave.

However, last night was a little different. The reason might be because my previous encounter involved a hostile agent demanding my ID because I refused to disclose my destination after being asked about 8 times by 3 different agents. I took all of their names and left.

Anyways.. last night me and my friend were on our way to Tucson. At primary the agent asks if we are U.S. citizens and we respond yes. He then asks if he can search my trunk and I said no. We're then sent to secondary. A DPS agent approaches and asks why I did not have my seatbelt on. I told him that I had just taken it off. I received a ticket for not wearing my seatbelt.

I told him he was being unreasonable and that this was an immigration checkpoint. His incoherent response involved something along the lines of "I could put up a stop sign and make people stop if I wanted to.

Not only that but I waited about 20 minutes for them to finish searching my car. Again, the K-9 was used as a pretext. They went through my bags and searched the whole car.
Everything that happened was obviously beyond the scope of power given to them. My friend suggested that it might be personal now which is a possibility."

"I'm charged with violating 28-909(A)(1). It was a DPS officer. His name is M. Anguiano badge no. 05915. I'll take a photo of the ticket and forward it to you."

"There were about 2 or 3 DPS cars at the checkpoint so i think they were probably working together. I came up on the left lane. When I lowered my window I was focusing on the BP agent. I can remember seeing a DPS in between the two lanes. My friend told me that this was not the same officer that gave me the ticket."

To sum up, travelers on their way to Tucson along I-19 were stopped at a Border Patrol checkpoint no where near the border where they answered all immigration related questions directed at them. Not satisfied with the responses, the stopping agent asked if he could search the vehicle's trunk without reasonable suspicion or probable cause. When the driver exercised his rights by refusing to consent to a search, the agent diverted the vehicle to secondary inspection despite clear Supreme Court guidance requiring probable cause or consent to extend a detention or search a vehicle:

"...We have held that checkpoint searches are constitutional only if justified by consent or probable cause to search....And our holding today is limited to the type of stops described in this opinion. -'[A]ny further detention. . . must be based on consent or probable cause.'" - U.S. v Martinez-Fuerte (1976)

At secondary, a drug dog was used to search the vehicle absent consent. It's unclear if the agents claimed the dog alerted or if they searched the vehicle despite lacking probable cause or consent. Regardless, twenty minutes later nothing illegal had been discovered (sound familiar?).
At some point during the time frame the travelers were being detained by Border Patrol agents at secondary, Arizona DPS officer M. Anguiano, badge #05915, approached the vehicle and ticketed the driver for not wearing a seatbelt. It's unclear why Arizona DPS Officer Anguiano was hanging around a Border Patrol checkpoint to begin with or why he felt the need to participate in the travelers detention at the hands of federal agents. What is clear however is that the statute the driver was charged with violating didn't apply to the situation:

"28-909(C): A peace officer shall not stop or issue a citation to a person operating a motor vehicle on a highway in this state for a violation of this section unless the peace officer has reasonable cause to believe there is another alleged violation of a motor vehicle law of this state."

Since the officer didn't cite the driver with any other traffic violation, the statute requirements were not met. In other words, DPS Officer Anguiano assisted Border Patrol agents at a federal checkpoint in harassing a traveler by maliciously citing him with a traffic infraction in violation of the very statute referenced by the officer.
How much more harassment at the hands of overzealous federal and state 'law' enforcement agents must we suffer before we put an end to suspicionless checkpoints inside America?

Some information here folks ...I 35 and I 19 are super highways that they are building or wanting to build.. These super Highways are to go from Mexico, clear on up to Canada, it is part of Nafta and the free trade agenda. It will ( I am thinking) by-pass our border inspection...The other name used was "Trans Texas Corridor" we were fighting that or I was a few years back, actually before I started posting here. There was supposed to be 3 one West, one East, and the Middle of the Country, that was called the Trans Texas Corridor!!!!! I am not sure what is going on with this now but Clinton first brought it in with his Nafta crap!!! Land was being bought out and etc in perpetration for this!! This is part of Agenda 21. Also they were trying to take control of our roads and construction of it all and it was under the quise of "Public Private Partnerships" deals...We get the bills, and they get the profit on their pay tolls and contracts......Not everything is as it seems, there is more underfoot!!!!

Mr. Perry at work securing our borders. I would like to know more about this story as I am from Conroe also.

The 2 checkpoints north of San Diego, on I-5 and I-15, not only catch lots of illegal aliens they also recover stolen cars and trucks (most driven by drug smugglers or human smugglers) and seize TONS of drugs.
I have been by them many times and never sent to secondary.
I have no problem with them being there.

I've been through hundreds of these checkpoints without any problems, they do ask if your a citizen even if white they require an answer as many people coming in illegal are white, a simple yes sir I'm a citizen, normally I receive a smile and a wave, also I have had Mexican-Americans riding with me they were also ask and never sent to secondary, however once you present yourself as confrontational then you sit off suspicion to the agent.

Many patriot groups don't like the process and I do understand that because I certainly don't like the pat downs by TSA at airports, however the action on the border and up to 40 miles north of the border is a war zone IMO, sadly it must be treated in a different manner.

TUCSON, AZ (Tucson News Now) -Border Patrol agents seized five vehicles, more than $1.1 million in narcotics and apprehended 23 suspects in separate incidents within a week.

Nogales Border Patrol agents arrested two people suspected of alien smuggling when they found an adult El Salvadorian woman in the trunk of a Chevrolet at the Interstate 19 checkpoint near Tubac on July 6.

On July 8, agents arrested a U.S. citizen driving a Plymouth sedan with two illegal immigrants in the trunk at the same checkpoint, according to a Tucson Sector Border Patrol news release.

On July 9, Willcox Border Patrol agents arrested three subjects traveling in a Chevrolet Silverado for narcotics smuggling at the Highway 80 checkpoint near Tombstone. A canine unit alerted agents to the car where they found 37 wrapped bricks of marijuana concealed in a false compartment in the truck’s bed. The estimated valie of the drugs was more than $119,000.

On July 11, a tip to law enforcement helped agents apprehend of a U.S. citizen driving a U-Haul truck near Tucson with seven Mexican nationals in the back of the truck. Border patrol officials said the Arizona Department of Public Safety assisted agents with the vehicle stop.

That evening, Douglas agents arrested a man identified as a “Special Interest Alien” from the country of Laos. Record checks revealed he was removed from the U.S. and had prior convictions, including assault, criminal mischief, disorderly conduct, reckless endangerment, theft and illegal possession of weapons.

On July 12, a Tucson Station Border Patrol agent seized a vehicle and arrested a U.S. citizen at a DPS traffic stop near Tucson for suspected alien smuggling. Agents found two illegal immigrants in the car trunk.

Later that day, Casa Grande Border Patrol agents seized more than 2,000 pounds of marijuana, worth an estimated $1 million, from a Chevrolet pickup truck they said was abandoned by smugglers near Santa Cruz. Agents later arrested two suspects near Pisinemo, Ariz.

All of the drugs and vehicles were processed for seizure.
