MURFREESBORO TN — Police on Thursday charged an undocumented Mexican immigrant with statutory rape of a 14-year-old girl.

Diego H. Hernandez-Luna, who told police he was 22, was booked into the Rutherford County jail on the charge following an investigation that involved Murfreesboro Police Detective Tommy Roberts and a Tennessee Department of Children’s Services investigator, according to a Murfreesboro Police report.

Roberts wrote in an arrest report that he received a referral from the DCS investigator, Kevin Smith, about an underage girl who was having sex with Hernandez-Luna.

Smith had interviewed the girl, who told him “she and Mr. Hernandez-Luna would go to a hotel on South Church Street and have sexual intercourse,â€
