Man involved in Nebraska ICE operation pleads guilty to conspiring to harbor aliens

    Juan Pablo Sanchez-Delgado

LINCOLN, Neb. — Juan Pablo Sanchez-Delgado, 40, of Mexico pleaded guilty to conspiring to harbor aliens on Tuesday, according to United States Attorney Joe Kelly.

Sanchez-Delgado admitted that between January 2015 and July 2017, he conspired with supervisors at multiple agricultural corporations to supply those companies with illegal immigrant workers who were not authorized to work or remain in the United States, according to United States Attorney Joe Kelly. The corporations contracted with Sanchez-Delgado in an attempt to avoid criminal responsibilities for labor violations.

Sanchez-Delgado, an illegal immigrant himself, provided hundreds of illegal workers to the corporations.

According to United States Attorney Joe Kelly, Sanchez-Delgado received money from the companies and also collected money from the illegal immigrants working by pretending to withhold state and federal employment taxes. He also charged illegal immigrants to pay a $50 to $75 check cashing fee as they were required to cash their paychecks at one of Sanchez-Delgado’s businesses. Sanchez-Delgado generated approximately $5,648,519 through this scheme.

A plea agreement included Sanchez-Delgado agreeing to forfeit four residences in Las Vegas, Nevada, with more than $1 million in equity along with forfeiting bank accounts and cash totaling more than $178,000. Both were from harboring conspiracy.

Sanchez-Delgado could face up to 10 years in prison and a fine of up to $250,000 for conspiring to harbor aliens for financial gain.

Sentencing is set for May 31, at 11 a.m. in Lincoln.

Sanchez-Delgado was one of 17 people federally indicted in a Nebraska ICE operation.

The investigation of this case by Homeland Security Investigations.

17 people federally indicted in Nebraska ICE operation

LINCOLN, Neb. — A federal indictment, unsealed Wednesday, is revealing more about an Immigration and Customs Enforcement operation in several north Nebraska towns that led to the arrest of 133 people in three states.

Seventeen people are indicted in U.S. District Court over incidents that allegedly all occurred between January of 2015 and last month.

A grand jury indictment said illegal immigrant Juan Pablo Sanchez Delgado, Magdalena Castro Benitez - who had previously been deported and returned - and her citizen son Antonio de Jesus Castro started the company JP and Sons, LLC and J Green Valley, LLC to provide jobs for undocumented immigrants in Nebraska, Minnesota and Nevada.

It said those companies had contracts with Elkhorn River Farms, LLC, O'Neill Ventures, LLC, GJW, LLC and other companies to supply workers.

But, court records said Sanchez Delgado and de Jesus Castro failed to complete hiring paperwork and used different names and social security numbers to conceal worker's identities.

Also arrested Wednesday were citizens Eric Beringer and Christopher Thurlow, who are said to be supervisors at Elkhorn River Farms. According to the indictment, they assisted in employing Jaime Garcia under a fake identity.

At O’Neill Ventures, court documents allege legal immigrant and supervisor Asiyadeth Jimenez-Castellon and Mayra Jimenez - also a legal immigrant from Mexico, who was a supervisor and human resources specialist -assisted in employing illegal workers.

The indictment said citizen John Glidden did the same as a supervisor at GJW.

It said more than $8 million in financial transactions were done through company accounts at Great Western Bank that were controlled by Sanchez Delgado.

Three women are accused of helping turn paychecks into cash for undocumented immigrants.

Alma Hernandez Moreno and Aracely Heredia Martinez are also illegal. Heredia Martinez has already been deported to Mexico before, according to federal documents.

Anayancy Castro Hernandez is a DACA recipient and employee at Great Western Bank.

Court records also said, the women assisted undocumented immigrants "with transferring the proceeds of unlawful employment into the United States by wire transfer to countries in Central and Southern America and by withholding money from those aliens and unlawful employees at Juan Pablo Sanchez Delgado's direction."

The conspiracy also includes an O’Neill restaurant called La Herradura, according to the indictment.

It said citizen John Good let Sanchez Delgado and Castro Benítez conceal commercial assets - like the restaurant - in his name.

It said Good also provided a home for Sanchez Delgado to hide him from immigration authorities.

The indictment said Sanchez Delgado made illegal immigrants convert their paychecks at his grocery store and money serving business, while he pocketed money he told the workers was being held for federal taxes.

It said Sanchez Delgado, Castro Benitez and de Jesus Castro deposited about $5,648,519.23 in proceeds. Sanchez Delgado and Castro Benitez are accused of buying property in Las Vegas, Nevada, with that money.

Mistrial declared for one of three defendants accused of harboring illegal immigrants

Mistrial declared for one of three defendants accused of harboring illegal immigrants in O'Neill

By Paul Hammel / World-Herald Bureau 1 hr ago

LINCOLN — One defendant was dismissed from a complex trial Wednesday over an alleged conspiracy that led to one of the state's largest immigration raids.

John Good, an Atkinson businessman, had been accused of money laundering and two charges related to harboring illegal immigrants in connection with a staffing agency established in O'Neill to provide undocumented workers to hog confinements, a tomato greenhouse, a potato packing facility and other farm-related businesses.

But on Wednesday, U.S. District Judge John Gerrard dismissed the money laundering charge against Good, ruling that federal prosecutors had failed to provide evidence of that crime. The judge also ordered a mistrial on the other two charges facing Good, ruling that testimony against two other defendants had made it impossible for Good to receive a fair trial.

Good, who could be retried, then walked out of the federal courtroom. He and two other O'Neill-area residents have been the subject of an 8-day trial over charges that they helped Juan Pablo Sanchez-Delgado and his family earn millions by providing illegal workers and running an O'Neill restaurant.

"He's really relieved about the money laundering charge," said Good's attorney, Dave Domina of Omaha. That, he said, was the most serious of the three charges Good faced.

Domina added that his client has a "really, really strong case" against the other two charges, that he harbored illegal immigrants and conspired with Sanchez-Delgado to harbor them, if federal prosecutors decide to retry him.

Mike Norris, a U.S. Attorney's Office spokesman, said Wednesday that it would be determined later whether Good will be retried.

Good and two others were among 130 people detained following an Immigration and Customs Enforcement raid in August of 2018 that involved 400 law enforcement officers, and touched operations as far away as Las Vegas and Minnesota.

The trio were the only three to contest charges against them, leading to a complicated trial, with three defendants standing trial for essentially three separate conspiracies. Jurors have been constantly warned that testimony being presented about one of the conspiracies should not be considered in judging the guilt or innocence of those involved in the other conspiracies.

The trial for the two remaining defendants, John Glidden, a manager of hog confinements, and Mayra Jimenez, a secretary at a massive tomato greenhouse in O'Neill, is expected to conclude on Friday.

Sanchez-Delgado has pleaded guilty and is awaiting sentencing. He faces up to 10 years in prison and a $250,000 fine for his role.

Glidden is accused of lining up illegal workers and providing housing for them. During the trial, he was heard on a wiretapped phone conversation discussing how one of the workers supplied by Sanchez-Delgado had just received his paperwork to become "legal."

Jimenez, the tomato greenhouse secretary, is charged with knowingly obtaining illegal employees for that business. Sanchez-Delgado testified that she had asked him to set up a staffing agency as a "middleman" because of a labor shortage in the area. He testified she was translating the request for another tomato plant worker.

Domina pointed out more that once during the trial that Good had nothing to do with providing or obtaining illegal workers. The defense attorney also said that there were no bank records showing that his client profited from helping Sanchez-Delgado.

Good had sold a home to Sanchez-Delgado, financing the purchase for him and then keeping his name on the deed (rather than Sanchez-Delgado's), according to court testimony, which prosecutors claimed helped hide the illegal status of Sanchez-Delgado. Good also obtained a liquor license for an O'Neill restaurant run by Sanchez-Delgado, who, because he was in the country illegally, could not obtain one.

Domina had said his client performed "acts of kindness" for Sanchez-Delgado but didn't know he and his wife were in the country illegally. The entire O'Neill community, Domina maintained, considered Sanchez-Delgado and his wife legal residents. Domina filed a motion for a mistrial, or a dismissal of charges, on Wednesday, maintaining the prosecutors had failed to show Good was part of any conspiracy.

After Judge Gerrard ordered a mistrial for Good, attorneys for Glidden and Jimenez also moved for mistrials for their clients. But the judge rejected the requests.

Central Figure In O'Neill Immigration Raids Sentenced

    November 27, 2019
    by Fred Knapp

A man who supplied workers who were in the country illegally to agricultural businesses in and around O’Neill, Nebraska was sentenced Wednesday to 10 years in federal prison.

Juan Pablo Sanchez Delgado pled guilty to conspiracy to harbor illegal aliens. He ran staffing companies that supplied workers to a tomato plant, a potato plant, hog, cattle, and poultry operations. Those operations were locations targeted in immigration raids on Aug. 8, 2018 in which over 130 people were arrested.

Sanchez-Delgado's wife, Magdalena Castro-Benitez was sentenced to two and a half years in prison for what the U.S. Attorney’s office described as serving as her husband’s “money manager.”

In a recent trial of other alleged conspirators, workers testified that Sanchez Delgado didn’t pay them for all the hours they worked, withheld money for taxes he never paid to the government, and charged workers for cashing their paychecks at his grocery store. Meanwhile, he and his wife bought three houses in Las Vegas worth more than $1.5 million. The U.S. Attorney’s office says Judge John Gerrard approved a preliminary order for those houses to be forfeited, and will determine the final restitution to be paid to workers who were victimized later.

Please raid the Mayors and Governors offices and prosecute them for harboring, aiding and abetting illegal aliens.

Charge them with EMBEZZLEMENT of our tax dollars, misappropropriation of those funds, for aiding and abetting illegal aliens, paying their bills, and encouraging them to LIVE in our country illegally with monetary benefits and taxpayer funded benefits reserved FOR the American people.
