RALEIGH, N.C. — Despite outcry from illegal immigration watchdogs, a House committee on Wednesday easily approved legislation that would grant driving permits to North Carolina residents who are in the U.S. illegally.

House Bill 328 would create a "restricted ID" for the state for undocumented residents who undergo fingerprinting and background checks and prove their identity and state residence.

"This bill has nothing to do with immigration, immigration law or immigration reform," said sponsor Rep. Harry Warren, R-Rowan.

"This is a bill about law enforcement and public safety."

The measure is designed to reduce the risk of identity theft and make it easier for law enforcement to identify criminals through a new state database of undocumented people in North Carolina, Warren said.

The bill also would make producing or selling counterfeit identification documents a felony – it is currently a misdemeanor – and prohibit municipalities and nonprofit groups from creating their own ID cards for immigrants.

Driving privileges would be attached to the restricted ID, provided applicants pass a state driving test and obtain liability insurance coverage, but Warren said the document "in no way should be confused with a North Carolina valid driver's license."

Although it would allow holders to drive on North Carolina highways, the restricted ID could not be used as a form of identification to vote, apply for public assistance, access government buildings or board a plane, he said.

Still, several longtime critics of U.S. immigration policy blasted the bill because of the driving privileges portion, saying they had no problem with the rest of the proposal.

"I want you to shut this bill down or take the license provision out of there," said WIlliam Gheen, president of the Americans for Legal Immigration PAC, noting that advocates worked a decade ago to stop North Carolina from issuing driver's licenses to undocumented immigrants.

"It doesn't make any sense as to why someone would be in favor of enforcing immigration laws on the one hand and in the same law be encouraging illegal immigration," said James Johnson, president of North Carolinians For Immigration Reform and Enforcement.

"Giving illegal aliens a North Carolina driver's license or permit – or whatever you want to call it – would only encourage more."

Ron Woodard, president of NC Listen, compared the driving permit to giving undocumented residents amnesty.

"Why reward people illegally in our nation with a legal driving permit and help them legally drive to a job that belongs to a citizen?" Woodward asked.

Warren dismissed arguments that the driving permit would attract hordes of immigrants to North Carolina. Thirteen other state offer licenses or driving permits to undocumented residents, he said, but none have the hoops House Bill 328 sets up to obtain one, he said.

"I would go to Maryland, I would go to Illinois to get a driver's license. I wouldn't come to North Carolina and submit to fingerprints and a criminal background check for a one-year permit," he said.

"Driver's licenses don't motivate immigration; economics do," he continued. "People don't sneak into the United States to get a driver's license, and they don't go to Arizona or Florida to get driver's licenses. They go there to work."

There are 90,000 to 110,000 undocumented immigrants in the state who are old enough to drive, but few have passed a driving test or can be held financially responsible if they are involved in a crash, Warren said.

"There's nothing wrong with issuing a permit. It's acknowledging the fact that we have people driving without insurance, without being vetted, without being tested," he said. "To recognize that and for us, as a legislative body, to do nothing about it is, in my opinion, a dereliction of duty."

Fred Baggett, legal counsel for the North Carolina Association of Chiefs of Police, said his group favors the bill because it would reduce the fraudulent IDs – or complete lack of identification – that officers now deal with on the streets.

The bill passed the House Judiciary I Committee on a voice vote with little debate and now heads to the House Finance Committee before going to the floor.

IMO the problem is that, except for a few people like Senator Jeff Sessions and a handful of Tea Party folks, nobody is promoting an American point of view. Demos are selling out Americans, to get the votes of those Undocumented Democrats, and the Repub leadership is selling out Americans, to give their big-money donors the additional surplus labor that those donors covet.

And they're all lining their pockets with bribes from the cartels behind this travesty. It's more than cheap labor because legalized illegal aliens offer no hiring advantage and when illegal aliens are legal they no longer have a reason to support catering to more illegals who will be legalized and handed the moon at their expense. The forces behind this disaster are all connected in one way or another to the evil of the foreign cartels who are the only ones who profit from this treason and the politicians who enact the policies and laws that make that profit possible.

I realize that it's our nature to assume the best of people, but there comes a time when we must face the reality as it exists, which in my opinion is he majority of our elected and appointed officials are owned by the foreign cartels. That's why nothing changes, that's why they continue to offer the unthinkable as solutions when they're clearly not solving a problem but in fact escalating it, that's why they support giving illegal aliens drivers' licenses, in-state tuition, tax credits for tax they never paid for children who aren't even in our country, social security numbers, work permits, amnesty, pathways to citizenship, automatic birthright citizenship, free education, health care, charity and government welfare.

No rational person in the world would do this to their citizens or nation, yet the majority of our politicians and public officials have done it for years. So the only rational explanation for their continued irrational treasonous behavior is ... they're on the take with the cartels.

In Philadelphia Pa, illegals have dl's. I don't recall any legistature to ok that. My understanding is you apply for the dl, are asked for a ssn, you apply & receive the SSN and you are good to go. The next move is automatic voter registration with the dl. So the new voting block is in like flint.

Someone should mandate nationwide that the dl's be marked NON citizen, therefore, no voting in elections would be the bottom line.

They are not returning to their countries as long as they have children born here (which they all have) and have a job here. They do not live with the children so the male also pays no child support and the burden of healthcare & monies is on the taxpayer. This is gov't ok'd.

Stop birthright citizenship, chain migtation (every illegal will be able to bring ALL family members to extended cousins), stop dl's unless marked NON citizen.

They sneaked the same kind of thing, they called Driver Authorization Cards, through in Nevada. There was a media blackout on it until it was passed. It's caused huge crowds at the DMV and created gigantic wait times because about 9% of the population of Nevada are illegals. The illegals taking the test even get interpreters because the don't speak English. It's disgusting. I wish you luck in fighting this.

Tennessee did this for a time and it was wall to wall hispanics. You would wait for hours and watch the buses or vans bring them in to the DMV. You would also see one or two probable illegals help another probable illegal to take the tests. When the drivers licenses for illegal aliens stopped, there were the normal, 2, 3,4 people. The sad part is that it helped to foster even more illegal immigration to Tennessee with endless thousands of illegal aliens showing up all over small cities and towns. Some agents with the DMV were found to be assisting the illegal population. Now Tennessee is heading back down a similar road with calls for in-state tuition and the drivers licenses to DACA recipients which will destroy the state even more with illegal immigration.

I hope good sense will prevail soon.

Wrong. Giving licenses assists, enables, and encourages. It all works together to increase illegal immigration.
