Illegal Immigrant Has Parole Hearing
Joycelyn Gardiner Killed In 2007 Nashville Crash

NASHVILLE, Tenn. -- An illegal immigrant who hit and killed a Tennessee State University student in 2007 had a parole hearing Thursday.

Of the seven-member parole board, one member sat in on the proceedings and recommended not to grant Victor Benitez parole. Four votes are needed, and it will take two to three weeks before other votes on the matter are tallied.

That board member also recommended not to have another hearing until 2013.

Benitez pleaded guilty to vehicular homicide charges in June of 2007. He was driving drunk, ran a red light and hit Joycelyn Gardiner at the intersection of Old Hickory Boulevard and Nolensville Road.

Gardiner was killed in the crash, just months before she was scheduled to graduate.
